Kerr asked if it was still necessary to go before the Board of
Adjustment. Debra Moore answered it was not necessary, but an
adjustment of even 2-1/2 to 3 ft. would help. She stated she
would like to go the the Board of Adjustment and reduce footage
they were requesting. It would take care of any of the trees that
are in question. Chairman Kerr asked if there were any members of
the commission that would be opposed to an incringement of 2-1/2
to 3 ft. There were no objections and Kerr asked staff to relay
that there were no objections from P&Z to the Board of Adjustment.
ASPEN THEATRE IN THE PARK
FINAL SPA
Chairman Kerr opened the public hearing.
Kim Johnson represented on behalf of staff, and asked Carol
Lowenstern, representing applicant, to submit for the record the
Affidavit of Public Notice (attached in record). Johnson stated
this was a final SPA Plan and Special Review for Parking for the
Aspen Theatre in the Park. Johnson said she had been processing
their yearly approvals through staff's temporary use permit
process, because the applicant was unable to come in for full SPA.
Given the amount of time it takes, it always seemed their season
caught up with them, and they needed some immediate solution to
their tent correction every year. The theatre tent is erected in
May and removed in September of each year. This year, Johnson said,
they wanted to get a headstart, and she stated staff does support
this final SPA Plan with its accessory reviews.
There are a couple of issues that are presented in the memorandum,
both from Planning and Parks' perspective; they are, parking of
non-central service vehicles in the parking and service area, and
a year-round storage situation, including everything from
legitimate prop materials to construction debris. Johnson stated
staff has conditioned the approval with specific conditions
regarding continued diligence of the parking situation, requiring
them to promptly clean up the site after each summer season, and
prohibition against storage and materials on site. Johnson stated
she and Carol Lowenstern spoke previously and there are some
options the applicant can pursue later as an amendment to approval.
She said the proposal is consistent with the 1993 Rio Grande
Masterplan which Johnson reviewed in processing this plan.
Kerr asked if Johnson was placing the burden of parking enforcement
on applicant. Johnson replied that she was putting the applicant
on notice that it is an issue, and if felt by staff, City Parks,
and Planning and zoning that it is a continued on-going thing, that
Theatre in Parks will have to be called back for discussion. Kerr

asked if the applicant will call police department if someone is
parking illegally, or notify their suppliers. Johnson stated that
perhaps Lowenstern had more insight, but employees, instead of
parking in the Rio Grande Parking Garage or along Rio Grande Place,
park next to the tent area. Johnson said, according to the
language in the Rio Grande Masterplan, the area is for central
delivery-type service and handicapped parking to be used during
performances, and only when necessary for delivery.
Kerr stated that what he was getting at was; staff is not requiring
applicant to provide some kind of parking mitigation plan that must
be reviewed periodically, but instead, is saying, don't do this
kind of thing, don't let it happen, and if it does, you are subject
to us looking at it again if someone complains. Otherwise, there
really is no enforcement mechanism. Johnson agreed, stating, I
guess so, unless the commission could offer some more internal
suggestions. Lowenstern' stated that if one person is ticketed
once, no one would park there. She said Aspen Theatre in the Park
really tries to keep people from parking illegally, but
occasionally someone will go into the tent thinking they will be
there for a few minutes and stays there an hour and their car sits
there. She felt ticketing would be appropriate.' Kerr stated he
was not' suggesting more, he said he was trying to make sure of the
understanding.
Hunt said he wondered if the accessway to that area should be
posted "no parking", except for handicapped and active delivery.
Garton stated that if posted, then it could be ticketed, and she
felt that was important. George Robinson of Parks stated he felt
signings would help a lot, and Lowenstern agreed.
Kerr asked if the applicant had a presentation to make and
Lowenstern stated she did not. Kerr asked if she had read the
conditions of approval and she stated. she had, and had no problems
with them. Chuck Roth of Engineering asked regarding wiring and
it not being underground. Garton asked if the lights were from a
generator or off the power pole. It was stated there were some
wires in the air and the electric source was a transformer in a
'shed, from the power pole, to the wooden shed, and then into the
tent. Lowenstern stated there were some wires in tubing that go
into the back of the tent. Kerr asked Roth if that was the only
place around the Rio Grande that has overhead, and was everything
else underground. Roth stated, yes, it was the only place that had
overhead. Hunt stated that he thought it was most likely telephone
wiring as opposed, to an electical drop.
There were no public comments and Chairman Kerr closed the public
hearing.

MOTION
Hunt moved to recommend approval of the SPA Amendment and Special
Review for Parking, GMQS Exemption for an Essential Public Facility
for the Theatre in the Park with Conditions 1-5 on Planning Office
memorandum dated 2 May 1995 and an additional Condition #6; if
there are overhead utilities, they should be underground. Garton
seconded, vote was unanimous with all in favor with 6 conditions;
motion carried.
Discussion of Motion
Clarification was asked of Condition #1 regarding signage of the
road. Johnson stated she had written some language and could read
it; Kerr asked her to do so. "The parking area and roadway shall
be signed for handicap access and service delivery only, and shall
not be used for access drive". Hunt stated he would so accept that
in the motion.
Kerr asked if Aspen Theatre in the Park would put up the signs and
pay for the signs? Johnson asked Robinson of the Parks Department
if Parks had signs to put up, or do they buy them. Robinson stated
they could work with the applicant regarding the signs and usually
the applicant pays for the signs. As far as placement
and installation, Parks would confer with the applicant.
Chaikovska asked regarding the wiring and questioned the expense.
She stated the commission was putting in the condition without even
knowing where it is, and said, perhaps it should be modified to see
what the applicant is up against.
Garton addressed Robinson's memorandum, Exhibit A, to the
applicant. The memorandum asked if there were any proposals to
improve any of the facilities, such as the portable housing toilet,
the electrical panel housing and storage area. Lowenstern stated
there hasn't been. Garton asked if staff thought that portable
toilets and all are fine? It was stated that it was a temporary
thing and Garton asked, how do we know that? Johnson stated,
temporary meaning, not used all year round, and probably would not
make financial sense to install plumbing. Robinson added that
there have been a few improvements but not represented on the map.
Garton asked if the Parks Department was responsible for the
maintenance of the Snowmelt area by a trail. Robinson stated it
had been turfed and rocks put in front of the tent area.
Garton, asked regarding no maintenance issues, such as irrigation
and turf, being addressed. Robinson stated he was basically asking
in his memorandum if applicant planned any more improvements in
irrigation, and if applicant still planned on mowing as they have

historically, and if they wanted that donated to the city. If so,
the Parks Department needed to know that, and it was there for
coordination. Lowenstern stated she would relay the this to the
the Theatre and its committee.
Mooney asked staff if there was any way, under the guidelines of
the SPA, that the Theatre in the Park could be used for anything
else; for any other event, meeting, or sub-lease or any other
activity that could happen. He was concerned about any change in
philosophy or change in process. Johnson said she would say, no.
Representations have been made in their letters that it is for some
performances, for so many weeks of the year, even times of the day,
that they are presented. In the off hours, there are sets up and
Johnson said it is not like a vacant stage that could be rented
out. Lowenstern stated that perhaps there were some days in August
where it could happen.
Chairman Kerr closed the public hearing.
CITY OF ASPEN/GOLF MAINTENANCE FACILITY
CONCEPTUAL DEVELOPMENT PLAN,
SUBSTANTIAL AMENDMENT
GMOS EXEMPTION & CONDITIONAL USE REVIEW
Leslie Lamont presented on behalf of staff and stated that the
Parks Department is requesting an expansion of their office and
maintenance facility. The zone district is Park with a PUD
overlay, therefore, it requires either insubstantial or substantial
review. Staff has determined, and the Parks Department has
requested, this be considered a substantial review; typically,
substantial reviews are a two-step process, but Parks has requested
a full four-step review process - doing conceptual P&Z City Council
and then final P&Z and City Council. Lamont stated that is why
this meeting is technically not a public hearing. Lamont stated
that the meeting would be just a conceptual review of the proposal
and she said that at the end of her memorandum she outlined several
threshold issues she felt the commission could give guidance to the
Parks Department on. Basically, she said the applicants are
proposing to expand their existing office space by an additional
1,000 sq. ft. and they are proposing to construct a maintenance
storage facility of about 9,000 sq. ft. The proposal in the
application is one that has been worked through with their
architect, neighborhood meetings, and one that they believe is the
best solution for them. However, they did start out with several
different ideas and several different designs. In addition, Lamont
attached to the memorandum, a letter from Bill Sharp with his
suggestion for a design for the maintenance building.

Councilwoman Richards said this application is not an application for parking to
the north of the Courthouse and has not been reviewed by P & Z~
City Attorney Worcester suggested amending the ordinance to read, "Applicant
shall provide bicycle racks for a minimum of 6 bicycles on the north side of the
jail building. Applicant shall submit a parking plan for the approval ofthe
director of the community development prior to C/O".
Councilwoman Waggaman moved that the applicant pave 4 spaces, add bicycle
racks and landscaping on the north side of the building; seconded by Councilman
Marolt.
Councilwoman Richards objected to creating parking spaces on open space. This
application does not cause a growth of employees. Councilwoman Richards said
this space is part of the entrance to the Youth Center. Stan Clauson suggested that
the applicants clean up the area between the Courthouse and submit a parking
plan. If the applicants need more spaces, staff will come back to Council.
Councilwoman Waggaman amended the motion to adopt Ordinance #23, Series of
1995, approving alternate 1, approving an exemption from the mitigation of
housing for an essential public facility, to bring the parking mitigation plan back
to the community development director including bicycle racks and to keep
unnecessary vehicles from parking there; seconded by Councilman Marolt. Roll
call vote; Councilmembers Marolt, yes; Paulson, yes; Richards, yes; Waggaman,
yes; Mayor Bennett, yes. Motion carried.
ORDINANCE #24, SERIES OF 1995 - Aspen Theatre in the Park Final SPA
Mary Lackner, community development department, told Council this is a SPA
plat amendment to the Rio Grande master plan. The applicant has been receiving
temporary use permits to erect their tent for the summer season. This is a request
for permanent approval of this tent and will eliminate the annual review. Ms.
Lackner said one outstanding issue is parking down by the snow melt area. Ms.
Lackner recommended the dumpster be moved to the south of the trail so that
trash trucks do not have to cross the trail. There have been complaints about
storage on site and it needs to be cleaned up. There is an overhead wire that
should be undergrounded if this is to be a permanent use. Ms. Lackner said
Council is being asked to waive the housing mitigation for this non-profit

organization. P & Z recommends approval with conditions outlined in the
memorandum.
Mayor Bennett opened the public hearing.
Pat told Council the dumpster has been moved up by the old snowmelt. Pat noted
there are construction vehicles parked down by their tent. ThIs will be eliminated
when the sidewalk project is complete. Pat said the theatre company does not
currently have the money to underground the phone line. Pat told Council the
theatre company reuses a lot of material which is why they leave the material and
props on site. Pat said the old stove and refrigerator can be relocated. Amy
Margerum, city manager, suggested if Council requires either a fence or
landscaping that they make this an administrative review by the planning office.
The applicant can design something to screen this area. Councilwoman Richards
said she would prefer not to see another fence in this area. Councilwoman
Waggaman pointed out the theatre company already stores their tent in the winter
and she would prefer that ariy props are stored off site. Mayor Bennett said the
ordinance should state this storage is screened and the applicants can work with
the community development department. Councilwoman Richards said there has
to be a limit of what is stored on site.
Stan Clauson, community development director, said undergrounding of the phone
wire is consistent with the overall plan for town and for the Rio Grande.
Councilwoman Richards suggested the city help finance the undergrounding of
this wire with a 3 year payoff. Council agreed with this.
Mayor Bennett quoted from the Rio Grande master plan discussion about parking
on this property. There was to be only 2 handicap parking spaces. Council
wanted as little asphalt on the area as possible. The motion states, "automobile
access to the site be restricted as much as possible and still comply with minimum
technical handicap access requirements". The applicants told Council there are
no cars parking on the site. They have requested no parking signs for that area. It
will only be used as handicap drop off. The handicap parking spaces are to be up
on Rio Grande drive. Ms. Lackner suggested the amendment to the SPA could
show that Art Park road is narrowed to the minimum needed by the city and that
the sides are vegetated. Council agreed this should be shown on the plat.

The amendments to the ordinance will be condition #1 will be changed to "All
parking, handicap parking and handicap drop-offs will be consistent with the Rio
Grande master plan as adopted by the City Council". Condition #2 will have
added "Materials and props stored on site shall be kept out of view in accordance
with a landscaping plan including fencing if necessary to be approved by the
director of community development with the ability of Council to review if it is
not working". Condition #5 will read "Any overhead utility wires shall be
undergrounded by the applicant within 3 years. The applicant shall work with the
parks department on an appropriate digging schedule". The,payback or financing
will be done separately with staff.
Mayor Bennett closed the public hearing.
Councilwoman Waggaman moved to adopt Ordinance #24, Series of 1995, on
second reading as amended above; seconded by Councilwoman Richards. Roll

ORDINANCE #27,1995 - Tap Fee Waivers for Mixed Affordable/Free Market
Projects
Amy Margerum, city manager, told Council this establishes a partial fee waiver
for mixed free market, affordable projects built in the AH zone. The
recommendation is that this be done on a sliding scale; category I would be 100
percent fee waiver, category 2 is 70 percent, category 3 is 40 percent and category
4 or resident occupied would be requiredto pay the full tap fee. Ms. Margerum
said this will apply to the Ute Trail Townhomes and this person will receive a
rebate.
Mayor Bennett opened the public hearing. There were no comments. Mayor
Bennett closed the public hearing.

First reading of this ordinance was adopted on the Consent Calendar
on May 15, 1995.
Process: The Planning Commission reviewed the proposal at a public
hearing on May 2, 1995 and approved Special Review for parking in
the Public zone. The Commission is forwarding a recommendation to
Council for the approval of Final SPA Plan and GMQS Exemption for
essential public facilities.
Background: The 1993 Rio Grande Master Plan approved general
locations for various users of the entire park property. At that
time, the Aspen Theatre in the Park did not propose specific
development, but acknowledged within the Master Plan that they
would be making changes in the near future. Staff finds that the
Theatre's proposal is consistent with the Rio Grande Master Plan.

section 24-8-104.C allows the Council to exempt from competition
and mitigation development associated with public facilities, and
more specifically, non-profit entities, "as it deems appropriate
and warranted".
As the Aspen Theatre in the Park has been a contributing cultural
amenity in Aspen for many years, Planning and Housing staff
recommend approval of the exemption and waiver of mitigation for
the tent productions. This is due to their seasonal nature and
consistent with the major developments undertaken by the several
non-profit users at the Aspen Meadows.

Municipal Code.
Financial Implications,: There are no additional public costs

waiver is granted by city Council for a showing of good cause.

these items must be stored on the site. However, it is much
preferred that off-site storage is found in the off season. Prompt
clean-up of the site after the summer season is a problem.
Engineering mentioned a the P&Z review that there is an overhead
wire extending from Rio Grande Place down to the tent area. We
have determined that this is a telephone line serving the tent.
Engineering wants this wire undergrounded, especially because of
the park area it traverses.
GMOS exemption for essential public facilities:
section 24-8-104.C allows the Council to exempt from competition
and mitigation development associated with public facilities, and
more specifically, non-profit entities, "as it deems appropriate
and warranted".
As the Aspen Theatre in the Park has been a contributing cultural
amenity in Aspen for many years, Planning and Housing staff
recommend approval of the exemption and waiver of mitigation for
the tent productions. This is consistent with the major
developments undertaken by the several non-profit users at the
Aspen Meadows.
Staff has attached Exhibit "A" for the SPA review standards and
staff response as set forth in section 24-7-804 B. of the Aspen
Municipal Code.
Financial Implications: There are no additional public costs
associated with this development.
Recommendations: The Planning and Zoning commission recommends
approval of the Final SPA Development Plan and GMQS Exemption for
Essential Public Facilities with the following conditions which
are listed in the ordinance:
1. The parking area and access drive shall be signed by the
applicant for handicap access and service delivery only and
shall not be used for employee parking, patron parking, or any
other use specifically not allowed by the SPA approval.
Failure to comply with this requirement will require the
applicant to be notified to appear before the Planning and
Zoning commission for a show cause hearing.

Aspen Theatre in the Park is requesting a Permanent use permit for the theatre
tent on the Rio Grande Parcel which includes the Art Park. The theatre has
operated in the same location since the summer of 1986 and is in large part
reasonable for the reclamation of the area. The first summer a group of theatre
volunteers undertook a cleaning and planting project which resulted in the Art
Park. The theatre tent is consistent with the Master Plan for the Rio Grande
parceL The theatre has operated in the same location for the past 8 summers
with minimal, if any, impacts and has been compatible with the surrounding
neighborhood.
Theatre in the Park will erect the same white tent as last summer. The erecting of
the tent would commence May 15 and the dismantling will be September 15-20.
The tent has interior structural supports of aluminum. A pl<i.tform was built to
provide for seating and the stage which was stored on site for the winter. A
platform to house the lighting equipment as well as partitions will be constructed
inside the tent. A propane heating system will also be in use. The shed for the
portable restore facilities remain.
The attached site plan shows the location of the theatre tent which is
approximately in the center for the park below the parking facility. The location
of the tent is such that it is accessible by public transportation, pedestrian/bicycle
traffic and by automobile with adequate parking at the city parking garage.
There will not be parking available next to the theatre, but we do request at least
3 spaces be available for delivery vehicles necessary for nightly operation of the
theatre and to provide for handicapped parking,
Theatre in the Park, together with the Aspen Art Museum located across the
river, the Art Park, the walking trails and the tranquillity of the residential area
along with the activities of the other facilities has brought a revitalization to the
long neglected Rio Grande parceL The Rio Grande Park has become an activity
center combining the arts and outdoor activities while connecting the town with
the river.

The tent will be erected after May 15, depending on the weather conditions, with
a crew of approximately 2 to 6 people and will be dismantled after September 6
with the same crew. During the operation of the theater there is a set crew of 2-5
people per day with a maximum of 15 during rehearsals. The performances are
scheduled for 6:30 p.m.- 9:00 p,m. on Wednesday and Thursday and 8:00 p.m.-
10:30 p.m. on Friday and Saturday, Rehearsal hours will range from
approximately 6-10:30 p.m. six nights a per week, except for the two "tech
nights" when use of the tent may go until midnight. The tent seats 100 people.
During the set-up, dismantling and operation of the theatre there is minimal

Response: Staff believes that this project is compatible with the
Rio Grande Park uses and particularly the Art Park theme. The tent
is actually a landmark for this area during the summer season.
2. Whether sufficient public facilities and roads exist to
service the proposed development.
Response: Public facilities and roads. are adequate in the vicinity
for service and handicap access. However, this area is
specifically not for patron use or general employee convenience
parking. As mentioned in the Parks referral, this parking should
be scrutinized so that it is not abused by non-essential service
use. P&Z has recommended a condition of approval that the area be
better signed to this effect.
3. Whether the parcel proposed for development is generally
suitable for development, considering the slope, ground
instability and the possibility of mud flow, rock falls,
avalanche dangers and flood hazards.
Response: No hazards exist for the tent and accessory uses.
4. Whether the proposed development creatively employs land
planning techniques to preserve significant view planes, avoid
adverse environmental impacts and provide open space, trails
and similar amenities for the users of the project and the

Theatre staff need to determine how to resolve the problem. Off-

Response: The Aspen Area Community Plan does not make specific
recommendations regarding this project. The Plan does emphasize
pedestrian access and preservation of trails, as well as

are subject to establishment or reduction by special review,
the applicant shall. demonstrate that the parking needs of the
residents, guests and employees of the project have been met,
taking into account potential uses of the parcel, its
proximity to mass transit routes and the downtown area, and
any special services, such as vans, provided for residents,
guests and employees.
Response: As discussed above, it appears that Theatre staff abuse
the limited parking at the tent reserved for handicap and
delivery/service parking. Unless materials are specifically being
delivered, or tradesmen are accessing the site with service trucks,
this area should not contain vehicles. Continued problems with
parking will require staff to notify the applicant to come back to
the Commission and Council for a show cause hearing on the
violation.
GMOS EXEMPTION FOR ESSENTIAL PUBLIC FACILITIES: Section 24-8-

We have reviewed their application and although it provided only a minimal amount of infonnation
regarding SPA criteria, we do have a few concerns that have occurred in the area over the past few
summers. The amount of trash, debris and what appears to be unnecessary props that are stored
on the north side of the tent between the berm and the tent is unacceptable. A privacy fence should
be installed on the north side of the tent (between the berm and storage area) and enclosed on the
east and west sides of the fence to eliminate the unsightly debris that exists in this area. Any
materials, props, etc. need to be stored in this area in an orderly and timely manner. This area
should be cleaned up and better organized on a continual basis and stated as a condition of
approval.
Additionally, their original approvals allowed handicap parking, service vehicle access and spring
and fall set and tear down support access. However, there has been some abuse of this area by
some of the theater people with what appears to be extended parking during the day or non-service
delivery trips to the tent. This should be monitored by the theater directors to ensure this privilege
is not abused. The three parking spaces and dumpster needs to be located near the snow melter
area to eliminate unnecessary traffic across trail and park area.
The map enclosed is actually outdated due to the improvements in this area and could be confusing.
For example: .
1) The new swale for drainage to the river has been completed.
2) The new portable toilet housing, electrical panel housing and storage area have been
installed and is not shown as it exists now. Are they proposing to improve these
facilities? If so, we need more detailed plans.
3) A new street lamp is shown on the map. Are they proposing to pay for it? Who
will be responsible for the cost of removal of the existing power pole and under-
grounding of electrical lines?
Any improvements or changes that will affect the park needs to be coordinated with the Parks
Department.
No maintenance issues of this area have been addressed, Le., irrigation, turf, etc.
The trail location around the existing berm is not correct. Are they proposing changing this? If so,
we need more details,

Dear Kim,
Enclosed please find a check in the amount of $2040 for your
work on our Final Permit to erect the theatre tent each year.
I am hoping the City will see fit to wave this fee as we are a non
profit organization with a relatively small budget and this is a
great deal of money to us. I feel that the community benefits
from the activities and cultural events that go on within the tent
and its surroundings which repays, hopefully, our debt to the City
and the Planning Dept.

RE: ASPEN THEATRE IN THE PARK FINAL SPA
NOTICE IS HEREBY GIVEN that a public hearing will be held on
Tuesday, May 2, 1995 at a meeting to begin at 4:30 p.m. before the
Aspen Planning and Zoning Commission, 2nd Floor Meeting Room, City
Hall, 130 S. Galena st., Aspen, to consider an application
submitted by Aspen Theatre in the Park, requesting Final SPA
approval to erect a theatre tent annually from May 15 to September
20. The property is located at the Art Park on the Rio Grande
Parcel. For further information, contact Kim Johnson at the
