SUMMARY: The applicant requests Subdivision Exemption to condominiumize the existing 13
commercial units and 2 residential units in the Katie Reed Plaza.
APPLICANT: Aspen Arcade Limited, represented by Kaufman & Peterson
LOCATION: SE Comer of S. Monarch St. and E. Hopkins Ave.; Lots A, B and C, Block 81, City and
Townsite of Aspen
ZONING: CC, Commercial Core
LOT SIZE: 9,047 sf
BACKGROUND: City Council designated the parcel as a historic landmark pursuant to Ordinance No,
36, Series of 1990. On April 16, 1991, the Planning Commission granted Special Review approval to
reduce the open space and parking requirements and GMQS Exemption to enlarge a historic landmark.
City Council Ordinance No. 15, Series of 1991, granted GMQS Exemption for affordable housing.
REFERRAL COMMENTS: Comments from the Engineering Department are attached as Exhibit B.
The plat shall be modified as noted in Chuck Roth's comments dated November 18, 1996, One concern
is drainage which is currently being conveyed to public sidewalks and walkways within the project site;
this drainage problem shall be corrected before the plat is signed and recorded.
STAFF COMMENTS: Pursuant to Section 26,88,070 of the Aspen Municipal Code, to convert an
existing development to a condominium form of ownership, a condominium subdivision exemption plat
shall be submitted to the Community Development Director for review and approval. Staff has reviewed
the plat and finds that it complies with the standards of the Code.
RECOMMENDATION: Staff recommends approval of the Katie Reed Plaza Subdivision Exemption
for Condominiumization, subject to the following conditions:
I, The applicant shall adhere to all representations made in the application as conditions of approval.
2, The condominium plat shall be reviewed and approved by the City Engineer and the Community
Development Director prior to recordation. The approved plat shall be recorded in the office of the
Pitkin County Clerk and Recorder within 180 days of its approval by the Community Development
Director. Failure on the part of the applicant to record the plat within 180 days following approval
by the Director shall render the plat invalid and a new application and approval will be required. The

plat shall also be submitted in a digital format acceptable to the Community Development
Department for incorporation into the City/County GIS system.
3, The condominium plat shall be revised as required by Chuck Roth in his referral memo dated
November 18, 1996, Drainage which is currently being conveyed to public sidewalks and walkways
within the project site shall be corrected to the satisfaction of the City Engineer before the plat is
signed and recorded,

Re: Katie Reed Plaza Condominiwnization
Having reviewed the above referenced application, and having made a site inspection, the
Engineering Department has the following comments:
1. Plat certificates
a. Change "Planning Department" approval certificate to read "Community Development
Director."
b. Add two approval certificates, one for the Water Superintendent and one for the Aspen
Consolidated Sanitation District. lbis is necessary because when structures change from
single ownership to multiple private ownerships, operational difficulties arise for both these
utilities. The difficulties must be addressed either by construction of such facilities as
additional service lines or additional metering or by clauses in condominiwn declarations,
covenants, or other agreements with the individual utility.
c. Revise owner's certificate to delete reference to Council approval. Condominiwnizations
are not approved by Council.
d. Include statement in surveyor's certificate or in general note addressing the applicability
of Colorado Common Interest Ownership Act state law to the condominiwnization and the
compliance of the plat with CCIOA. Surveyor's certificate must state performance in
accordance with Colorado Revised Statutes 1973, Title 38, Article 51, as amended from time
to time. Date of survey must be current (within past 12 months).

2. Additional plat content requirements areas follows:
Vicinity map; zone designation; surveyor to complete title policy nwnber and date; written
survey description of the area including area to 0.001 acre; utilities in adjacent rights-of-way;
water shut-off valve box; date survey performed; full monwnentation of property.
3. Elevations are indicated as referenced to a manhole rim. Manhole rim elevations may be altered
by street improvement projects. The elevation must be tied to a survey monwnent.
4. The plat sheet showing boundary lines, building footprints, trees, manholes, walkways, must be
submitted in dxfformat on electronic file compatible with City/County GIS system.
5. Show drainage improvements. Is there a drywell that is accessed in a general common element
space in the basement? There is drainage from the "Katie Reed House" which is currently being
conveyed to public sidewalks and to walkways within the project site. This is a hazardous situation
and was not approved during the land use review for the project. It must be corrected prior to
signing the plat.
