RECORDED AT 4:22 P.t~. 23 APRIL, 1980 LORETTA BANNER RECORDER BOOK 388 i',~(t 82 ~tciWI~1 STATEMENT OF EXEMPTION FROM THE DEFINITION OF SUBDIVISION WHEREAS, J-H-J CORPORATION ("applicant") is the owner of a parcel of land located in Pitkin County, Colorado, more particularly described as: Lots P, Q, Rand S, Block 78 City and Townsite of Aspen County of Pitkin, State of Colorado WHEREAS, the applicant has constructed an office building on said property, and WHEREAS, applicant has requested an exemption from the definition of subdivision for the purpose of subdividing the existing building through condominiumization, and WHEREAS, The Aspen Planning and Zoning Commission, at its meeting on March 4, 1980, determined that an exemption from the definition of subdivision is appropriate and recommended that the same be granted, and WHEREAS, the Aspen City Council determined that the subdivision of the existing building through condominiumization is not within the intent and purpose of the subdivision ordinances set forth in Chapter 20 of the Aspen Municipal Code, THEREFORE, the City Council of Aspen, Colorado, does hereby determine that the proposed subdivision of the building located on said property by its condominiumization is not within the intent and purpose of the subdivision ordinance and does, for such reason grant an exemption from the definition of such action. Bleeker(Lots P,Q,R and S, Block 78, Aspen Townsite) Lot Size: Approximately 12,062 Square Feet Rental History: Not applicable Engineering Comments: Recommends approval with no conditions Attorney's Comments: No comment Housing Director's Comments: Not Planning Office Recommendation: applicable Recommend approval subject to applicant's filing of a condominium plat P and Z Recommendation: Concurrs with Planning Office recommendation. \ 1\ ,~ ,\'" V~ ~ ~\ '1, ) 78 APPLICATION FOR EXEMPTION FROM SUBDIVISION REGULATIONS Request is hereby made on behalf of J-H-J Corporation (hereinafter referred to as "Applicant") under Section 20-19(a) of the Aspen, Co~orado, Subdivision Regulations, for an exemption from the definition of the term "subdivision" with respect to the following real property: -: 77 Lots P, Q, Rand S, Block 78, City and Townsite of Aspen County of Pitkin, State of Colorado It is submitted that the requested exemption is appropriate for the condominiumization of an office building which is constructed on the above-described property. If the requested exemption is granted, the owners of the property will have a common interest in the land and there will be a condominium declaration and maintenance agreement applicable to the property which will not in any way increase the land use impact of the property. An exemption in this case will not conflict with the intents and purposes of the subdivision regulations of the City of Aspen which are directed to assist the orderly, efficient and integrated development of the city to insure the proper distribution of population, to coordinate the need for public services, and to encourage well-planned subdivision. The above-described real property is zoned "0" for office use. The building constructed on the property is to be used for office purposes. It should be noted that the construction of an office building in the office zone district is exempt from the Growth Management Quota System of the City of Aspen (Section 24-10 of the Aspen Zoning Code), and thus the building permit for development of this property was issued without the necessity of competition under the Growth Management Quota System. Accordingly, the granting of this exemption application will not undermine the intent of the subdivision regulations of the City of Aspen as this application is clearly within the area intended for exemption. The applicant intends to file a condominium plat for the property which will include approximately twenty-two . office condominium units together with fifteen parking spaces which will be designated as limited common elements appurtenant to some of the condominium office units. The office building will be occupied, however, by substantially less than twenty-two tenants due to the fact that some tenants will occupy contiguous units. For example, one proposed tenant intends to occupy two contiguous units and another proposed tenant intends to occupy eight contiguous units. It is anticipated that most of the condominium office units will be sold to local business firms, but a few units may be leased prior to eventual sale. A copy of a recent survey of the above-described property is attached hereto together with a copy of the proposed condominium office layout for each of the two floors within the building. The final condominium office layout may differ slightly from the attached plat based upon the actual square footage of each condominium office unit as designed to meet the needs of the purchaser or lessee of such unit. To accomplish such modifications of individual unit size the demising walls of each such office condominium unit will be placed in the configuration desired by the purchaser or lessee.
