Condominiumization Plat Amendment

SUMMARY: The applicants, Mountainview studios Condominiums, seek
to amend the condominiumization plat to reflect the current
condition of the building which includes improvements such as decks
and changes in limited and common elements.
LOCATrON: 819 East Hyman Avenue, Aspen
PROPOSAL: To amend the condominium plat and declarations of an
eight unit building.
STAFF COMMENTS: Pursuant to Section 24-7-1006, an insubstantial
amendment to a subdivision development order or minor change in a
plat shall be reviewed by the Planning Director as an insubstantial
review.
The Engineering Department and Planning staff have reviewed the
revised plat. The Engineering Department has made several
recommendations with regard to the revised plat, Please see
attached referral comments.
RECOMMENDATrON: Staff recommends approval of the amended plat with
the following conditions:
1. The applicant shall submit a revised plat for review by the
Planning and Engineering Departments.
2. The applicant shall record the revised plat within 180 days of
this approval. Failure to record a revised plat shall render this
approval void.
3. The applicant shall adhere to the recommendations made by the
Engineering Department in the referral comment memo dated september
8, 1994.

Re: Mountainview Studios Condominium Plat Amendment
Having reviewed the above referenced application, and having made a site inspection, the
Engineering Department has the following comments:
1. Sidewalk Area - Prior to signing the plat, the spruce trees in the sidewalk area should
be pruned back so that the branches do not encroach into the usable sidewalk area. The
sidewalk area should be clear to a height of seven feet.
There is gravel in the sidewalk area which is not permitted by code. The driveway
beyond the sidewalk is a gravel surface, It is easy to see why gravel is not permitted in
sidewalk areas because the gravel migrates onto the sidewalk. I would not provide a
condition of approval concerning the gravel, but the applicant is advised about this Code
requirement for future reference and improvement.
2, Dumpster - It is recommended but not required that the applicant construct a concrete
pad on their property for the dumpster to facilitate winter use of the dumpster,
3, Name - The name of the condominium is being changed by the amendment. The title
of the plat is not accurate because there is no "Mountainview Studios Condominiums" plat
to amend. I suggest that the plat be titled "Mountainview Studios Condominiums" and
that a note be added immediately beneath the title similar to the language contained in
the Owners' Certificate,
4. Suxvey Monument - Three corners are fully indicated. The fourth corner indicates that
the monument was found as described, but it is not described. The final plat must contain
the description,
5. Plat Certificates - The plat must contain certificates for Planning Director approval,
City Engineering Department approval, and for a title company, A mortgagee's certificate
is recommended but not required.
It is recommended that the surveyor's certificate or a note on the drawing state that

all easements of record as indicated on Title Policy No. _ , dated . have been
shown, that the survey closes to 1:10,000, and that the survey was performed in accordance
with Colorado Revised Statutes, Title 38, Article 51, as amended from time to time.
6. Vicinity Map - The final plat should contain a vicinity map, and we would also like to
see the street address indicated beneath the plat title.
7. Lot Area - The final plat should indicate the lot area to the nearest 0.001 acre.
8. Work in the Public Right-of-way - Given the continuous problems of unapproved work
and development in public rights-of-way adjacent to private property, we advise the
applicant as follows:
The applicant shall consult city engineering (920-5080) for design
considerations of development within public rights-of-way, parks department
(920-5120) for vegetation species, and shall obtain permits for any work or
development, including landscaping, within public rights-of-way from city streets
department (920-5130).
