Having reviewed the above referenced application, the engineering
department has the following comments:
1. Although the applicant has submitted line locate reports from
three of the six utilities, what is needed is either letters from
all six utilities or sign -off certificates on the plat amendment
which grant permission to vacate the easement.
2. The plat amendment must contain a note which states what action
was effected by the amendment and at what book and page the
original plat and any subsequent amendments are filed.
3. Given the continuous problems of unapproved work and
development in public rights -of -way, we would advise the applicant
as follows:
The applicant shall consult city engineering (920-5080)
for design considerations of development within public
rights -of -way and shall obtain permits for any work or
development within public rights -of -way from city streets
department (920-5130).

We have visited the Murphy property and have determined that the
easement vacation requested will not have any adverse impacts
upon the District's collection system. Since the area immediately
north of the property is a paved roadway, it appears that future
development in that area is unlikely, and sewer service access
should not be a future problem.

Generally, to submit a complete application, you should fill in
the application form and attach to it that written and mapped
information identified in Attachments 2 and 3. Please note that
all applications require responses to the review standards for
that particular development type. The standards for your
application are listed in Attachment 4.
You can determine if your application requires that public notice
be given by reviewing Attachment 5. Table 1 of that attachment
will tell you whether or not your application requires notice and
the form the notice should take. Your responsibilities in this
regard are summarized in the cover explanation to the table.
We strongly encourage all applicants to hold a pre -application
conference with a Planning Office staff person so that the
requirements for submitting a complete application can be fully
described to you.
Please also recognize that review of these materials does not
substitute for a complete review of the Aspen Land Use
Regulations. While this application package attempts to
summarize the key provisions of the Code as they apply to your
type of development, it cannot possibly replicate the detail or
the scope of the Code. If you have questions which are not
answered by the materials in this package, we suggest that you
contact the staff member assigned to your case or consult the

SUBDIVISION IMPROVEMENTS AGREEMENT
THIS AGREEMENT, entered into and made this day of
. 1977, by and between NATALIE GIGNOUX, here-
inafter referred to as "Owner", PATRICK LYNCH, hereinafter referred
to as "Subdivider" and The City of Aspen, Colorado, a Municipal
Corporation, hereinafter referred to as "City".
WITNESSETH:
WHEREAS, Subdivider and Owner desire to subdivide a tract
of land within Pitkin County, Colorado, consisting of property set
forth on the attached Exhibit "A", City of Aspen, County of Pitkin,
State of Colorado.
WHEREAS, Subdivider and Owner have submitted to City for
approval, execution, and recording a subdivision plat of the above
described property, such Subdivision to be known and desiqnated as
"Gignoux-Lynch Subdivision", and
WHEREAS, the City has fully cons4.dered such subdivision plat,
the proposed development and the improvement of the subject property
shown thereon, and is willing to approve, execute, and accept said
plat for recordation upon the agreement of Subdivider and Owner to
the matters hereinafter described, which matters are dee d necessary
to protect, promote, and enhance the public welfare; and
WHEREAS, Subdivider, Owner and the City wish to re' ice said
agreement to writing,
NOW, THEREFORE, in consideration of the premises, the mutual
covenants herein contained, the parties hereto hereby agree as
follows:
1. Subdivider and Owner covenant rind agree to and -vith the
City that they will affirmatively consent to and join in Vie forma-
tion of any special improvement district, encompassing al. or any
part of Gignoux-Lynch Subdivision, that may hereafter be p oposed or
formed For the constrixction of streets, alleys and drainaq improve-
ments or buried electric,,.l improvements. Subdivider hereb• waives

2. Owner and Subdivider, for themselves, their successors
in interest, grantees and assigns, covenant and agree that in the
event the City undertakes street improvements (including paving,
curb and gutter, and sidewalks) without the formation of a special
assessment district when such street improvements include improve-
ments in the right of way abutting said property, they will pay the
actual cost of any such improvements abutting the boundary of said
property, such payment to be made to the City within ninety (90)
days after completion of the improvements and on receipt of written
notice and demand for such payment.
3. Except for landscaping, the improvements shown in
Exhibit "A" to the Subdivision Plat shall be completed as a cendiLion
for the issuance of a Certificate of Occupancy, and the landscaping
shall be completed by September 1, 1978. To insure satisfactory
completion of the landscaping as set forth in Exhibit A to the
Subdivision Plat, the Subdivider shall place in escrow with the
City of Aspen the sum of S_3.575.00 , or, in the alternative,
provide the City with a letter from the First National Bank of Aspen
guaranteeing payment in the amount of $575.00 upon demand
by the City if Su
rd}eider fails to complete the landscaping as
required herein.
4. Subdivider :agrees to pay a Park Dedication fee for Lot 1
of said subdivision to the City in accordance with the provisions
of Sec. 20-18 (a)(1) of the Aspen Municipal Code.
5. Upon execution of this Agreement by all parties hereto,
City agrees to approve and execute the final plat of the Gignoux-
Lynch Subdivision and accept the same for recording in the real
property records of Pit.kin County, Colorado, upon payment of
recording fees rnd costs to City by Subdivider.
6. The covenants and agreements of the Subdivider and Owner
herein shall be deemed covenants that run with the land, shall
burden the land included within the Gignoux-Lynch Subdivision, and
shall bind and be specifically enforceable against all subsequent
owners thereof, including Subdivider and Owner, their grantees, grid
successors in interest and assigns.
