SUBJECT: Code Amendment - Parking Lots in Office Zone

SUMMARY: The Planning Office and Aspen Planning and Zoning Commission
recommend approval of an amendment to Section 24-3.2 identifying
parking lots and structures in the Office Zones as a conditional use,
provided that they not be located along Main Street.
PREVIOUS COUNCIL ACl'ION: City Council passed First Reading of this
zoning Code amendment on July 8, 1985. The Planning and Zoning
Commi ssion passed a motion to recommend approval of the zoning Code
amendment on June 18, 1985.
BACBGROUND: For the past several years a parking lot on Hyman Avenue
between Spring and Original Streets (Block 105, opposite the Aspen
Athletic Club) has been the source of complaints from neighbors
regarding dust and abandoned vehicles. The owners of the property
agreed in a meet ing with the City Manager and Planning Director to
clear the lot, grade it, and put gravel down to improve its appear-
ance and cont rol dust. The lot would be managed by a neighbor (Si
Kelly of the Buckhorn Lodge) so that it can be rented on a weekly or
monthly basis for parking.
The only problem with the proposed solution is that parking lots are
neither a permitted nor conditional use in the Office Zone District,
where the property lies. Therefore, the Planning Office agreed to
sponsor this Code amendment to rectify the nuisance and to legalize a
lot which has historically provided needed parking in this area of the
City.
PROBLEM DISCUSSION: In the opinion of the Planning Office, the
reason for keeping such uses out of this zone district is that most of
Main Street is zoned Office, and we would not want to have such uses
intrude in our historic entrance to town. The Planning Office does
not see a particular problem with the concept of having a commercial
parking lot in those portions of the Office Zone which are not along
Main Street.
The Planning and Zoning Commission added parking structures to parking
lots to be included as conditional uses recommended in the Office
Zone. It is felt that again there is no problem with the concept of

parking structures in the Office Zone. By making both parking lots
and structures conditional uses the City is provided with the oppor-
tunity to review such proposals on a case-by-case basis so an exces-
sive number does not develop. The conditional review also provides us
with the ability to review the design of the lot or structure so as to
control appearance, provide for screening and consider the access/e-
gress points to the site.
ADVISORY COMMITTEE VOfE: The Planning and Zoning Commission recom-
mended unanimously in favor of this code amendment on June 18, 1985.
RECOMMENDED MOf ION:
"Move to approve Ordinance No. ~, Series of 1985, on
second reading."

For the past several years, the City has received complaints from
neighbors regarding the parking lot on Hyman Avenue between Spring and
Original (opposite Aspen Athletic Club). The complaints allege that
the property is a nuisance because the owner does not control dust and
leaves abandoned vehicles for long periods of time.
The City Manager and I met with the owners of the property who agreed
that the property has not been well managed in recent years. They are
willing to clear the lot, grade it and put gravel down to improve its
appearance and reduce dust. They are also willing to have the
prope rty managed by a neighbor (Si Kelly of the Buckhorn Lodge) so
that it can be rented on a weekly or monthly basis for parking.
The only problem with the proposed solution is that parking lots are
ne.ither a permitted nor conditional use in the Office zone distric;t,
where the property lies. In the opinion of the Planning Office, the
reason for keeping such uses out of this zone district is that most of
Main Street is zoned office, and we would certainly not want to have
such uses intrude into our historic entrance to town.
We do not see a particular problem with the concept of having a
commercial parking lot in those portions of the Office zone which are
not along Main Street. We, therefore, recommend that you initiate a
Code amendment to provide that "commercial parking lot, provided that
it not be located along Main Street" be identified as a conditional
use in the Office zone. By making this a conditional use, we provide
ourselves the opportunity to review such proposals on a case-by-case
basis so an excessive number of such lots does not develqp. Further-
more, we obtain an opportunity to address site specific concerns such
as screening, paving versus gravel surface, etc.

RE: Municipal Code Amendment: Parking Lots in the Office
Zone
NOTICE IS HEREBY GIVEN that a public hearing will be held
before the Aspen Planning and Zoning Commission on Tuesday, June
18, 1985 at a meeting to being at 5:00 P.M., in City Council
Chambers, 130 S. Galena, Aspen, Colorado, to consider an amend-
ment to the Municpial Code of the City of Aspen, Colorado, which
would provide for "commercial parking lot", provided that it not
be located along Main Street, to be a conditional use in the
Office zone district.
