MEMORANDUM

RE: Little Nell Insubstantial SPA Amendment

SUMMARY: The applicant proposes to relocate the existing ATM building in the courtyard
between the Little Nell Hotel and the North of Nell building in order to replace one of the two
electric transformers located behind the building and to allow future emergency access to the
tranformers. The ATM building would be moved approximately 10 feet to the southwest. The
application is attached as Exhibit A. Aspen Skiing Company and Alpine Bank have both
consented to the building relocation (Exhibit B).

LOCATION: Little Nell Specially Planned Area; in the vacated portion of Hunter St.

BACKGROUND: In June of 1992, an insubstantial SPA Amendment was approved by the City
Planning Director to allow installation of a 44 square foot structure to house an ATM. The staff
memo dated June 5, 1992, states, "The ATM will block the view of the electric transformers, but
has been located so as not to prevent emergency access to the two transformers that are located in
the same area." However, the equipment needed to replace the transformers cannot access the
area. The Electric Department needs to replace one of the transformers in order to upgrade the
electric service to the City's potable well that is located in the plaza, and needs to maintain future
access in case of emergency.
STAFF COMMENTS:
Insubstantial SPA Amendment: Section 26.80.040(E) of the Aspen Municipal Code authorizes
the Community Development Director to approve an insubstantial amendment to an approved
SPA. The proposed amendment complies with the standards, in that it does tlx:
1. Change the use or character of the development;
2. Increase the overall coverage of structures on the land by more than 3%;
3. Substantially increase trip generation rates or the demand for public facilities;
4. Reduce the approved open space by more than 3%;
5. Reduce the off-street parking and loading space by more than 1 %;
6. Reduce the required pavement widths or rights -of -way for streets and easements;
7. Increase the approved gross leasable floor area of commercial buildings by more than
2%;
8. Increase the approved residential density of the development by more than 1 %;
9. Create a change which is inconsistent with a condition or representation of the project's
original approval or which requires granting a further variation from the project's
approved use or dimensional requirements.
Only one of the transformers is currently directly visible from the courtyard; after the relocation
of the building both transformers will be visible. However, the transformers are set back beneath
the eave of the North of Nell building, and are painted the same color as ,the ATM building and
the ticket booths, and have a minimal visual impact on the courtyard.
RECOMMENDATION: Staff recommends approval of an insubstantial amendment to the
Little Nell SPA to relocate the existing ATM building, subject to the following conditions:
The applicant shall submit an amended plat within 180 days of this approval, for review
and approval by the City Attorney, City Engineer, and the Community Development
Department.

SUBJECT: REPLACING TRANSFORMER
Please find attached an application to move the existing ATM building that is between the North of
Nell and Little Nell in the vacated portion of Hunter Street. This is necessary so I can access the two
transformers behind the building. The original approval of an Insubstantial Plat Amendment for the
construction of this building stated that the building would be located so as to not prevent emergency
access to the two transformers. However, this is not the case. I need to change out one of these
transformers in order to upgrade the electric service to the City of Aspen potable well that is located
out in the plaza. With the current placement of the building, I am unable to get a piece of equipment
to the transformers so they can be moved.
I would like to move the building about ten feet to the southwest. This location would put the
building in compliance with the original approval by allowing us emergency access to our
transformers. If these transformers would fail under the existing conditions, we would have to move
this building to address the transformer for replacement. This would result in a prolonged outage
and is not an acceptable situation.
I have been on site with representatives from Alpine Bank, North of Nell and the Aspen Skiing
Company. We have looked over all concerns and the proposed location is acceptable to all parties.
Hopefully, this application is complete. If not, please let me know. I am available for a site visit.
I would like to complete this work as soon as possible, hopefully in July. If you have any questions,

e. A statement specifying the public facilities that will be needed to accommodate the proposed devel-
opment, and what specific assurances will be made to ensure that public facilities will be available to accommodate
the proposed development.
f. A statement of the reasonable conformance of the final development plan with the approval granted
to the conceptual development plan and with the original intent of the city council in designating the parcel
specially planned area (SPA).
Cr. A plat which depicts the applicable information required by Section 26.88.040(D)(1)(a)(3) and (13)(2)(a).
2. Variations pemutted. The final development plan shall comply with the requirements of the underlying
zone district; provided, however, that variations from those requirements may be allowed based on the standards
of Section 26.80.040(B). Variations may be allowed for the following requirements: open space, minimum
distance between buildings, maximum height, minimum front yard, minimum rear yard, minimum side yard,
minimum lot width, minimum lot area, trash access area, internal floor area ratio, number of off-street parking
spaces and uses, and design standards of Section 26.88.040(C)(4) for streets and related improvements. Any
variations allowed shall be specified in the SFA agreement and shown on the final development plan.
3. SPA agreement. Upon approval of a final development plan, the applicant and the city council shall
enter into an agreement binding the real property to any conditions placed on the development order approving
the final development plan, and providing landscape and public facilities guarantees as specified in Section
26.84.040(C) and (D).
4. Recordation. The final development plan, which shall consist, as applicable, of final drawings depicting
the site plan, landscape plan, utility plan and building elevations, and Specially Planned Area (SPA) agreement
shall be recorded in the office of the Pitkin County Clerk and Recorder, and shall be binding upon the property
owners subject to the development order, their successors and assigns, and shall constitute the development
regulations for the property. Development of the property shall be limited to the uses, density, configuration,
and all other elements and conditions set forth on the final development plan and SPA agreement. Failure
on the part of the applicant to record the final development plan and SPA agreement within a period of one
hundred and eighty (180) days following its approval by city council shall render the plan invalid. Reconsideration
of the final development plan and SPA agreement by the commission and city council will be required before
its acceptance and recording.
E. Amendment to final development plan.
1. An insubstantial amendment to an approved development order for a final development plan may
be authorized by the Community Development Director. The following shall not be considered an insubstantial
amendment:
a. A change in the use or character of the development.
b. An increase by greater than three (3) percent in the overall coverage of structures on the land.
c. Any amendment that substantially increases trip generation rates of the proposed development, or
the demand for public facilities.
d. A reduction by greater than three (3) percent of the approved open space.
e. A reduction by greater than one (1) percent of the off-street parking and loading space.
f. A reduction in required pavement widths or rights -of -way for streets and easements.
g. An increase of greater than two (2) percent in the approved gross leasable floor area of commercial
buildings.
h. An increase by greater than one (1) percent in the approved residential density of the development.

SUMMARY: The applicant seeks to amend the Little Nell Final SPA
Plan to install a 6.3' by 7' ATM booth in the courtyard next to
the Durant Avenue ticket booths.
ZONING: Conservation with SPA Overlay
REFERRAL COMMENTS:
Having reviewed the above referenced application, and having made
a site inspection, the engineering department has the following
comments:
1. The area required for the Automated Teller Machine was given
as 44 square feet which meets the insubstantial amendment
requirement of being less than 3% of the total open space.
2. The proposed location of the ATM does not conflict with the
waterline easement which goes through this property.
3. The applicant needs to adjust the survey boundary on the
subdivision plat to include the vacated portion of Hunter Street
that is now under Ski Company ownership.
STAFF COMMENTS: The applicant proposes to install a 6.3' by 7' ATM
booth at the south end of the Aspen Ski Company ticket booths on
Durant Street. The applicant has worked with the Parks Department,
the Electric Department and the Planning Department to find the
ideal location.
Pursuant to Section 24-7-804 E. an insubstantial amendment of an
approved SPA plan may be authorized by the Planning Director
provided that the amendment does not:
a. change the use or character of the development;
RESPONSE: The character of the SPA plan is a tourist and ski
orientation. The character and use of the courtyard space (where
the ATM is proposed) is a very organized and uncluttered open
space. The booth will be placed approximately three feet from the
south end of the ticket booth between the two trees that frame the
bench so as not to clutter the courtyard and will be the same wood
pattern and color as the ticket booths. The ATM will block the
view of the electrical transformers but has been located so as not
to prevent emergency access to the two transformers that are
located in that same area.
b. increase by greater than 3% the overall coverage of
structures on the land;
RESPONSE: The booth that will encase the ATM will cover
approximately 44 square feet and does not increase the site
coverage by greater than 3%.
c. substantially increase trip generation rates of the
proposed development, or the demand for public facilities;
RESPONSE: This area supports a significant amount of pedestrian
traffic and the ATM's location is intended to service that traffic.
The machine was originally intended to service the skier purchasing
lift tickets. It is not anticipated that traffic will increase due
to the machined.
d. reduce by greater than 3% the approved open space;
RESPONSE: A 44 square foot booth will not reduce the open space
of this development (which include the area surrounding the
Gondola) by greater than 3%.
e. reduce by greater than 1% the off-street parking and
loading space;
RESPONSE: Parking and loading are not affected by this proposal.
f. reduce in required pavement widths or rights -of -way for
streets and easements;
RESPONSE: The proposal will not affect pavement widths or rights -
of -way for streets and easements.
g. increase greater than 2% the approved gross leasable floor
area of commerical buildings;
RESPONSE: The Planning staff determined that the ATM was
considered net leasable and functioned more as a service.
Therefore there is no increase in leasable square footage.
i. create a change which is inconsistent with a condition or
representation of the project's original approval or which
requires granting of a further variation from the project's
approved use or dimensional requirements;
RESPONSE: When the aspen Ski Company was seeking an SPA approval
for the development of the Little Nell and the base area the
position of the ticket kiosks was thoroughly discussed. The
original placement of both tickets booths were changed due to

concerns voiced by the owners in the North of Nell building.
Apparently the previous location blocked views from the North of
Nell and created a congested courtyard situation.
Having reviewed the files, staff discussed the placement of the ATM
booth with the manager of the North of Nell, Don Helmuth. Mr.
Helmuth reviewed the location of the booth with the homeowners and
indicated that they did not have a problem with the location.
RECOMMENDATION: Staff recommends approval of the SPA plan
amendment reflecting the location of the ATM booth with the
following conditions:
1. The entire booth that encases the machine shall be 6.3' by 7'
and will be finished with the same wood pattern and color as the
ticket booths unless the applicant wishes to enhance the exterior
of the booth via color or murals etc. which shall be reviewed by
the Ski Company and Planning Department to ensure consistency with
the SPA final development plan and City of Aspen sign code.
�2. Pursuant to the attached map, the booth shall be minimum of
6.3' away from the electrical transformers and will not encroach
over the tree grates.
3. It may be necessary to move the bench approximately 2 or 3
inches to accommodate the booth, however the booth shall not
encroach over the utility box that is located beneath the bench.

Pursuant to our telephone conversation, I write this
letter to request an amendment to the Final Development Plan of
the Little Nell S.P.A. As we discussed, the Aspen Skiing
Company and Alpine Bank would like to put an ATM machine in the
Little Nell mall area, next to the ticket windows. I have
enclosed for your review a picture of the type of machine which
is contemplated (approximately 9' x 61).
During the course of operation of the ski area, it has
become apparent that guests often need cash and would like the
opportunity to utilize an ATM machine. We don't believe that
this was discoverable during the actual planning of the S.P.A.
or the development of the hotel. We feel that it is, in fact,
consistent with the intent of the original Little Nell S.P.A.,
which was to provide a quality experience for Aspen Skiing
Company guests, as well as guests of the City of Aspen.
We believe that the amendment we seek qualifies under the
amendment to final development order criteria. There is no
change in the use or character of the development. There is no
increase of 3% in overall coverage of structures on the land.
There will be no increase in trip generation rates of the
proposed development. The demand for public facilities will
not reduce greater than 3% of the approved open space. It will
not in any way affect off-street parking or loading space. It
will not affect required pavement widths or rights -of -way for
streets and easements. It will not increase 2% or greater of
the approved gross leasable floor area of the commercial
buildings. No residential density will be affected by this
request, nor is the change inconsistent with the condition or
representation of the project's original approval, or which
requires the granting of a further variation of the project's
approved use or dimensional requirements.

have the ATM available for the start of the ski season. I

believe that this type of minor change is exactly what the
insubstantial amendment was intended to fulfill. Putting the
addition of an ATM machine through a full-blown review and
approval process would not seem to make sense or be productive
for the Planning and Zoning Commission or City Council time.
Enclosed please find letters of authorization from the
Aspen Skiing Company and Alpine Bank, proof of ownership,
Alpine Bank's check in the amount of $113.00 for the Planning
Office review fee, pictures showing where the ATM machine will
be situated, and a picture of the ATM machine itself. If you
have any questions, please feel free to contact me. Otherwise,
I will assume that you will place this matter on the next
available City Council agenda. Thank you for your help and
