STATEMENT OF EXEMPTION FROM
THE DEFINITION OF SUBDIVISION
WHEREAS, JOHN DOREMUS ("applicant"), intends to construct
a condominium duplex located within the City of Aspen, which 10-
cation is more particularly described as:
Lots M, Nand 0, Block 8, City and Townsite of Aspen,
Pitkin County, Colorado, and
WHEREAS, the applicant has applied, pursuant to the pro-
visions of Section 20-l9(b) of the Aspen Municipal Code, for an
exemption from the definition of subdivision for the creation of
two separate units to be constructed during the Spring of 1977
on the above described lots, and
WHEREAS, the Aspen Planning and Zoning Commission did,
at its meeting held March 1, 1977, determine that this proposed
conveyance is without the intents and purposes of subdivision
regulation (subject to certain conditions) and did further
recommend to the City Council that the requested exemption be
granted, and
WHEREAS, the Aspen City Council, at a regular
meeting held

, March 28, 1977, did consider the requested exemption,
did agree that issuance of an exemption is appropriate, and
did grant the same subject to certain conditions,
THEREFORE, NOTICE IS HEREBY GIVEN that the City Council of
the City of Aspen, Colorado, has granted an exemption from the
difinition of subdivision for the creation of two separate condo-
minium units and conveyance of separate interests in said units.
PLEASE TAKE FURTHER NOTICE that this grant of exception
is conditioned as follows:
1. That, at the time of Building Permit issuance, the
applicant shall pay to the City of Aspen the appropriate Park
Dedication Fee attributable to the 2 units and calculated pursuant
to Section 7-143 of the Aspen Municipal Code.
2. That both units of the duplex be subject to the City's
rental policy of six month minimum rental, with allowance of two
short term rental restrictions.

3. That the conditions hereby imposed shall be deemed
covenants running with the land and burden the same, and be
binding upon the applicant, his heirs, assigns and successors
in interest.

Subdivision Exemption - Doremus Duplex Condominiumization
March 10, 1977
This is a request by John Doremus to condominiumize a proposed
duplex to be located on Lots M, Nand 0, Block 8, Aspen Townsite
(Smuggler and N. Seventh Street), The property consists of
9,000 square feet and is zoned R-6.
The Engineering Department has no comments on this request.
The Planning and Zoning Commission on March 1, 1977 recommended
approval of the request subject to the minimum six month leasing
provisions as recently enacted for the RMF zone.
The Planning Office recommends approval subject to payment of
the Park Dedication Fee at the time of building permit appli-
cation and the six month lease agreement.

Re: Doremus Exemption
Dear Mr. Collins:
Please consider this letter a formal application to the Aspen
Planning & Zoning Commission for an exemption from the term "sub-
di vis ion", as defined in Aspen Municipal Code S;20- 3 (s), with respect
to my proposed condominiumization of the two-family dwelling ("dup-
lex") which I intend to build during the Spring of 1977 on Lots
M, Nand 0, Block 8, City and Townsite of Aspen. The property
consists of three (3) standard-sized City lots containing a total
of 9000 square feet, is presently zoned R-6 Residential, and a
duplex structure is a permitted use under the applicable zoning
regulations. The proposed condominiumization, then, is solely for
purposes of modifying the nature of the ownership of this structure,
and will involve no additional land use, density or resource impact.
For the foregoing reasons, it is respectfully submitted the
comtemplated "division" does not fall within the intent or purpose
of Aspen's Subdivision Regulations, which are expressly designed
to assist the orderly, efficient and integrated development of
the City of Aspen, to insure the proper distribution of population,
to coordinate the need for public services, and to encourage well-
planned subdivision.
Current City policy allows an exemption from subdivision
requirements for the condominiumization of existing duplex struc-
tures, and it is further submitted that there is no meaningful
distinction between such an exemption and the exemption of a
duplex to be constructed in the near future.
I would appreciate your earnest consideration of this
application.
