RE: Goodheim & Ross Commercial Condominiums - Insubstantial
Plat Amendment
DATE: July 28, 1992
SUMMARY: The Applicant wishes to amend the condominium plat to
reflect the expansion of Unit #2 into common hallway area. The
remodel was accomplished under a 1987 building permit. No other
change to the structure is involved in this amendment. This
proposal qualifies as an insubstantial plat amendment, and shall
be approved by the Planning Director.
APPLICANTS: Goodheim & Ross Condominium, represented by Dwight
Shellman.
LOCATION/ZONING: 100 S. Spring, Unit #2• The property is zoned O
"Office".
BACKGROUND: In 1987, building permit #10217 was approved by Zoning
Enforcement Officer Bill Drueding. The Certificate of Occupancy
was issued in December 1987. Please see Attachment "A" for sketch
of revisions to Unit #2.
REFERRALS: On July 22, Engineering, Zoning, and Planning staff met
to discuss this item. The following are official referral
comments:
Engineering: (Chuck Roth)
1) Regarding the encroachment of the structure in the Main Street
right-of-way, the Owner's Certificate shall include the following
language: "In addition, Owner does hereby acknowledge the
encroachment of the north wall of the structure into the Main
Street right-of-way and agrees that if the structure is removed for
any reason, any new structure will be built inside the property
line." Also, the City Engineer's signature block shall include the
following language: "In addition, the City Engineer does hereby
acknowledge the encroachment shown hereon with the conditions set
forth in the Owner's Certificate."
2) The revised plat shall be titled "First Amended Plat of the
Goodheim & Ross Condominiums". Reference the original 1981 plat
on the amended plat with the book/page filing information.
3) A Title Certificate is required on the amended plat. A Mortgage
Certificate is recommended.
4) The amended plat must contain the signature of the Condominium
Association. If Neil Ross owns all five units, the
Owner/Subdivision certificate on the plat shall state his
ownership. Language shall meet the plat certificate requirements
of the City Engineer.
Zoning: (Bill Drueding)
1) Pertinent building permit records need to be checked. (This
information was later found.)
STAFF DISCUSSION: The 1987 building permit information was located
and it was determined that this remodel received proper approval
through the Zoning Office. There was no increase in the
structure's FAR. The comments from Engineering are of general
platting nature. Section 24-7-1006 A. of the Aspen Municipal Code
reads:
"Insubstantial Amendment. An insubstantial amendment to an
approved plat may be authorized by the Planning Director. An
insubstantial amendment shall be limited to technical or
engineering considerations first discovered during actual
development which could not reasonably be anticipated during the
approval process, or any other minor change to a plat which the
Planning Director finds has no effect on the conditions and
representations limiting the approved plat."
Staff believes that the proposed plat amendments do not affect any
conditions of the original plat. In fact, per City Engineer
requirements, the revised plat will be current to plat language
requirements.
RECOMMENDATION: Staff recommends that the Planning Director
approve the Goodheim & Ross Condominium Plat Amendment amending
Unit #2 to incorporate the common hallway area approved in 1987.
The following conditions should apply:

I hereby approve the Goodheim & Ross Condominium Plat Amendment
revising Unit #2 as shown on Attachment "A". The above conditions
apply to this approval.

I have enclosed herewith a copy of the Land Use Application form
regarding the above matter.
I hope and believe that this can be approved promptly by the
Planning Office and Engineering Department as an Insubstantial Plat
Amendment.
The North wall of Unit #2 was relocated 3 to 4 feet to incorporate
part of what was previously shown on the Condominium Map as a
landing hallway area. The owner of the building, Neil Ross,
desires to have the relocated wall reflected as the Unit #2
boundary location by this Amendment to the Condominium Map (see
blueprint).
The amended Condominium Map was previously recorded upon advice of
Bill Drueding that the City would not process insubstantial
amendments of this type. However, subsequent to recording an
inquiry was made by the undersigned to the Planning Office, which
advised that a Land Use Application form should be submitted
requesting Insubstantial Plat Amendment.
I have enclosed a check in the amount of $290.00 representing the
application fee payable to the Planning Office ($200.00) and to the
Engineering Department ($90.00) for review. I believe the Amended
Condominium Map reprint (enclosed), reflects all information
necessary to identify that the requested modification is quite
insubstantial. Hopefully, the applicant will not be put to
additional delay or expense in preparing other materials which
might be submitted with a more substantial application.
No changes of land use or building size is- contemplated. The
applicant merely desires to conform the Condominium Map with
existing wall locations.
Prompt approval by the Planning Office and the Engineering
Department would be greatly appreciated so that the amended plat
can be re -recorded with proper sign -offs by the Planning Director
and the Engineering Department.
The requested Condominium Map Amendment has no effect on any
conditions or representations limiting the original approved plat.
