The construction of these units was originally approved in early 1997. Since then, the owner/developer determined that the marketability of the units was being adversely affected by the arrangement of the access to the two Accessory Dwelling Units. The applicant applied for and was granted a building permit to make various improvements involving the access/entries to the two ADUs on the subject property. As a consequence, the former access area which served both ADUs is now part of Unit 2, and is restricted for access only to the ADU attached to and part of Unit 2. A new access off of West End Street was created to access the ADU which is attached to and part of Unit 1. The construction has since been completed; however, due to the changes that were made, the plat currently on file with the City is inaccurate. This amendment is being requested in order to reflect the changes that were approved and constructed. The applicant is now in the process of selling one or both of the units on the property and wants to make sure the legal record accurately reflects the actual property. The application was referred to the Engineering Department, who examined the proposed plat and found it to be acceptable as submitted. The application is consistent with an insubstantial amendment to a subdivision order, pursuant to Section 26.88.060, and there are no other land use issues involved. Staff recommends that the Community Development Director approve this insubstantial amendment. No Rec1p1ent, No SULJect ~ To: ohkg@rof.net From: Mitch Haas <mitchh@ci.aspen.co.us> Subject: Condo Plat Amendment Cc: sarat, stanc, juliew, johnw, davidho Bcc: X-Attachments: Dear Lenny, Now that I've had a bit of time to read over the CCIOA materials that you were kind enough to send to me, one particular Section appears to be significant with regard to the submitted plat for the 904 East Cboper/312 West End Condominium Plat, namely Section 38-33.3-209(8). The cited Section states simply that the requirements of a plat or map under CCIOA "shall not be deemed to satisfy any subdivision platting requirement enacted by a county or municipality . . . or a similar provision of a home rule city . "Thus, in my estimation, it is fully possible to satisfy the statutory platting requirements outlined in CCIOA while still falling short of complying with the plat requirements of a municipality or county. This is not to say that the submitted plat for the 904 East Cooper/312 West End Condominiums meets or does not meet the City's platting requirements; rather, meeting the requirements of CCIOA may not be enough. The City of Aspen's platting requirements are outlined in detail by Section 26.88.040(D) of the Aspen Land Use Code. Of particular interest are Sections 26.88.040.D.l.a(3) (k) and (I), which call for tabulations listing, among other things, the size of the lots, structures and/or dwelling units; the number of bedrooms per dwelling unit; and, the location of all proposed areas for common use. While the Unit 2 ADU will be under the same ownership as Unit 2 itself, the stairs providing access to the basement and the ADU will be an area for common use. That is, the conditional use application for Unit 2's ADU never would have been approved if private access were not going to be provided. Unless the stairs are shown as an area for common use, we cannot guarantee that the proposed Insubstantial Plat Amendment would not result in failure to comply with the terms of the Conditional Use approval given for the ADU. It follows that these common areas, those guaranteeing private access to the Unit 2 ADU will need to be indicated on the revise~plat. It would also be helpful if an itemized tabulation of the floor areas for each unit could be included on the revised plat as well. If you have any questions, please call me at 920-5095.
