SUMMARY: The applicant proposes to amend the plat to reflect the
,adjustment of the lot line between two parcels that are still
under one ownership. A realignment of the lot line between lots
14 and 15 represents an exchan~e of approximately 500 square feet
of lot area between the two parcels. Please refer to the
attached map.
If there were two separate property owners this would constitute
a lot line adjustment. Both lots are owned by the wogan's, thus
staff recommends an insubstantial amendment to the plat.
BACKGROUND: The Wogan Lot Split, at 230 Lake Avenue, was
approved by city council October 1986, and the Subdivision
Exception Agreement was approved on January 7, 1987. This plat
amendment will have no affect on those conditions or
representations that were made on the plat and in the Subdivision
Agreement.
FINDINGS: Pursuant to section 7-1006 A. of the Land Use Code an
insubstantial amendment to the final plat can be approved by the
Planning Director if the amendment is limited to technical or
engineering considerations first discovered during actual
development or any other minor change to a plat which the
Planning Director finds has no effect on the conditions and
representations limiting the approved plat.
The square footage of the lots will remain the same. The
building envelope on Lot 14, however will be altered due to the
diminished lot area fronting along Lake Avenue. This alteration
will not affect potential development.
RECOMMENDATION: Staff recommends approval of the amendment to
the plat to adjust the boundary between Lots 14 and 15 as
represented on the attached map with the condition that the final
plat be amended and approved by the Engineering Department and
the conditions for the 1986 Lot Split remain in effect.
I hereby approve the insubstantial amendment to
the Wogan Lot Split final plat pursuant to Section
7-10 A. of the Aspen Land Use Code.

As a result of the Wogan Lot Split Plat Amendment, the building
envelope of Lot 14 should be adjusted to reflect the dimensional
requirements of, that &one district. Specifically the side yard
setbacks.
The applicant's representative is aware of this adjustment and it
will be reflected on the amended plat.

Dear Leslie:
Pursuant to our conversation, this letter is a request for
an insubstantial plat amendment, pursuant to ~7-1007 of the
Aspen Land Use Code. The Wogan Lot Split Plat was approved by
City council, and recorded in Plat Book 19 at Page 31, and the
Subdivision Exception Agreement was approved on January 7,
1987, and recorded in Book 527 at Page 710. At this time, the
Applicant wishes to realign the property line division of the
two lots, as sketched on the attached drawing. As you can see,
the square footage of the two lots will remain the same, and
there is no affect on the conditions or representations which
were made when the Plat was approved in 1987.
Upon your approval of how to proceed with this
Application, we will have an Amended Lot Split Plat prepared by
a surveyor showing the new lot line, such Plat to be approved
administratively and recorded.
