HomeMy WebLinkAboutcoa.lu.ex.Interwest Lot 15,Blk1.Snowbunny-Subd.1977INTERWEST Lot 15, Block 1, Snowbunny X "I A • Recorded 10:00 AM Auaust 9 1978 Reception #, Loretta Banner Recorder 2063"- 3 STATEMENT OF EXEMPTION FROM THE ^ 352 mar 594-9 DEFINITION OF SUBDIVISION WHEREAS, the provisions of Section 20-19(b) of the Aspen Municipal Code provide that, following receipt of a recommendation from the Planning Commission, the City Council may exempt a parti- cular division of land from the definition of a subdivision set forth in Section 20-3(s) of the Code, when, in the judgment of the City Council, such division of land is not within the intent and purpose of subdivision regulation, and WHEREAS, pursuant to said Section 20-19(b), INTERWEST ASSO- CIATES, a Colorado Partnership, has requested such an exemption for the condominiumization of the existing improvements on Lot 15, Block 1, Snowbunny Subdivision City of Aspen, Pitkin County, Colorado, and WHEREAS, the Aspen Planning and Zoning Commission, at its meeting held recommended approval of s request, and WHEREAS, the City Council has determined that the proposed condominiumization is not within the intents and purposes of sub- division regulation, THEREFORE, the Aspen City Council, pursuant to the authority granted in Section 20-19(b) of the Aspen Municipal Code, does hereby determine and declare that the condominiumization of Lot 15 of the Snowbunny Subdivision, Pitkin County, Colorado, is without the intents and purposes of Chapter 20 of the Aspen Municipal Code and does hereby waive the enforcement of the City subdivision regulations with respect thereto. Notary Pu is My Commission expires: 1� Zfc,r `S • QE ' J,SEAL ) C"� stv FPITR WOUNTY 0 0 • APPLICATION FOR EXEMPTION Pursuant to Section 20-19 of Chapter 20 of the Municipal Code of the City of Aspen, INTERWEST ASSOCIATES, a Colorado Partnership, hereby applies for an exemption from the definition of the term "Subdivision" with respect to the real property des- cribed as: Lot 15, Block #1, Snowbunny Subdivision City of Aspen, Pitkin County, Colorado The applicants submit that the exemption in this case would be appropriate. The application involves the subdivision of a proposed passive solar duplex to be built this coming spring. The owners of the property will have a common interest in the land and there will be a condominium declaration and a use maintenance agreement applicable to the property and does not in any way increase the land use impact of that property since a duplex is permitted on an existing R-15 lot. The applicants submit that such an exemption in the instant case would not conflict with the intent and purpose of the subdivision regulations which are directed to assist, among other things, orderly, efficient and integrated development of the City of Aspen; to insure the proper distribution of population; to coordinate the need for public services; and to encourage well - planned subdivision. They are directed to considerations of sub- division design and improvements and to restrict such building where it is inappropriate after considering its land use impact. The density would not effect the prevailing contemplated or desired population density on this property. Also, duplexes and duplex subdivision exemptions are not affected by the administrative review required prior to the adoption of the city's growth manage- ment plan. DESCRIPTION: (NAME, NUMBER, ETC.): CASHIER VALIDATION RECEIVED FROM MEMORANDUM TO: Aspen City Council FROM: Planning Staff (HC) RE: Interwest Associates - Subdivision Exemption for Proposed Duplex DATE: March 9, 1977 This is a request by Interwest Associates for subdivision exemption to condominiumize a proposed duplex on Lot 15, Block 1, Snowbunny Sub- division. The granting of the exemption prior to construction will enable the developers to obtain separate construction financing for the project. The Engineering Department recommends approval without conditions due to the location of the project in an established approved subdivision. The Planning and Zoning Commission recommends approval of the exemption subject to payment of the park dedication fee. The Planning Office recommends approval subject to payment of the Dedi- cation Fee at the time of building permit application. We can find no valid reason to object to approval of the exemption prior to construc- tion since this an established and approved subdivision.
