CCtIC/, o� �L ll C MEMORANDUM TO: Stan Clauson, Community Development Director FROM: Suzanne Wolff RE: Little Nell Insubstantial SPA Amendment DATE: July 26, 1996 SUMMARY: The applicant proposes to relocate the existing ATM building in the courtyard between the Little Nell Hotel and the North of Nell building in order to replace one of the two electric transformers located behind the building and to allow future emergency access to the tranformers. The ATM building would be moved approximately 10 feet to the southwest. The application is attached as Exhibit A. Aspen Skiing Company and Alpine Bank have both consented to the building relocation (Exhibit B). APPLICANT: City of Aspen Electric Department REPRESENTATIVE: Bill Earley, Electric Superintendent LOCATION: Little Nell Specially Planned Area; in the vacated portion of Hunter St. ZONING: C/SPA BACKGROUND: In June of 1992, an insubstantial SPA Amendment was approved by the City Planning Director to allow installation of a 44 square foot structure to house an ATM. The staff memo dated June 5, 1992, states, "The ATM will block the view of the electric transformers, but has been located so as not to prevent emergency access to the two transformers that are located in the same area." However, the equipment needed to replace the transformers cannot access the area. The Electric Department needs to replace one of the transformers in order to upgrade the electric service to the City's potable well that is located in the plaza, and needs to maintain future access in case of emergency. STAFF COMMENTS: Insubstantial SPA Amendment: Section 26.80.040(E) of the Aspen Municipal Code authorizes the Community Development Director to approve an insubstantial amendment to an approved SPA. The proposed amendment complies with the standards, in that it does tlx: 1. Change the use or character of the development; 2. Increase the overall coverage of structures on the land by more than 3%; 3. Substantially increase trip generation rates or the demand for public facilities; 4. Reduce the approved open space by more than 3%; 5. Reduce the off-street parking and loading space by more than 1 %; 6. Reduce the required pavement widths or rights -of -way for streets and easements; 7. Increase the approved gross leasable floor area of commercial buildings by more than 2%; 8. Increase the approved residential density of the development by more than 1 %; 9. Create a change which is inconsistent with a condition or representation of the project's original approval or which requires granting a further variation from the project's approved use or dimensional requirements. Only one of the transformers is currently directly visible from the courtyard; after the relocation of the building both transformers will be visible. However, the transformers are set back beneath the eave of the North of Nell building, and are painted the same color as ,the ATM building and the ticket booths, and have a minimal visual impact on the courtyard. RECOMMENDATION: Staff recommends approval of an insubstantial amendment to the Little Nell SPA to relocate the existing ATM building, subject to the following conditions: The applicant shall submit an amended plat within 180 days of this approval, for review and approval by the City Attorney, City Engineer, and the Community Development Department. This is necessary so I can access the two transformers behind the building. The original approval of an Insubstantial Plat Amendment for the construction of this building stated that the building would be located so as to not prevent emergency access to the two transformers. However, this is not the case. I need to change out one of these transformers in order to upgrade the electric service to the City of Aspen potable well that is located out in the plaza. With the current placement of the building, I am unable to get a piece of equipment to the transformers so they can be moved. I would like to move the building about ten feet to the southwest. This location would put the building in compliance with the original approval by allowing us emergency access to our transformers. If these transformers would fail under the existing conditions, we would have to move this building to address the transformer for replacement. This would result in a prolonged outage and is not an acceptable situation. I have been on site with representatives from Alpine Bank, North of Nell and the Aspen Skiing Company. We have looked over all concerns and the proposed location is acceptable to all parties. Hopefully, this application is complete. If not, please let me know. I am available for a site visit. Any variations allowed shall be specified in the SFA agreement and shown on the final development plan. 3. SPA agreement. Upon approval of a final development plan, the applicant and the city council shall enter into an agreement binding the real property to any conditions placed on the development order approving the final development plan, and providing landscape and public facilities guarantees as specified in Section 26.84.040(C) and (D). 4. Recordation. The final development plan, which shall consist, as applicable, of final drawings depicting the site plan, landscape plan, utility plan and building elevations, and Specially Planned Area (SPA) agreement shall be recorded in the office of the Pitkin County Clerk and Recorder, and shall be binding upon the property owners subject to the development order, their successors and assigns, and shall constitute the development regulations for the property. Development of the property shall be limited to the uses, density, configuration, and all other elements and conditions set forth on the final development plan and SPA agreement. Failure on the part of the applicant to record the final development plan and SPA agreement within a period of one hundred and eighty (180) days following its approval by city council shall render the plan invalid. Reconsideration of the final development plan and SPA agreement by the commission and city council will be required before its acceptance and recording. E. Amendment to final development plan. 1. An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director. The following shall not be considered an insubstantial amendment: a. A change in the use or character of the development. b. An increase by greater than three (3) percent in the overall coverage of structures on the land. c. Any amendment that substantially increases trip generation rates of the proposed development, or the demand for public facilities. d. A reduction by greater than three (3) percent of the approved open space. e. A reduction by greater than one (1) percent of the off-street parking and loading space. f. ZONING: Conservation with SPA Overlay REFERRAL COMMENTS: Having reviewed the above referenced application, and having made a site inspection, the engineering department has the following comments: 1. The area required for the Automated Teller Machine was given as 44 square feet which meets the insubstantial amendment requirement of being less than 3% of the total open space. 2. The proposed location of the ATM does not conflict with the waterline easement which goes through this property. 3. The applicant needs to adjust the survey boundary on the subdivision plat to include the vacated portion of Hunter Street that is now under Ski Company ownership. STAFF COMMENTS: The applicant proposes to install a 6.3' by 7' ATM booth at the south end of the Aspen Ski Company ticket booths on Durant Street. The applicant has worked with the Parks Department, the Electric Department and the Planning Department to find the ideal location. The original placement of both tickets booths were changed due to 2 concerns voiced by the owners in the North of Nell building. Apparently the previous location blocked views from the North of Nell and created a congested courtyard situation. Having reviewed the files, staff discussed the placement of the ATM booth with the manager of the North of Nell, Don Helmuth. Mr. Helmuth reviewed the location of the booth with the homeowners and indicated that they did not have a problem with the location. RECOMMENDATION: Staff recommends approval of the SPA plan amendment reflecting the location of the ATM booth with the following conditions: 1. The entire booth that encases the machine shall be 6.3' by 7' and will be finished with the same wood pattern and color as the ticket booths unless the applicant wishes to enhance the exterior of the booth via color or murals etc. which shall be reviewed by the Ski Company and Planning Department to ensure consistency with the SPA final development plan and City of Aspen sign code. �2. Dear Leslie: Pursuant to our telephone conversation, I write this letter to request an amendment to the Final Development Plan of the Little Nell S.P.A. As we discussed, the Aspen Skiing Company and Alpine Bank would like to put an ATM machine in the Little Nell mall area, next to the ticket windows. I have enclosed for your review a picture of the type of machine which is contemplated (approximately 9' x 61). During the course of operation of the ski area, it has become apparent that guests often need cash and would like the opportunity to utilize an ATM machine. We don't believe that this was discoverable during the actual planning of the S.P.A. or the development of the hotel. We feel that it is, in fact, consistent with the intent of the original Little Nell S.P.A., which was to provide a quality experience for Aspen Skiing Company guests, as well as guests of the City of Aspen. We believe that the amendment we seek qualifies under the amendment to final development order criteria. There is no change in the use or character of the development. There is no increase of 3% in overall coverage of structures on the land. There will be no increase in trip generation rates of the proposed development. The demand for public facilities will not reduce greater than 3% of the approved open space. It will not in any way affect off-street parking or loading space. It will not affect required pavement widths or rights -of -way for streets and easements. It will not increase 2% or greater of the approved gross leasable floor area of the commercial buildings.
