FROM THE DEFIN TION OF SUBDIVISION WHEREAS, Main Street Block 19 Associates is the owner of a parcel of land located in Pitk',in County, Colorado, more particularly described as: Lots D, E, and F, Block 19 City and Townsite of '',Aspen County of Pitkin, State of Colorado WHEREAS, the applicant has proposed to construct and has n n� constructed an office building located on said property; and 0 0 -« CL WHEREAS, applicant has requested an exemption from the � definition of subdivision for the purpose of subdividing the Z a building through condominiumization; and 0 WHEREAS, The Aspen Planning and Zoning Commission, at its ,- meeting held October 21, 1980, determined that an exemption from the definition of subdivision is appropriate and recommended that the same be granted; and O 0 WHEREAS, the City Council determined that the subdivision of10r, the building through condominiumization is not within the intent 7-, and purpose of the subdivision ordinances set forth in Chapter 20 r- of the Aspen Municipal Code, and approved the exemption subject 0 !Z. to the following conditions: 1. Owner/Applicant may condominiumize a maximum of twelve o office units subject to language which shall be included in the 3 condominium plat limiting the number of separate interests which n may be sold at any one time to a maximum of ten. 2. THEREFORE, the City Council of Aspen, Colorado, does hereby determine that the proposed subdivision of the building located on said property by its condominiumization is not within the intent and purpose of the subdivision ordinance and does, for such reason grant an exemption from the definition of such action.
