HomeMy WebLinkAboutcoa.lu.ex.Concept 600 Condo.1980 Reception No. 10retta Banner, Recorder July 11.,)980 22529~ Recorded at 2:27 P.M. _391 ,i/,E569 STATEMENT OF EXEMPTION FROM THE DEFINITION OF SUBDIVISION WHEREAS, the Aspen 600, a Colorado general partnership, is the owner of a parcel of land located in Pitkin County, Colorado, more particularly described as: Condominium unit "commercial space," Concept 600 Condominium, according to the plat map thereof filed for record at Plat Book 4, page 442 of the records of Pitkin County, Colorado. WHEREAS, the Applicant has an existing commercial condominium space located on said property, and WHEREAS, applicant has requested an exemption from the definition of subdivision for the purpose of subdividing the existing commercial space through re-condominiumization, and WHEREAS, The Aspen Planning and Zoning Commission, at its meeting held May 6, 1980, determined that an exemption from the definition of subdivision is appropriate and recommended that the same be granted, and WHEREAS, the City Council determined that the subdivision of the existing commercial space through re-condominiumization is not within the intent and purpose of the subdivision ordinance set forth in Chapter 20 of the Aspen Municipal Code, THEREFORE, the City Council of Aspen, Colorado, does hereby determine that the proposed subdivision of the commercial space located on said property by its re-condominiumization is not within the intent and purpose of the subdivision ordinance and does, for such reason grant an exemption from the definition of such action. The Engineering Department suggests, however, that in keeping with the initiative taken by the City to construct ramps for the handicapped in the commercial areas of Aspen and consider- ing the immediate location of three existing ramps for the handicapped across Main Street, it would be an exemplary service if the owner/applicant were to con- struct two handicapped ramps for access to the Concept 600 Building. The suggested location of these ramps is described in the Department's attached memorandum. P & Z Recommendation: Concurred with Planning Office recommendation. \ \ APPLICATION FOR EXEMPTION FROM SUBDIVISION REGULATIONS Request is hereby made on behalf of Aspen 600, a Colorado general partnership, (hereinafter referred to as "Applicant") under Section 20-19(a) of the Aspen, Colorado, Subdivision Regulations, for an exemption from the definition of the term "subdivision" with respect to the following real property: Condominium unit "commercial space", Concept 600 condominium, according to the map thereof filed for record at Plat Book 4, page 442 of the records of Pitkin County. Said space comprises all of the ground floor commercial space in the Concept 600 building. It is submitted that the requested exemption is appropriate for the condominiumization of a commercial building which is constructed on the above-described property. If the requested exemption is granted, the owners of the property will have a common interest in the land and there will be a condominium declaration and maintenance agreement applicable to the property which will not in any way increase the land use impact of the property. An exemption in this case will not conflict with the intents and purposes of the subdivision regulations of the City of Aspen which are directed to assist the orderly, efficient and integrated development of the city to insure the proper distribution of population, to coordinate the need for public services, and to encourage well-planned subdivision. The above-described real property is zoned C-l for commercial use and the building constructed on the property is used for commercial purposes. Accordingly, the granting of this exemption application will not undermine the intent of the subdivision regulations of the City of Aspen as this application is clearly within the area intended for exemption. The applicant intends to file a condominium plat for the property which will include approximately nine commercial condominium units. The building will probably be occupied, however, by less than nine tenants due to the fact that some tenants will occupy contiguous units. It is anticipated that most of the condominium units will be sold to local business firms, but a few units may be leased prior to eventual sale. The condominium declaration for the Concept 600 building provides authorization for the re-subdivision of the commercial unit and is in accordance with this application. A copy of a recent improvement survey of the above- described property is attached hereto. The Engineering Department would like to suggest that in keeping with the initiative taken by the City to construct handicap ramps in the commercial areas of Aspen and considering the immediate location of three existing handicap ramps across Main Street, it would be an exemplary service if the owner/applicant were to construct two handicap ramps for access to the Concept 600 Build- ing; one ramp being located on the Northwesterly corner of (the intersection of) Main Street and Spring Street and the other lo- cated on the Northerly end of the crosswalk which begins on the Southeasterly corner of the intersection of Main Street and Hunter Street.
