Other: / " / FILE STATUS AND LOCATION: , ;-, .r-, MEMORANDUM TO: Leslie .Lamont, Interim City Planning Director FROM: Kim Johnson, Planner RE: Insubstantial Amendment to Aspen Meadows SPA Development Plan for the Addition of a Japanese Garden DATE: July 11, 1994 ----------------------------------------------------------------- ----------------------------------------------------------------- SUMMARY: The Aspen Institute wishes to amend the Aspen Meadows Master Plan to allow the construction of a Japanese style meditation garden near a walkway to the Music Tent. This proposal meets the qualifications of an insubstantial amendment to the Meadows SPA pevelopment Plan and shall be approved by the Planning Director. FINDINGS: The Aspen Meadows Final SPA Development Plan was adopted in June of 1991. The landscape development within the SPA boundary was considered as part of this approval. Any changes to this 1991 approval must be processed as substantial or insubstantial amendments. This application proposes to create a Japanese style garden of approximately 800 s.f. between the Music Tent and the Boettcher Building. This site was chosen for its views up towards Independence Pass and down to Mt. Sopris as well as the limited amount of undisturbed sage. Currently growing in this area is predominately unmowed grasses. What few existing sage plants are in this location will be incorporated whenever possible into the garden's design. A new path will lead to the garden from the one serving the Music Tent. Plant materials used for the Japanese design will be species locally adapted to the mountain environment. A dry gravel "lake bed" will also be incorporated into the garden. Please refer to the attached application and drawing. REFERRAL COMMENT: Upon review of the proposal, Assistant Parks Director Rebecca Baker stated in conversation that her only concern is that the applicant should limit impacts to the sage plants encountered in this area. Native sage is very difficult to transplant and dislikes irrigation. section 7-804(E) governs insubstantial amendments to an approved final development plan by the planning director, The following shall not be considered an insubstantial amendment: a. A change in the use or character of the development. b. An increase by greater than three (3) percent in the overall coverage of structures on the land. I'"'- ~ c. Any amendment that substantially increases trip generation rates of the proposed development, or the demand for public facilities. d. A reduction by greater than three (3) percent of the approved open space. e. A reduction by greater than one (1) percent of the off-street parking and loading space. f. A reduction in required pavement widths or rights-of-way for streets and easements. g. An increase of greater than two (2) percent in the approved gross leasable floor area of commercial buildings. h. An increase by greater than one (1) percent in the approved residential density of the proposed development. i. Any change which is inconsistent with a condition or representation of the project's original approval or which requires granting of a further variation from the project's approved use or dimensional requirements. staff has reviewed the proposed garden addition to the SPA landscaping plan and finds that criteria (b) through (h) do not apply to this proposal. Criteria (a) and (i) have been satisfied because the project does not create substantial impacts to the open space character of the area. The proposal adds an interesting landscape feature to the south side of the Music Tent where most people make their approach. The garden's designer, Mr. David Slawson, is a .renowned designer of Japanese gardens. Thus, the Institute will be gaining an important landscape feature with the new development. During construction of the garden, staff recommends that a barricade be placed immediately behind the line of new Engelmann spruce trees and the pathway at the northwest portion of the site. This will protect the sage meadow beyond the project boundary. RECOMMENDATION; Staff recommends that the Planning Director approve the insubstantial amendment to the Aspen Meadows Final SPA Development Plan for the addition of a Japanese garden between the Music Tent and the Boettcher Building, finding that the criteria in section 7-S04(E) have been met. The only condition attached to this approval is: 1) In order to protect the sage meadow beyond the project boundary during construction, a barricade shall be placed immediately behind the line of new Engelmann spruce trees and the pathway at the northwest portion of the site. The Aspen Institute is interested in commencing construction as soon as possible on this project as the designer, David Slawson, is currently in town and will be here through July 15th. As you will note on the drawing and as you will remember from our site visit, the existing sage brush in the area will be incorporated into the garden and the dl)' lake bed effect will require vel)' little sage brush removal.
