SUMMARY: The applicant, Aspen Institute, received a substantial
amendment to the Final SPA Development Plan for the Aspen Meadows
in May of 1994. The Aspen Institute had proposed-an approximately
2,410 square foot addition to the seminar facilities at the Paepcke
Auditorium complex. The approval also required the applicant to
record an amended SPA development plan reflecting the approved
changes. The amended plan was to be recorded within 180 days of
final approval, December 12, 1994.

As part of this extension request, staff would also like to point
out that the Institute is proposing minor changes to the 1994
approval and has been working with staff in review of the minor
amendments to the 1994 approval. Those minor changes include 758
square feet of additional square footage that was not contemplated
in the 1994 review. The additional square footage represents a
2.5% increase in floor area from the 1994 approval. These changes
will be approved as a minor amendment by the Community Development
Director if this extension is granted.
Please see Ordinance 21, Series of 1994, which granted the SPA
amendment for the Aspen Institute.
Staff recommends approval of an extension of the date for filing
the amended final SPA development plan to August 31, 1995 finding
that the Land Use Code has not been amended that would require a
reevaluation of the 1994 approval.
RECOMMENDED MOTION: "I move to adopt Resolution _, Series of
1995, extending the date to file amendments to the Aspen Meadows
Final SPA Development Plan to August 31, 1995."

SUMMARY: The applicants, the Aspen Institute, seek to amend the
Aspen Meadows Final SPA Plan for Lot I-B to adjust a previously
granted approval for the expansion of the Institute's Seminar
building.
ZONING: Academic with SPA overlay
STAFF COMMENTS: The Aspen Meadows final SPA development plan was
approved in 1991. The approved plan outlined specific development
proposals and provided the ability for other entities of the Aspen
Meadows to propose future expansions their facilities.
In 1994, a substantial amendment to the final SPA plan was approved
for the expansion of the Aspen Institute's Seminar building. For
a variety of reasons the Institute has been unable to begin
construction based upon the 1994 approval.
The 1994 review granted an approval to add ,approximately 2,410
square feet. However, the existing gross square footage of the
building was incorrectly stated as 5,120 square feet rather than
the current calculations which indicate the building is 5,467
square feet.
The purpose of this application is to correct the existing gross
square footage and to request an additional amount of square
footage than was previously approved.
In addition to the 2,410 square feet, the applicant requests to add
758 more square feet to the proposed enlargement. The total square
footage of the proposed enlargement ,is 3,168. The total gross
square footage of the building will be 8,635.
REVIEW: Pursuant to Section 24-7-804 E. an insubstantial amendment
of an approved SPA plan may be authorized by the Planning Director
provided that the amendment does not:
a. change the use or character of the development;
RESPONSE: The character of the Aspen Meadows SPA is tourist, guest
and conference oriented. The use of the Seminar building will be
enhanced by the expansion as circulation within the building will
be improved, bathroom facilities will become accessible for the

The Institute's request for an expansion is consistent with the
original approval.
RECOMMENDATION: Staff recommends approval of the correction of the
gross square footage of the Aspen Institute's Seminar building and
the additional 758 square feet to be included with the 1994 request
to expand the Seminar building with the following conditions;

1. The applicant shall record an amended SPA plan that indicates
the approved addition. The plat shall be recorded prior to the
issuance of any building permits or within 180 days whichever is
shorter. Failure to record the amended plat shall render this
approval void.
2. The total gross square footage of the Aspen Institute Seminar
building shall be 8,635 square feet.
3. All representations made in the application and in meetings
with staff shall be adhered to unless amended.

The 180 day Recordation Period for the Amended Final SPA Development Plan commencing
6/1 3/94 has expired and the documents for the approval have not been recorded. We are hereby
requesting that an extension for this Recordation Period be granted by the City Council through an
Ordinance Procedure.
We anticipate an October construction start date and would like to secure Planning Department
approval as soon as possible so we can submit for Building Permit review at the earliest possible
date. If possible we would like to be scheduled for the June 26th City Council meeting and the next
available meeting for review and approval.
The following documents are included for your review:
- A letter of authorization from the Owner to act as his representative
- A draft Plat with current amendment conditions and 1992 SPA approval conditions

The following text was included in a letter to Bill Drueding dated 6/1/95. Per your request I am
readdressing this letter in your name.
The amendment to the Aspen Meadows Final SPA Development Plan was granted for this project on
June 13, 1994 as Ordinance No. 21 (Series of 1994). A copy of this Ordinance is attached for your
reference. Prior to our submittal for an Insubstantial Amendment to the SPA Plan, Kim Johnson
suggested we review our assumptions for calculating the lot coverage increase with you (Bill
Drueding).
The area to be added to the existing building was quoted as approximately 2,410 square feet. The
existing gross area of the building was incorrectly quoted as 5,120 square feet. The correct
existing gross area of the building is 5,467 square feet and is identified in our drawing sheet A2.0,
Demolition Floor Plan, dated 6/1/95. This corrected figure is significant because our proposed
addition to the building has increased to 3,168 square feet and we are submitting this information
as a part of our Developme~t Application for an Insubstantial Amendment to the approved SPA Plan.
According to the Review Standards, an Insubstantial Amendment may be authorized by the Planning
Director if an increase is less than three (3%) percent in the overall coverage of structures on the
land. Kim Johnson suggested we consider the approved square footage of the Seminar Building as
existing and use only the difference between the approved and proposed areas in calculating the
overall increase coverage of structures on the land. Our calculations for this increased coverage
are as follows:

The amendment to the Aspen Meadows Final SPA Development plan was granted for this project on

The purpose of this Development Application is to correct the the existing gross area of the building as
5,467 square feet; to increase the area to be added as 3,168 square feet and to request an
Insubstantial Amendment to the SPA Plan by the Planning Director. The proposed net area addition
represents a 2 1/2 percent increase to the existing coverage of structures on the land and is below the
maximum 3 percent increase allowed by the Review Standards.
Review Standards
a. There is no change in use or character of the development.
b. The increase to the overall coverage of structures on the land is less than three (3%) percent.
Overall coverage will be increased by two and one half (2 1/2%) percent.
c. Existing public facilities, utilities and roads exist to service the existing building with no increased
impacts as a result of this amendment.
d. The reduction to the approved open space is not greater than three (3%) percent. The reduction is
one tenth (.1%) of one percent.
e. There is no reduction to the number of off-street parking spaces or loading spaces.
f. There is no reduction to the required pavement widths or the rights-of-way for streets and
easements.
, g. There is no increase to the approved gross leasable floor area of commercial buildinQs.
h. There is no increase to the approved residential density of the proposed development.
i. The change is consistent with the conditions and representations of the project's original approval.
The change does not require granting of a further variance from the project's approved use or
dimensional requirements.

The Planning approvals required to proceed with the project are:
A. Granting of an extension and waiver by the City Council for showing of good cause to
allow the applicant to record an Amended Final SPA Development Plan.
B. Planning Director approval of an Insubstantial Amendment to the SPA Plan for the
2 1/2 percent increase in the overall coverage of structures on the land.
The applicant shall secure the City Council approval of an extension and waiver, then
proceed with securing the Planning Director's approval for the Insubstantial Amendment.
Stan has scheduled Gty Council reviews of the extension and waiver request as follows:

Public Hearing
Due to the fact that their is less than a 30 day period between the two scheduled reviews,
pre-notice posting is required. The Architect has contacted Suzanne Wolff of Community
Development to notify Catherine Koch of the City Clerks Office regarding our request for
pre,notice posting.
Upon detailed review and discussion of the previously approved project and the proposed
square footage increase, Stan determined that granting approval for the Insubstantial
Amendment request would be forthcoming once City Council has granted an extension and
waiver.
Stan requested the Architect readdress the letter to Bill Drueding regarding the
Insubstantial Amendment and overall coverage of structures, dated 6/1/95, directly to
him.
The above represents our report of events noted and items discussed, and will be relied upon as true
and correct by all parties unless notified within 5 working days of receipt.
