RE: Little Jewel Condominium #1 Plat Amendment
DATE: April 1, 1997
On behalf of Health Care for Women, Martha Pickett has applied for an insubstantial plat
amendment for the Little Jewel Condominium #1. Apparently the applicant made interior
improvements to the property in 1991 and never amended the plat to reflect these
changes. The applicant is now in the process of selling the property and is making sure
the legal record reflects the actual property. I have referred this application to the
Engineering Department and the applicant has responded to the suggested modifications
to the draft plat. The application is consistent with an insubstantial amendment to a
subdivision order pursuant to Section 26.88.060 and there are no other land use issues
involved.
Staff recommends that the Community Development Director approve this insubstantial
amendment with no conditions.

CITY OF ASPEN (hereinafter CITY) and Health Care for women, a Salinas Medical
(hereinafter APPLICANT) AGREE AS FOLLOWS:
Corp. Money Purchase Pension Plan
1. APPLICANT has submitted to CITY an application for
an insubstantial plat amendment to the Little Jewel Condominium Plat -
(hereinafter, THE PROJECT).
1. APPLICANT understands and agret< :hat City of Aspen Ordinance
No. 53 (Series of t995) establishes a fee structure for Planning applications and
the payment of all processing tees is a ondiuon orecedem to a determination of
application completeness.
3. APPLICANT and CITY agree that because of the size. nature or
scope of the proposed project, it is -not possible at this time to ascertain the full
extent of the costs involved in processing the application. APPLICANT and
CITY further agree that it is in the interest of the parties to allow APPLICANT
to make payment of an initial deposit and to thereafter permit additional costs to
be billed to APPLICANT on a monthly basis. APPLICANT agrees he will be
benefited by retaining greater gash liquidity and will make additional payments
upon notification by the CITY when they are necessary as costs are incurred.
CITY agrees it will be benefited through the greater certainty of recovering its full
costs to process APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for
CITY staff to complete processing or present sufficient information to the
Planning Commission and/or City Council to enahle the Planning Commission
and/or City Council to make legaliy required [findings for project approval, unless
current billings are paid in full prior to decision.

S. Therefore, APPLICANT agrees chat in consideration of the CTTY's
waiver of its right to collect full- prior to a deters Una . n of application
completeness, APPLICANT shall pay an initial deposit in the amount of $ 245 . o0
which is for hours of Planning staff time, and if actual recorded costs exceed
the initial deposit, APPLICANT shall pay additional monthly billings to CTI'Y to
reimburse the CITY far the processing of the application mentioned above,
including post approval review. Such periodic payments shall be made within 30
days of the billing date_ APPLICANT further agrees that failure to pay such
accrued costs shall be grounds for suspension of procming.

owner. of Unit 1, Little Jewel Condominium. In 19_, the owner made improvements
to the unit's basement, pursuant to a building permit, and received a CO (a copy of
which is enclosed for your convenience). It is my understanding that the only review
necessary is by the City Engineering Department. I spoke with Ross Soderstrom who
suggested I deliver this application to you, which is the proper procedure for review
plat amendments. Therefore, please find enclosed a draft Amendment to
Condominium Plat, prepared by Aspen Survey Engineers, along with a check in the
amount of�11 .00 for the Engineering referral fee.
