Amendments to Little Nell SPA Precise Plan
Dear Alan:
We are writing to request certain amendments to the Little Nell
SPA Precise Plan which include a proposed revision to our Dean Street
ticket kiosk. We feel this should be reviewed in conjunction with the
renewal of our Aspen Mountain Vendor's License.
Over the past several months, we have made great headway in
proceeding with more detailed design phases for the completion of the
Hunter and Dean Street plazas, which are public spaces and of interest
to the City of Aspen. After our first operating year with the new
Little Nell Gondola and use of Hunter Street, we have carefully
examined their use and would like to make some refinements. One area
we would like to change is the size and location of the Hunter Street
ticket kiosk and its obstruction to pedestrian flows on Hunter Street.
We are also aware that the Dean Street ticket kiosk has been objected
to by a nearby condominium owner, and we have independently taken steps
to try to achieve a design that will mitigate reasonable impacts.
By this letter, we are asking to accomplish two things. First, we
would like to have an agenda time set for the City Council to review
our Dean Street kiosk plans, and to renew our Vendor's License
Agreement. We believe that a July 27th meeting would work for you and
the Aspen Skiing Company. As you know, time is of the essence on this
action since we need lead time to make building design and site
modification improvements before the start of the ski season. Please
find attached a copy of a plan that reflects the new design for the
Dean Street kiosk, as well as the Hunter Street ticket kiosk. At that
same meeting, we would like to discuss the Vendor's Agreement and show
how our new Dean Street ticket kiosk functions more efficiently, and
also preserves adjacent property owners' views.

With regard to the Hunter Street kiosk, it is within your
authority to adminstratively review and approve minor amendments to the
SPA Precise Plan. This authority is contained in Section 24-7.9 and
Section 24-8-2.6 of the Municipal Code of the City of Aspen, and we
feel that there is adequate authority for you to undertake approval of
these changes at the administrative level. The principal change
requiring review is a proposed reduced ticket kiosk which, as can be
seen on the plan, is proposed for location at the intersection of
Hunter and Dean Streets. This building would be located wholly on
Aspen Skiing Company land and would occupy far less footprint than the
kiosk originally approved in the SPA. The new ticket kiosk occupies
about a 120 sq. ft. footprint as opposed to 206 sq. ft. proposed in the
original plan. This is about a 40% reduction in floor area. This new
kiosk design will accomplish numerous beneficial features. First, by
being located further to the south on Hunter Street, people queued in
line for tickets will not obstruct pedestrian flow to the mountain and
will not create a visual barrier along Durant Street. We feel that the
ability to angle these ticket selling spaces at 45 degrees and set it
to one corner of the site will preserve flow and the visual entrance to
Aspen Mountain, and we request that you approve this change on an
administrative level given the authority found in the Code.
With respect to the Dean Street ticket kiosk; again, the original
building footprint contained about 206 sq. ft. and our revised plan
would call for a building of approximately 125 sq. ft. Also, it should
be noted that because the existing kiosk is not located on a flat site,
it has been jacked to a level condition and is, therefore, a full foot
higher than our proposed new building. While our new building
represents a 40% reduction in the actual floor area, its reduction is
more significant in terms of the total volume reduction of the
building. Our philosophy on both of the ticket selling facilities is
to make them small and unobtrusive, maximize ease of skier and
pedestrian flows on the site, and minimize visual impact. We think
these design criteria are compatible with those of the City. We look
forward to an opportunity to present our revised plan for the Dean
Street kiosk before the City Council, and we seek your administrative
approval for the Hunter Street change.
Please inform us at your earliest convenience of your disposition
on these items and a schedule for City Council review.

Dear Bob:
Please consider this letter a request on behalf of the
Aspen Skiing Company to renew its vendor's license with the
City of Aspen for the sale of lift tickets and ski school
tickets for skiing on its mountains. Last year the City
Council and the Aspen Skiing Company entered into a vendor's
agreement which granted the Ski Company permission to vend
under the provisions of Section 13-61 of the Municipal Code
of the City of Aspen. The agreement was subject to an annual
review by the City Council. Therefore, we request that this
matter be brought before the City Council for renewal.
Enclosed please find $10.00 which is the annual fee for our

The North of Nell Condominium Owners Association has asked
us to request that you require a relocation of the Aspen
Skiing Company's Dean Street ticket kiosk. Enclosed is a
copy of the agreement between the Aspen Skiing Company
(ASC) and the City of Aspen which provides in paragraph III
that "Vendor may position 'kiosk' in such design and at
such locations as approved in writing by the city manager."
The present location of the ticket kiosk obstructs the view
from several of the resiential units in the North of Nell
condominium, particularly units 2B, 2C, 2D and 3C. I am
enclosing several pictures taken from the interior of
Unit 2-C showing the impact of the kiosk. These units are
on the Dean Street (south) side of the North of Nell
building, and one of the primary values of those
condominiums is the view of Aspen Mountain.
The Aspen Municipal Code, Section 13-61, provides (in the
second sentence) that there may be vending on public rights
of way if there is an agreement between the City and the
vendor, which agreement is approved by the City Council.
The five factors to be considered by the council in
approving such a vending agreement are (1) the public need
for such service, (2) the availability of existing
services, (3) the cost of policing and administering the
proposed vending service, (4) what revenues shall accrue to
the City for grant of permission to vend and (5) whether
the vendor applying for such contract will best serve the
public need. The ASC sells lift tickets at their
administrative offices, under the gondola, and at the

ticket kiosk on Hunter Street. We maintain that the second
criteria is not really met by this fact situation and that
there is no need for a ticket kiosk on public property.
Since there is no need for the service to be on public
property, i.e., the services existing on non-public
property are or can be expanded to be adequate to serve the
public need, the prohibition provided in the first sentence
of § 13-61 of the Municipal Code should be given due
consideration. Under the Municipal Code, the ASC should be
required to locate ticket sales facilities on ASC property.
There are several alternatives, most of which would be
beneficial to the skiing public and the North of Nell
Condominium owners without being a significant burden on
the ASC. Probably the best solution would be to eliminate
the Dean Street kiosk and open additional ticket windows at
the Hunter Street kiosk and at the ASC administrative
offices. The Hunter Street ticket kiosk is a four-sided
building with ticket sales windows on two sides of the
building. It could easily be doubled in capacity by
opening windows on the two remaining sides of the building.
A second alternative is to move the Dean Street kiosk down
the hill to the east in front of the ASC administrative
offices. This would block some of the view out of the ASC
administrative office windows, but it is more appropriate
for an ASC sales facility to block ASC office views than
for the facility to block the view of neighbors who do not
benefit from the ticket facility. A third alternative
solution would be to move the Dean Street kiosk to Hunter
Street; the pump house on Hunter Street is being removed,
and there is room on Hunter Street for another kiosk
without interfering with anybody's view. A fourth
alternative would be for the ASC to build a ticket booth at
the Dean Street level with the back of the booth against
the retaining wall for the stairs that are on the west side
of the gondola platform. This latter solution may require
the moving of a utility box.
The skiing public would be benefitted by eliminating or
moving the Dean Street kiosk. A significant majority of
skiers approach Aspen Mountain by the Hunter Street
entrance, and only a few skiers approach the mountain by
Dean Street. The Dean Street kiosk is not easily visible
from Hunter Street by someone who is standing to the north
of the Hunter Street kiosk. There are often long lines at
the Hunter Street kiosk (all ticket windows are on the
north side of the kiosk) when the lines at the Dean Street
kiosk are short or nonexistent. If additional ticket

windows were available in the Hunter Street kiosk area,
skiers approaching the mountain from Hunter Street would be
able to see and utilize the additional windows and the
waiting time for purchasing a ticket would be more evenly
disbursed. Further, eliminating the Dean Street kiosk or
moving it to the east or against the westerly stairs which
approach the gondola building would, in addition to
eliminating the interference with the views from several of
the North of Nell condominiums, give Dean Street a more
"open -space" or "mall" feeling, which would benefit all
skiers and users of Aspen Mountain.
The only skiers who may have to walk a little further by
moving or eliminating the Dean Street kiosk are the few
skiers who approach the mountain from Dean Street and use
the Little Nell chairlift. Those using the gondola have to
walk to and load from the east side of the gondola anyway,
so purchasing tickets at the administration office or an
expanded Hunter Street ticket booth would not lengthen
their walks.
Moving or eliminating the Dean Street kiosk would have a
minimal impact on the ASC. The kiosk is a temporary
building, and the ASC has plans to do significant
landscaping along Dean Street this spring and summer. It
would be a simple and inexpensive process for the ASC to
open additional ticket windows on the south side of the
Hunter Street kiosk or at the administrative offices. It
would also be relatively inexpensive to move the kiosk or
build a different structure near the westerly steps to the
gondola platform.
I note the agreement is to be reviewed annually. I would
appreciate knowing whether this will be an administrative
decision made by you or whether this matter will be brought
before the council for review. In either event, I would
appreciate being advised of the time and place and the
forum in which the annual review will be conducted so I can
present the request for the relocation.

Dear Mr. Anderson,
When the Aspen Skiing Company (ASC) sought approvals for
redevelopment of the Little Nell area, the ASC represented
to the owners of the North of Nell condominiums that Dean
Street would be lowered to the elevation of Durant Avenue
and that the roofs of all structures built on the Dean
Street side of our building would be no higher than the
balconies of our first residential level, i.e., the second
floor. On the basis of these representations, our
association supported ASC's redevelopment of the Little Nell
base area.
The views from several of the units in our building are
severely impacted by the present location of the ticket
kiosk on Dean Street. Since it is apparent that Dean Street
is not going to be lowered, we request that you exercise
your power under paragraph III of the April 28, 1986,
vendor's agreement and require that the kiosk be eliminated
or relocated so that the top of the kiosk does not extend
above the balcony level of the second floor of our building.

Dear Curt,
I have reviewed the revised drawing you submitted to me in
support of your request to amend the Little Nell SPA with respect
to the location of both ticket kiosks. As part of my review, I
have sought the advice of the City Engineer and City Manager. I
have also contacted the representative of the North of Nell
condominiums and advised him of my decision.
Pursuant to the authority granted to me as Planning Director by
Section 24-7.9 of the Municipal Code, as affirmed by City Council
on July 27, I hereby approve the proposed relocation of the
ticket kiosks in Dean Street and Hunter Street. This approval is
subject to ASC meeting the following conditions:
1. You must amend the interim SPA plan to show the new
locations of the kiosks, and record the amended plan, following
its signature by the City Engineer and Planning Director.
Further, following construction of the hotel and mall, if
additional changes to your approved plan are made, you will be
required to record an amended final SPA plan, reflecting cond-
itions "as built".
2. As requested by the.City Engineer in his attached memo,
you shall be required to relocate the fire signal and standpipe
in Dean Street to his satisfaction. You shall also be required
to place an empty conduit under the Hunter Street kiosk to
accommodate placement of low power utilities in the event of a
failure under the structure.
3. Until such time as the mall is built and the sidewalk
along Durant Avenue is extended, I am concerned that lines from
the ticket windows may conflict with pedestrian conflict. You
indicated to me that you would have "ticket -hawkers" out in the
mall any time this conflict appeared. I expect you to stand by
this commitment, and if it does not turn out to be sufficient, to
work cooperatively with the City to resolve any circulation
conflicts you cause.
4. You will complete relocation of the pumphouse and the
transformers which are in the vicinity of the new Hunter Street
kiosk site, and will entirely remove from the base area the small
structure on which you are now displaying construction plans for
the site.
5. You will submit to me a letter from the North of Nell
condominium association indicating that they do not object to the
proposed location of the Hunter Street kiosk and that they have
permitted you to enter the structure across their property.
I expect you to demonstrate to me that the above conditions have
been met before any building permits are issued for the relo-
cations.
It is my belief that at this point we have resolved this matter
to everyone's satisfaction. Please let me know if I can other-
wise be of assistance to you.

Per your request, I have reviewed the current plan for the Aspen
Skiing Company's replacement of ticket kiosks on their property
adjacent to Dean Street and on the vacated Hunter Street
extension. Having made a site inspection, I would support
approval of the current locations subject to the following:
1. Adequate relocation of the fire signal and standpipe adjacent
to the Dean Street location.
2. Placement of empty conduit under the Hunter Kiosk to
accommodate replacement of low power utilities in the event of a
failure under the structure.
3. Recordation of the approved locations on an interim plan.

MEMORANDUM

RE: Aspen Skiing Company Vendors License Renewal
DATE: July 24, 1987
SUMMARY: The Planning Office recommends that you grant a one
year renewal of the vendor's license for the Aspen Skiing Company
to sell tickets at a relocated Dean Street kiosk. We also
recommend that you authorize the Planning Director to grant a
minor amendment to the approved Little Nell SPA to permit
relocation of the Dean Street ticket kiosk.
PREVIOUS COUNCIL ACTION: On April 28, 1986, as, part of your
action approving the Little Nell SPA, you granted a vendor's
license to ASC to sell tickets from its kiosk located in Dean
Street, a City right-of-way. Conditions of the license were that
it be subject to annual review by City Council and be located and
designed in a manner consistent with the approved plan (see
attached copy of approved license).
BACKGROUND: ASC submitted a request to renew its vedor's license
in April. The reason that this item was not brought to Council
earlier is that numerous letters, in the form of the one that is
attached, were submitted to the City by owners of North of Nell
condominiums objecting to the size and location of the existing
kiosk. The City Manager and Planning Director have therefore
sought to resolve this issue between the affected parties before
bringing the license renewal in front of Council.
ASC has had several meetings with the representatives of the
condominium owners and has identified a new location and design
for the ticket kiosk. The applicant's current request for the
vendor's license renewal, including the new location for the
kiosk, is summarized in the attached letter from Curt Stewart.
PROBLEM DISCUSSION:
1. Dean Street Kiosk As can be best demonstrated to you by
photographs we will present at the meeting, which were taken from
the interior of several of the North of Nell units, the existing
kiosk is in a highly obtrusive location and dominates the view
for several owners. Looking back at the approved SPA Plan, it is
clear that the kiosk was placed in its approved location.
However, we set no specific limits on the size of the approved

The Planning Office has received a drawing prepared by the
applicant showing a new location and configuration for the kiosk.
The new kiosk is to be moved back out of the middle of the street
and will be nestled into a location next to the stairs, about 10
feet southwest of its current placement. As noted in the
applicant's letter, the new kiosk will be approximately 125
square feet, where the existing building is about 206 square
feet, and will be reduced in height from its present size of
about eleven feet to a proposed height of nine feet.
A model of the new kiosk in relation to the North of Nell
building and the base area was presented to me. Based upon my
review of this model, I am satisfied that the kiosk has been
effectively removed from the view of the condominiums. Whereas
previously the building blocked the view up the mountain, it now
hides the wall on the north side of the stairs and has been moved
more into the background than the foreground of the view.
Looking at the new location, I feel that it will enhance pedes-
trian movements in the base area by opening up Dean Street both
visually and physically. I have spoken to the representative of
the North of Nell owners, who would like to have the building
moved back even further, to sit against the stairs. However,
based upon the staff's review, there is one technical problem
affecting this alternative. There are several transformers and
other underground utility connections in this area, several of
which were made by the applicant last year to meet conditions of
the project, which would be affected by locating the kiosk next
to the stairs. I had Jay Hammond review the drawing and he
comments that if the kiosk were located against the stairs, it
could make maintenance of the sewer, fire and drainage lines
beneath the structure very difficult, particularly during winter.
There is, however, one factor of public import which may outweigh
this technical question. If the kiosk were moved against the
stairs it would be entirely on the applicant's property and out
of the right-of-way altogether. In a recent visit to the site, I
determined that there is room for the kiosk in this location and
that it would certainly remain visible to skiers if placed there.
While some screening of the transformers in the area would be
required, this does not seem to be an insurmountable task.
The Planning Office supports the applicant's proposed location
and design of the kiosk and recommends its approval by your
renewal of the ASC vendor's license. However, if you believe
that the benefit of placing the structure on private property
outweighs the likely maintenance problems from the location
against the stairs, we would support its relocation to that
suggested by the North of Nell condominium owners. In either
case, according to Section 24-7.9 of the Code, the Planning

Director is authorized to approve minor changes to an adopted
precise plan, if required by technical design needs not antic-
ipated at the time of project review. The Planning Director is
limited in discretion, in only being able to approve changes in
the location, sizing, height and siting of strucures, provided
that a series of review critieria are met. These criteria have
to do with coverage of structures, use or character of the
development, traffic circulation, open space, parking, FAR and
density.
Since the new strucure is to be smaller, have a lesser floor
area, height and site coverage, and appears to improve circul-
ation, I believe I have the authority to grant its approval.
However, due to the delicate nature of this site, and the many
issues which arose both during the initial review of the SPA, and
now during the vendor's license renewal, I seek your authoriz-
ation to take this action before I grant a minor amendment.
2. Hunter Street Kiosk After the ski season I was approached by
ASC to evaluate the possibility of moving the Hunter Street
ticket kiosk. While this kiosk is fully on private property and
therefore not subject to a vendor's license, it is part of the
SPA. Once again, I believe the Code authorizes me to permit a
relocation of the strucure. However, I again seek your authoriz-
ation for this action, given the critical public issues assoc-
iated with this area.
The applicant is requesting to move the kiosk out of the main
pedestrian traffic flow in Hunter Street into a new location near
the eastern property line of the North of Nell. The applicant's
stated reason for this change is to open up the views toward the
entrance to the mountain and to permit better pedestrian flows
and queuing for tickets. The new kiosk will occupy a footprint
of approximately 120 square feet, compared to the existing 206
square foot building, and will rise to a height of nine feet, as
compared to the existing structure's height of eleven feet. It
should also be pointed out to Council that ASC has initiated
removal of the pumphouse from the Hunter Street entrance to the
mountain, which will also tend to open up this area. We would
also like to see the applicant remove or find a better location
for the small structure showing the construction plans for the
site, which has had the effect of further blocking views and
pedestrian movement.
Our initial reaction to this proposal is support for the concept
of opening up mountain views and improving pedestrian flows. One
of the main reasons for having an annual review of the Dean
Street kiosk was to evaluate how well it functioned, given the
fact that it sits on a public right-of-way. We commend the
applicant for recognizing that the Hunter Street kiosk is also
not functioning as was hoped, and should be redesigned.

The main concern with the new location is that it will obstruct
the visibility of the store currently occupied by Breeze Ski
Rentals. We asked the applicant about moving the location to the
eastern side of the property and combining it with other ASC
commercial spaces. The response was that this location would
allow those on line to be in sun, rather than in shade, and that
forcing skiers with boots, poles and skis to enter a building to
purchase tickets also would not work. We would note, however,
that designing ticket windows into the commercial structure built
by ASC which would sit at the building's edge is a very workable
concept used at many ski area bases and should be investigated by
the applicant.
On Friday, July 24, I visited the site with the manager of Breeze
Ski Rentals, the manager of the North of Nell condominiums and
other condominium representatives. They pointed out to me that
the proposed location of the kiosk directly interferes with the
location of a door which Breeze is about to receive a permit to
construct. They further stated that the had informed ASC of this
intention several months back and that my contact with them was
their first indication that ASC was moving its kiosk into this
location.
We spent some time on the site imagining how skier flows would be
affected by the proposed relocation and came to the conclusion
that wrapping the kiosk around the intersection of Hunter and
Dean Streets might cause as many problems as it would solve. We
were able to identify several alternative locations for the kiosk
which would not totally obliterate the visibility of Breeze, but
which would enhance ski area pedestrian movement. I have not yet
had a chance to review these alternatives with ASC, but may have
done so by the time of your meeting. In any case, based on my
meeting with these citizens, I am unable to support the new
location for the kiosk at this time.

SUMMARY: The Planning Office recommends that you grant a one
year renewal of the vendor's license for the Aspen Skiing Company
to sell tickets at a relocated Dean Street kiosk. We also
recommend that you authorize the Planning Director to grant a
minor amendment to the approved Little Nell SPA to permit
relocation of both the Dean and Hunter Street ticket kiosks.
PREVIOUS COUNCIL ACTION: On April 28, 1986, as, part of your
action approving the Little Nell SPA, you granted a vendor's
license to ASC to sell tickets from its kiosk located in Dean
Street, a City right-of-way. Conditions of the license were that
it be subject to annual review by City Council and be located and
designed in a manner consistent with the approved plan (see
attached copy of approved license).
BACKGROUND: ASC submitted a request to renew its vedor's license
in April. The reason that this item was not brought to Council
earlier is that numerous letters, in the form of the one that is
attached, were submitted to the City by owners of North of Nell
condominiums objecting to the size and location of the existing
kiosk. The City Manager and Planning Director have therefore
sought to resolve this issue between the affected parties before
bringing the license renewal in front of Council.
ASC has had several meetings with the representatives of the
condominium owners and has identified a new location and design
for the ticket kiosk. The applicant's current request for the
vendor's license renewal, including the new location for the
kiosk, is summarized in the attached letter from Curt Stewart.
PROBLEM DISCUSSION:
1. Dean Street Kiosk As can be best demonstrated to you by
photographs we will present at the meeting, which were taken from
the interior of several of the North of Nell units, the existing
kiosk is in a highly obtrusive location and dominates the view
for several owners. Looking back at the approved SPA Plan, it is
clear that the kiosk was placed in its approved location.
However, we set no specific limits on the size of the approved
kiosk, relying on an illustrative landscape plan to address its
dimensions.

area circulation and visibility. ASC also wants to add restrooms
at the base area prior to the next ski season. Since both of
these activities can also be reviewed and approved by the
Planning Director, I recommend they be presented to you with the
Dean Street relocation, so we can approve a single base area
circulation amendment.

Holy Cross Electric Association has just recently revised
their Equipment Screening Specifications, a copy of which is
attached. The revised specifications are more restrictive
than the previous guidelines. All the minimum clearances
between equipment and screens have been increased and the
maximum distance from a vehicular accessway is now 10'
instead of 15'. Restrictions have been placed on the height
of walls and the minimum overhead clearance. Several
illustrations are included with the specifications.

EQUIPMENT SCREENING SPECIFICATIONS
All proposed designs or proposed alterations to existing screens shall comply with
the following specifications. Proposals (plans and specifications) shall he sub-
mitted to the HCEA Engineering Department for written approval prior to con-
struction. Compliance and approval shall be the sole determination of the HCEA
Engineering Department. Noncompliance with these specifications or railure to
gain written approval, shall result in the denial of a permanent meter connection
or the dismantling of nonconforming screens.
Attached are examples of suggested equipment screens.
General Specifications:
1) HCEA shall not be liable for any damage to screens.
2) Screen construction and maintenance shall be the responsibility of parties
other than HCEA.
3) The area inside the screen shall be kept clean. There shall be no material
of any kind stored inside the screen.
4) HCEA equipment will be installed in accordance with HCEA installation
specifications.
Design.Specifications:
1) All equipment shall be readily accessible by HCEA personnel.
2) All construction shall he permanent in nature, and shall not interfere with
operation and maintenance of HCCA facilities.
3), There shall be a maximum of 10 feet horizontal distance from enuiprnent to"
-'nearest vehicle accessway to por7nit removal or replacement of equilwrent.
4) There shall be a minimum of 10 feet level, unobstructed, horizontal distance
in front of equipment doors for maintenance and operations activities.
5) Water, snow and ice buildup shall be prevented. Proper drainage shall he
provided. The area inside the enclosure shall be gravel or concrete. Snow
removal by parties other than HCEA may be required. Equipment will not he
located under roof lines where water, snow or ice buildup and drdindge mrdy
occur.
6) Equipment shall not be covered in any manner for 15 feet directly above the
requipment. if in the opinion of Holy Cross, the size and/or weight of e(iuip-
ment to be installed may present handling problems, additional access and
clearance may be required.
7) There shall be no doors or moving parts associated with the screen.*
8) Walls shall be a maximum of 6 feet in height.
9) There shall be no walls within 10 feet of equipment sides having doors.
10) Equipment doors shall be able to open fully.
11) Proper equipment ventilation (minimum 4 feet from equipment pad) shall be
maintained. This may require snow removal by parties other than HCEA.
12)_ Shrubs and trees (in all stages of growth), ornamental decoration, land-
scaping or any other camouflage shall conform to all specifications.
13) Contact HCEA for equipment and pad dimensions.
*Doors are discouraged. However, in some cases, such as locations near schools,
doors may be approved for equipment screening. Door supports shall be cun-
crete block or concrete. Duors shall be of sturdy construction and open onto
an area that is kept free of snow and ice; such as parking lots, driveways,
etc. Doors shall have removable hinges and he locked with an HCEA lock. if
problems develop with door operation, the doors will be dismantled.

Skiing Company ticket kiosk in Dean Street. Following are my
comments in this regard.
As part of approving the SPA Plan for the Little Nell Base Area
Redevelopment, the ASC asked the City if it could set up ticket
kiosks in Dean and Hunter Streets. The Hunter Street location is
on private property owned by ASC and was subject only to SPA
approval. The Dean Street location is within the City right-of-
way and therefore, the City Attorney recommended that the kiosk
be subject to a vendor's agreement.
I attach for your review a copy of the signed agreement. As was
recommended by staff, the agreement is subject to annual review
and expires on April 28, 1986. I understand, from a conversation
with Gideon Kaufman, representing ASC, that a renewal request was
submitted to your office today.
Paragraph III of the agreement requires you to find that the
design and locations of the kiosk must conform to the applicant's
Precise SPA Plan. I have reviewed the Precise Plan documents for
you, and I find that the kiosk was placed in its proper location.
I cannot find any representation in the SPA agreement regarding
the height of the kiosk. If the representation referred to in
the letters was made at a public hearing, we should ask the
owners to provide us with the date. If not, I would suspect that
the representation was made at a meeting between ASC and the
North of Nell, and that it would be difficult for us to enforce.
Please also be aware that I have had conversations with ASC
regarding potential relocation of the kiosk in Hunter Street.
The applicant is asking me to sign off on this minor change under
my authority in Section 24-7.9 of the Code. Given the cont-
roversy surrounding the Dean Street kiosk, my tendency is to get
Council approval of the Hunter Street relocation at the same time
as you bring the Dean Street vendor's agreement to Council. Are
you planning on this occuring at the May 11 meeting?

Re: Dean Street Ticket kiosk
Dear Mr. Anderson,
When the Aspen Skiing Company (ASC) sought approvals for
redevelopment of the Little Nell area, the ASC represented
to the owners of the North of Nell condominiums that Dean
Street would be lowered to the elevation of Durant Avenue
and that the roofs of all structures built on the Dean
Street side of our building would be no higher than the
balconies of our first residential level, i.e., the second
floor. On the basis of these representations, our
association supported ASC's redevelopment of the Little Nell
base area.
The views from several of the units in our building are
severely impacted by the present location of the ticket
kiosk on Dean Street. Since it is apparent that Dean Street
is not going to be lowered, we request that you exercise
your power under paragraph III of the April 28, 1986,
vendor's agreement and require that the kiosk be eliminated
or relocated so that the top of the kiosk does not extend
above the bal ony evel of the second floor of our building.

Dear Ms. Koch:
The Aspen Ski Company's approval for Phase I of the Little Nell Develop-
ment included a "Vendor's Agreement".
This agreement allowed the Aspen Ski Company to place a kiosk on Dean
Street for the sale of lift tickets.
The Vendor's Agreement was granted for one year, the anniversary date
being April 28th, 1937. A renewal of this agreement will be reviewed
by the City Council.
I would appreciate your informing me wt;en the City Cou:icil review will
be heard.
