COMMERCIAL CORE & LODGING COMMISSION
MINUTES OF OCTOBER 4. 2006
Chairperson Bill Dinsmoor called the meeting to order at 8:45 a.m.
Commissioners in attendance: Shae Singer, Mark Goodman, Stan Hajenga
Excused were John Starr, Don Sheeley and Terry Butler.
Shae inquired as to what it would take to extend what is considered the core
past the Wieners tube. Real estate businesses are allowed on the lower floor
of the redevelopment of the Wienerstube. This was also discussed by Frick
& Bier.
Chris Bendon, Community Development Director - Commercial core
From time to time there is discussion of expanding the core. CI is almost
identical to the CC except for the prohibition on offices. Changing to the CI
zone district could be discussed but where is the appropriate place for
offices.
Shae said City market is not in the commercial core. There could be offices
there. Could the retail zoning on the first floor extend out further. Offices
can go on the second floor or in basements.
Bill said City Council and Com Dev. are in the middle of it right now.
The CI zone not considered downtown.
Shae relayed that there is quite a bit of new development and those areas are
turning into office spaces on the first floor. It is real estate offices on the
first floor. We are talking about having a viable downtown which is retail
and dining. Retail and dining make the town viable. Offices that don't have
traffic should be on the second floor.
Bill said if you are a landlord you would get the business who can pay the
rent.
Shae recommended that the same CC zoning extend to Spring Street.
Chris said that would be real estate, dentist and offices.
Chris pointed out that retail is allowed in landmark buildings, Main Street
and the Commercial core.
Chris said there is discussion of retail as a conditional use in the mixed use
zone. Chris said council is interested in locally service commercial.

Chris mentioned regulatory - and encourage it through the normal practices
of the private sector. Have regulatory businesses downtown due to location.
Shae said you can't put a rent price to be charged on development.
Mark said there are also property right issues with doing that.
Mark said it sounds crazy regulating rent. Expand retail that serves the
pedestrians is a good idea. He is against market regulations. Retail serving
type of spaces are necessary for our guests.
Chris said we could change the prohibitions i.e. moratorium to extend to the
CI zone.
MOTION: Shae moved that CCLC recommend that the boundaries of the
commercial core be extended to the CI zone and we think the same rules
should apply as in the CC zone. Motion second by Stan. No vote on the
motion.
Mark discussed whether we should extend the rules or zoning.
Shae said whatever is the simplest way to get it done. The rules that
apply in the commercial core should be extended to the CI zone. All rules
apply in one block in all directions.
City market could be raised and have office buildings upstairs.
Stan said he feels like he has a lack of knowledge regarding the expansion.
He needs to see it visually. What is there and what would change and what
wouldn't change. What is on the development table right now. Before we
go make a motion we need to get are arms around this to see how this is
progressed. What are we causing with this proposed change. Need to see
something laid out.
Bill said he also doesn't have enough information to see what the effect of
this proposal.
Mark suppose we enact this and expanded CC to CI to include retail spaces
and restaurant spaces that benefit pedestrians. Chris said the consequences
are that some offices would be grand fathered. There would be push back
from tenants and owners that exits. Chris said the original intent of the core

is where the concentrated retail is. If you get too many offices you feel you
are at the end of the shopping experience.
Mark said it is a bold thing putting forces on the market.
CCLC recommends that council discuss the issue of the expansion of the
core. Stan suggested that a map be provided so we can visually see the
zones, buildings etc.
Bill said he would like to see a fully enacted plan for clothing racks, outside
seating etc. for next year.
Chris said he asked Joyce Allgaier to put a scope of work together over the
winter regarding outdoor merchandise and restaurant seating. She will
clarify who it is that is permitting certain things.
Tom McCabe - Affordable housing.
Tom said the City has their own program and the City has their own
housing. The City manager has control of the city housing. In general terms
they follow our guidelines.
APCHA - Aspen Pitkin County Housing Authority - Essentially you need to
be employed in Pitkin County for 4 years and then you can qualify.
If you qualify and your circumstances can change. Once you are in you can
remain in, including retirement. It helps with the program that if your
circumstances change you can still remain in APCHA. The goal in the long
term is 60% of the work force should be housed.
Shae said she knows people that live in affordable housing and neither one
work in Pitkin County. Tom said in affordable housing they are required to
work in Pitkin County. There are a certain number of hours that you have to
work.
Bill said you can qualify if you have a home business. He feels there are
loop holes. There are so many people that in reality they are not working
here. Tom said we do have standards.
Shae said she feels the program is abused.
Stan relayed that housing is a huge problem.

Mark what is the appreciation rate for rental pool and housing to buy pool.
Tom said it is about half and half.
What is the appreciation level? Tom said some appreciation is zero. Some
years it is 3 to 6%.
Mark said with Burlingame how does that effect the 50% to 60% goal? Tom
said studies say we are approaching that goal.
Bill said the deficit in housing is the rental housing. He has seasonal people
that need a place to rent and it is not met.
Shae said because of restrictions she can't buy affordable housing because
she doesn't live there. Tom said with Phase II of Burlingame business
owners can buy affordable housing for their employees.
Bill said overall this community has contributed in trying to figure out
affordable housing.

Peter Forte and Dave Whittlesey
Peter Forte said are mission is to encourage farmers to come up with home
products or crafts.
Dave - fee for Produce Vendor: 30 feet $575. over 30 feet 20 per ten feet.
Bill said we strive for excellence in service and diversity of the market.
Mark said we need to prioritize in the consideration if you do better in sales
you get to move up.
The board determined that agriculture booths should be judge by the farmers
group. All other booths that are not agriculture should fall under the CCLC.
