On behalf of the Ute NO.4 Townhomes, the Kentco Limited Partnership, has
applied for a subdivision exemption to condominiumize the Ute No. 4
Townhomes, which are located at 917 East Hyman Avenue.
This condominiumization is being requested because the applicant is now in the
process of selling one or both of the units (duplex) on the property and wants the
elements of the sale to be clearly defined. The application was referred to the
Engineering Department, who examined the proposed plat and found it to be
acceptable as revised. The application is consistent with the condominium
conversion exemption from the City's subdivision regulations, pursuant to
Section 26.88,030(A)(3) and 26.88.070 and there are no other land use issues
involved.
Staff recommends that the Community Development Director approve this
condominiumization with no conditions.

Re: The Ute No, 4 Townhomes Subdivision Exemption for Condominiumization
I have reviewed the above referenced application, and I have the following comments:
1. Missine plat content requirements
a, The lot designations are not acceptable. The plat is not a lot split" and the limited
common area yard elements are not shown.
b. The designation "Ute No.4 Rock" is incorrect. The rock contains a registered survey
monument which must be correctly labeled,
c, Are there overlapping ownership spaces vertically? Are there general common elements
such as mechanical spaces? The submitted condominium map is very incomplete, The
property must be fully monumented and parking spaces, including ADU, shown and
dimensioned. State the total acreage of the lot to nearest 0.001 acre. The lot to the east is
not fully described.
d. The plat must make reference to a recent title policy or letter for easement information.
e. Show utility sources, services, and meters, Show drainage improvements.
f. Show rock wall in public right-of-way, A sidewalk was required to be constructed prior
to certificate of occupancy but is not shown, on the plat.

SUBDIVISION EXEMPTION APPROVAL AND VESTED RIGHTS FOR THE SUND LOT
SPLIT (LOTS D,E,F AND G, BLOCK 35, EAST ASPEN ADDITION)

Sec.-tien 24-7-l003.A.2 of the A.3pen Municipal Code
provides for City Council approval for lot splits as Subdivision
Exemptions and Section 24-6-207 allows vested rights for a period
of three years; and
WREREAS, the -,"pplicant, Mel:ropolis Investment Incorporated,
submitted an application for a lot split to the Planning Office;
and
WREREAS, the City Engineering Office has provided referral
comments on the proposed lot split; and
~rlEREAS, the Historic Preservation Committee of the City of
Aspen has recommended that the western portion of the subject
property be considered for historic landmark designation because
of a large boulder \-Thich has been identified as an historic survey
marker for early mining claims in Aspen; and
WHEREAS, the lO,t split .:pproval as requested by the applicant
shall not foreclose or limit any future action regarding the
par~el's designation as an historic landmark; and
WREREAS, the Planning Office reviewed the proposed lot split
pursuant to Section 24-7-1003.A.~ of the Aspen Municipal Code and
the comments received from Engineering and recommends approval of
the Subdivision Exemption for a lot split with conditions; and
~THEREAS, the Aspen City Council having considered the Planning
Office's recommendations and section 24-7-l003.A.2 of the Aspen

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLOPADO:
section 1:
That it does hereby grant SUbdivision Exempt ion
approval ~or a lot split pursuant to Section 24-7-1003.A.2 of the
Aspen Municipal Code subject to the fOllowing condi~ions:
1) If 'che ELM survey monument on the boulder is to be relocatec',
it must be done so by a registered surveyor in accordance with
ftpplicable state statutes.
2) To help preserve character of the streetscape, the old rock
wall must remain where it cnrrently exists in the public
right-of-'way.

9) The new Subdivision Plat and Subdivision Exemption .".greement
must be recorded with the Pitkin county Clerk and Recorder
within 180 days of approval by city Council. Failure t9 do
so will render the subdivision exemption approvals invalid.

1. The rights granted by the site specific development plan
approved by this Ordinance shall remain vested for three (3)
years from the date of final adoption specified below.
However, any failure ~o abide by the terms and conditions
~ttendant to this approval shall result in forfeiture of said
vested property rights. Failure to timel:t and prop",rly record
all plat:sand agreements as specified herein and or in the
Municipal Code shall also result in the forfeiture of said
vested rights.
2. The approval granted hereby shall be subject to all rights of
referendum and jUdicial review.
3. Nothing in the approvals provided ',n this Ordinance shall
exempt the site spp.cific develo"".lent plan from subsequent
reviews and or ~pprovals required by this Or&inance or the
general rules, regulations or ordi~ances or the city provided
that such revim.:s or approvals are not inconsistent '"Tith the
approvals granted and vested herein.
4. The establishment herein of a vested pr'operty right shall not
preclude the application of ordinances or regulations which
are general in n"ture and are applicable to all property
subj ect. to land use regulation by the city of Aspen including,
but not limited to, building, fire, plumbing, electrical and
mechanical codes. In this n'gard, as a condition of this site
development approval, the developer shall abide by any and
~ll such building, fire, plumbing, electrical and mechanical
codes, unless an exemption therefrom is granted in '.~ri ting.
Section 3: The city Clerk shall cause notice of this Ordinance to
be published in a newspaper of general circulations within the City
of Aspen no later than fourteen (14) days following final adoption
hereof. Such notice shall be given in the following form:
Notice is hereby given to the general public of the approval
of a site specific development plan, and the creation of a
vested property right pursuant to Title 24, Article 68,
Colorado Revised Statutes, pertaining to the fol:owing-
described property:

PURSUANT TO SECTION 26.40.090 OF THE
CITY OF ASPEN MUNICIPAL CODE
THIS ACCESSORY DWELLING UNIT DEED RESTRICTION is made and
entered into this 21- day of October, 1996, by Richard Kent ("Owner") for itself, its
successors and assigns, for the benefit of the City of Aspen, Colorado, a municipal
corporation, and the Aspen/Pitkin County Housing Authority, a multi-jurisdictional housing
authority established pursuant to the AMENDED AND RESTATED INTER-
GOVERNMENTAL AGREEMENT recorded in Book 605 at Page 751 of the records of
the Pitkin County Clerk and Recorder's Office ("Authority").
WHEREAS, Owner owns that parcel of real property located at 935 East Hyman,
in the City of Aspen, County' of Pitkin, Colorado, more specifically described as Lot 1,
Kentco Lot Split, Block 35, East Aspen Township, upon which is situate a duplex which
each shall contain a studio, . .500 net livable square foot accessory dwelling unit
("Units"); and
WHEREAS, Owner agrees to accept and impose certain conditions on its use and
occupancy of the Units as accessory dwelling units under the Aspen Municipal Code.
NOW, THEREFORE, in consideration of the mutual promises and obligations
contained where. the Owner hereby covenants and agrees as follows:
1. The Units, as identified hereinabove, shall not be condominiumized and, if rented,
shall be rented only in accordance with the guidelines as adopted and as may be
amended from time to time by the Authority goveming "resident-occupied" dwelling
units.
2. Owner need not rent the Units: however, when rented, only qualified residents, as
defined in the Housing Guidelines, shall reside therein and all rental tenns shall be
for a period of not less than six (6) consecutive months. Owner shall maintain the
right to select the qualified resident of its own choosing when renting the Units. An
executed copy of all leases for the Units shall be submitted to the Authority within
ten (10) days of the approval of a qualified resident.
3. The covenants and limitations of this deed restriction shall run with and be binding
on the land for the benefit of the City of Aspen and the Authority, either of whom
may enforce the provisions thereof through any proceedings at law or in equity,
including eviction of non-complying tenants.

4. It is understood and agreed by the Owner that no waiver of a breach of any term or
condition as contained in this deed restriction shall be construed to be a waiver of
any breach of the same or other tenn or condition, nor shall failure to enforce any
one of the tenns or conditions, either by forfeiture or otherwise, be construed as a
waiver of any term or condition.
IN WITNESS HEREOF, Owner has placed its duly authorized signature hereto on
the date as described above.
