A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
AUTHORIZING THE EXECUTION OF AN AMENDMENT TO AN
INTERGOVERNMENTAL AGREEMENT REGARDING THE FUNDING AND
CONSTRCUTION OF THE ROUNDABOUT ON STATE HIGHWAY 82, AND
AUTHORIZING THE MAYOR OR CITY MANAGER TO EEXCUTE SAID AGREEMENT
ON BEHALF OF THE CITY OF ASPEN
WHEREAS, there has been submitted m the City Council An Amendment m
Intergovernmental Agreement for the Roundabout Funding contract between the City of Aspen.
Colorado, and the Board of County Commissioners of Pitkin County, a copy of which is
annexed hereto and part thereof.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADO.
That the City Council of the City of Aspen hereby approves that the Amendment to
Intergovernmental Agreement Roundabout Funding between the City of Aspen, Colorado, and
the Board of County Commissioners of Pitkin County for the funding of the roundabout at the
Entrance to Aspen on State highway 82, a copy of which is annexed hereto and incorporated
herein, and does hereby authorize the City Manager and Mayor m execute said agreemem on
behalf of the City of Aspen.

AMENDMENT TO
ZNTERGOVERNMENTAL AGREEMENT
ROUNDABOUT FUNDING
THIS AMENDMENT ;,TO THE,, INTERGOVERNMENTAL AGREE~M~NT-
ROUNDAB(~U. T FUNDING (the ' Agreement ), dated May 27, 1999, is made this
day of ~ , 2000 by and between the Board of County
Commissioners of Pitkin County, Colorado, whose address is 530 East Main Street, Aspen,
Colorado ("the County") and the City of Aspen, Colorado ("Aspen"), whose address is 130
South Galena Street, Aspen, Colorado. The County and Aspen are sometimes collectively
referred to as the "Governments".
RECITALS
1. The Governments entered into a Roundabout Construction Agreement on May 27,
1999, which established responsibilities and obligations concerning the funding of and payment
for improvements for the Roundabout.
2. The contracts approved by the County for the Roundabout construction, per
Resolution 99-91A, are being amended through change order to provide for the construction of
pedestrian bridges over Maroon Creek Road and Castle Creek Road, to connect existing City and
County trails, the total cost of which is estimated not to exceed $1,146,090.00. As the designed
details, unit quantities and unit prices are not fully identified at this time, and the County and
Aspen desire to proceed with this work to provide completion of the project by
Mov', i ~ '2~o~::> , this estimated amount will be used as a not to exceed amount for the work.
Work may be modified or deleted to maintain the not to exceed an~ount for the work. If both the
County and Aspen desire work which exceeds the not to exceed amount, a supplement to this
amendment will be made to increase the not to exceed an~ount, which will be approved by the
County and Aspen prior to authorizing the contractor to proceed with the additional work.
3. The County has agreed to fimd $250,000.00 through its Open Space and Trails
Program of the cost of the pedestrian bridges and $188,890.00 through its General Fund. The
City will pay the balance of the cost of $707.210.00
4. The Governments wish to amend their Agreement to provide for these additional
COSTS.
5. The Governments are authorized to enter this Amendment, and have determined
that it is in the best interests of the citizens of the Governments to enter into this Amendment.
AGREEMENT
NOW, THEREFORE, for and in consideration of the mutual promises and agreements of
the parries and other good and valuable consideration, the adequacy and sufficiency of which is
hereby acknowledged, the parties agree as follows:
1. The Agreement is amended to add a new paragraphs as follows:
la. The City will transfer the additional sum of $707,210.00 to the County for the
additional Roundabout improvements/pedestrian bridges, which the County shall
budget for such improvements. The County has budgeted its $250,000.00 from
Open Space and Trails and $188,890.00 from its General Fund for this purpose.
lb. The cost of the pedestrian bridges is not subject to reimbursement from CDOT.
lc. The City shall be responsible for ma'mtenance of the bridges.
2. The Roundabout Funding Intergovernmental Agreement, as amended herein, remains in
full force and effect.
