THIRD AMENDMENT TO PRECISE PLAN
AND SUBDIVISION AGREEMENT
FOR
SMUGGLER MOBILE HOME PARK

This Amendment, entered into this .E:L day of t>~'ll1o!l.VlU992, by
and between the city of Aspen, Colorado, a municipal corporation
(hereinafter referred to as "the city"), and Smuggler Mobile Home
Owners' Association, a Colorado not for profit corporation,
(hereinafter referred to "the Association").
WHEREAS, the Association has submitted to the city for
approval, execution and recordation a Second Amended Plat, a copy
of which is incorporated herein by this reference and hereinafter
referred to as the "Second Amended Plat" for a tract of land known
as the Smuggler Mobile Home Park Subdivision, (hereafter referred
to as "the Property"), and
WHEREAS, the Property is zoned as a specially planned area
pursuant to requirements of the Aspen Municipal Code, and
WHEREAS, the city has fully considered the proposed amendments
of the Plat of this Property;
WHEREAS, the Property is governed by a Precise Plan and
Subdivision Agreement ("Precise Plan") recorded in Book 424 at Page
780 of the records of Pitkin County, Colorado; and
WHEREAS, the Precise Plan has been previously amended by
amendments thereto recorded in Book 439 at Page 213 of the records
of Pitkin county ("First Amendment") and in Book 535 at Page 975
("Second Amendment"); and
WHEREAS, on July 9, 1990 the City of Aspen approved Ordinance
40 (Series of 1990) granting further amendment to the Precise Plan;
and
WHEREAS, the requirements of Chapter 24 of the Municipal Code
of the city of Aspen require a written amendment to any Precise
Plan and Subdivision Agreement; and
WHEREAS, the city and the Association furthermore wishes to
amend the Precise Plan to incorporate therein certain architectural
restrictions with respect to construction on the Property; and
WHEREAS, the city has agreed to the adoption of the
architectural restrictions pursuant to Ordinance 40 of 1990; and
WHEREAS on July 15, 1992 the city approved the adjustment of
a lot line between real property owned by the Association and Anne
Byard Peterson also known as Anne Byard; and agreed to extend the
deadlines for the filing of the plat required pursuant to Ordinance
40 of 1990 and the recording of this amendment to the Precise Plan;

WHEREAS, the city is willing to approve, execute and accept
for recordation, the Second Amended Plat upon the agreement of the
parties who on matters hereinafter described, subject to the
representations made in the application submitted in connection
therewith and conditions of all approval and all requirements terms
and conditions of the city of Aspen Subdivision SPA regulations now
in affect and such other rules and regulations as or may be
applicable; and
WHEREAS, the City of Aspen is willing to approve, execute and
accept this Third Amendment to the Precise Plan and Subdivision
Agreement for Smuggler Mobile Home Park in order to adopt certain
architectural controls, rules and regulations.
NOW, THEREFORE, in consideration of the premises, the mutual
covenants herein contained, and the approval, execution and
acceptance of the Second Amended Plat for recordation by the city
it is mutually agreed as follows:
1. Amendment To Paraqraph 1 (General Development Plan) of the
Second Amendment: There shall be added to Paragraph 1
(General Development Plan) of the Second Amendment the
following language:
"It is hereby recognized that mobile homes, modular homes, or
site built homes shall be permitted within Smuggler Mobile
Home Park pursuant to the dimension requirements set forth in
the Third Amendment to the Precise Plan and Subdivision
Agreement. Any and all additions to any mobile home or
structure in the Smuggler Mobile Home Park shall meet the city
of Aspen Building Regulations (Chapter 7 of the Aspen
Municipal Code). It is further recognized that the placement
of any structure or improvement on any lot wi thin the Smuggler
Mobile Home Park will be subject to the review and approval of
the Architectural Control Committee of the Smuggler Mobile
Home Owners' Association.
2. Buildinq and Architectural Restrictions. Anything in the
Precise Plan Subdivision and Improvement Agreement or any
amendment thereto, to the contrary notwithstanding, the
following architectural rules, regulations and restrictions
shall effect any and all construction and use in the Smuggler
Mobile Home Park Subdivision:
A. Basements. Any basement and floor system upon which one
relocates a mobile home or modular home must be capable of
supporting the relocated mobile or modular home.
B. Heiqht. The height of all residential and service
structures within Smuggler Mobile Home Park shall be limited
to fifteen (15) feet as measured from the mid-point of the
lots average slope.

C. Minimum Lot Size. The minimum lot size of any lot within
the Smuggler Mobile Home Park shall be twenty-four hundred
(2400) square feet.
D. Front Yard Set Back. The m~n~mum front yard set back
shall be zero (0) feet for every Lot in the Smuggler Mobile
Home Park and there shall be an average eight (8) foot limited
common element from the edge of the roadside curb to the front
property line of any Lot in Smuggler Mobile Home Park. This
common element is intended to be used for off street parking
by the owner of the adjacent lot.
E. Rear Yard Set Back. The rear yard set back shall be a
minimum of five (5) feet for any lot in the Smuggler Mobile
Home Park.
F. Side Yard Set Back. There shall be a minimum of ten (10)
feet on one side and a minimum of zero (0) feet on the other
side of any structure on any lot within the Smuggler Mobile
Home Park.
G. Maximum Floor Area. The maximum allowable floor area in
any dwelling unit within Smuggler Mobile Home Park shall be
two thousand (2,000) square feet. This two thousand (2000)
square foot limitation shall not include five hundred (500)
square feet which may be utilized for the construction of
either a garage or a shed. For the purposes of calculation of
floor area, each square foot of above grade space will equal
one square foot of floor area; each square foot of below grade
space will equal one-half (1/2) square foot of floor area for
the purposes of floor area calculation.
H. Parkinq. Parking requirements shall remain as defined and
set forth in the rules and regulations of the Architectural
Control Committee of the Smuggler Mobile Home Owners'
Association. Those regulations as of the date hereof are as
follows:
There shall be a minimum of two (2) off street parking spaces
for each lot on the area between the service of the road and
the lot line of any lot. For any structure or dwelling unit
over fifteen (1500) square feet in living area, as calculated
hereunder, three (3) parking spaces shall be required for any
structure or dwelling unit in excess of two thousand (2000)
square feet, four (4) parking spaces shall be required and any
mobile home in excess of twenty-five hundred (2500) square
feet, five (5) parking spaces shall be required. When garage
space is utilized for parking, that space shall not be
included in the calculation of living area for computed
required parking spaces.
I. Accessorv Buildinqs. No accessory buildings or ingress or
egress therefrom shall be built within any of the set backs as
set forth herein.

3. Affirmation of Other Terms. Except as modified hereby, the
terms of the Precise Plan and Subdivision Agreement and the
First and Second Amendment thereto are hereby confirmed by all
of the parties hereto in all respects.
4. Miscellaneous.
A. The provisions hereof shall be binding upon and inure to
the benefit of the Association, the city and their respective
successors and assigns.
B. This Agreement shall be subject to and construed in
accordance with the laws of the State of Colorado.
C. If any provisions of this Agreement or any paragraph,
sentence, clause, phrase, word or section, or application
thereof in any circumstances invalidated, such invalidity
shall not affect the validity of the remainder of this
Agreement. The application of any such provision, paragraph,
sentence, clause, phrase, word or section, any other
circumstances, shall not be affected thereby.
D. This Amendment to the Precise Plan and Subdivision
Agreement may be altered or amended form time to time only by
written instruments executed by all the parties hereto.
E. Notices to be given to the parties to this Agreement shall
be considered to be given when delivered or deposited in the
United States mail to the parties by registered or certified
mail, at the addresses indicated below or such other addresses
as may be substituted upon written notice of the parties or
their successors or assigns:

F. The terms, prov~s~ons, conditions and obligations
contained herein shall be deemed to be covenants and burden
the real property more particularly shown on the Second
Amended Plat, any and all owners thereof, their successors,
grantees or assigns, and further shall inure to the benefit of
and be specifically by or against the parties hereto, their
successors, grantors or assigns.
G. In the event the City determines that the Association is
not in substantial compliance with the terms of this
Amendment, the City may serve a Notice of Non-Compliance and

request that the deficiency be corrected within a period of
forty-five (45) days. In the event the Association believes
that it is in compliance or that the non-compliance is
insubstantial, the Association may request a hearing before
the City Council to determine whether the alleged non-
compliance exists or whether any amendment, variance or
extension of time to comply should be granted. On request,
the city shall conduct a hearing according to standard
procedures and take such action as it then deems appropriate.
The City shall be entitled to all remedies at equity and at
law to enjoin, correct and/or receive damages for any non-
compliance with this Agreement.
H. In the event that any of the provisions of this Agreement
or any paragraph, sentence, clause, phrase, word, or section
or the application thereof in any circumstances is
invalidated, such invalidity shall not affect the validity of
the remainder of this Agreement, and the application of any
such provision, paragraph, sentence, clause, phrase, word or
section in any other circumstance shall not be affected
thereby.
IN WITNESS WHEREOF, the parties have hereunto set their hands

AN ORDINANCE OF THE ASPEN CITY COUNCIL GRANTING A LOT LINE
ADJUSTMENT FOR THE SMUGGLER MOBILE HOME PARK SUBDIVISION AND 860
GIBSON AVENUE, ASPEN COLORADO
WHEREAS, pursuant to section 24-7-1003 of the Municipal Code,
Brooke Peterson, representing the Smuggler Mobile Home Park
Homeowner's Association, submitted an application requesting a Lot
Line Adjustment for the Mobile Home Park and 860 Gibson Avenue
owned by Ms. Anne Peterson to adjust the actual fence line that has
been in existence for at least twenty years; and
WHEREAS, a lot line adjustment is reviewed and approved by
the City council as a subdivision exemption; and
WHEREAS,
the
Homeowner's
Association
received
a
PUD/Subdivision amendment from city Council in July of 1990
confirming dimensional requirements for the Mobile Home Park; and
WHEREAS, the amended PUD/Subdivision plat was not recorded
within 180 days of approval as required by Section 24-7-906; and
WHEREAS, the Homeowner's Association request an extension from
city council for the recordation date to file the amended plat
representing the 1990 approvals and the adjusted lot line approval;
and
WHEREAS, the Planning Department has reviewed the application
and recommends approval of the lot line adjustment with conditions
and recommends the extension for filing the amended PUD/Subdivision
plat.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADO:

Smuggler Mobile Home Park and 860 Gibson Avenue with the following
condition that an amended plat shall be reviewed and approved by
the Engineering Department and shall be filed within 180 days of

represented on the survey submitted with the lot line adjustment
application.

deadline for filing the amended PUD/Subdivision plat for the
Smuggler Mobile Home Park pursuant to the amendments granted in
Ordinance 40, Series of 1990 with the following condition: that an
amended plat shall be reviewed and approved by the Engineering and
Planning Departments and filed within 180 days of final approval
of the development review for the lot line adjustment.

If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
provision and such holding shall not affect the validity of the
remaining portions thereof.

PREVIOUS COUNCIL ACTION: ".,!::ouncil approved first reading of
9rdinance 45 at the June 22, 199:2 meeting.
BACKGROUND: Smuggler Mobile Home Park received a PUD/Subdivision
amendment approval from City council in July of 1990. The PUD
amendment formalized the dimensional requirements of the Mobile
Home Park. The applicants were required to file an amended plat
within 180 days of final approval pursuant to section 24-7-906.
The plat and amended PUD/Subdivision agreement were never filed.
Because the lot line adjustment requires filing an amended plat,
the Homeowners request Council's consent to file the 1990 PUD
amendments concurrently with the lot line adjustment.
CURRENT ISSUES: The fence between the Mobile Home Park and Ms.
Byard I s property is situated approximately 12 feet off of the
property line. According to the application, the Mobile Home Park
fence has been in this location for at least 20 years and the
Mobile Home Park has had no effective use of this property. Please
see the property survey attachment "C". It is the Mobile Home Park
Homeowner's position that Ms. Peterson has acquired this property
by adverse possession. Therefore, it is proposed that the lot line
be adjusted to the existing and actual fence line.
Pursuant to section 7-1003, the following criteria for a lot line
adjustment are as follows:

1. It is demonstrated that the request is to correct an
engineering or survey error in a recorded plat or is to permit
an insubstantial boundary change between adjacent parcels.
RESPONSE: This is an insubstantial change in the boundary between
the Mobile Home Park and Ms. Peterson. While this will increase
the size of Ms. Peterson's parcel by approximately 2,664 square
feet it is the position of the Smuggler Homeowners that the
property has effectively become Ms. Peterson's property through
adverse possession and should be legally corrected.
2. Both landowners whose lot lines are being adjusted provide
written consent to the application.
RESPONSE: Both the Smuggler Homeowners and Ms. Peterson have
provided written consent to the lot line adjustment.
3. It is demonstrated that the request is to address specific
hardship.
RESPONSE: The adjustment is necessary to clear up the property
boundary that has been in effect for at least 20 years.
4. The corrected plat will meet the standards of this division,
and conform to the requirements of this chapter, including
the dimensional requirements of the Zone District in which
the lots are located, except in cases of an existing
nonconforming lot, in which the adjustment shall not increase
the non-conformity of the lot.
RESPONSE: According to the application, an amended plat will be
filed that accurately reflects the new property boundary between
the Mobile Home Park and Ms. Peterson. The amended plat will
comply with the requirements of the Land Use Code and will be
reviewed by the City of Aspen Engineering Department. Although Ms.
Peterson's single family residence is non-conforming with respect
to several dimensional requirements the lot line adjustment does
not increase the non-conformities.
5. It is demonstrated that the lot line adjustment will not
affect the development rights or permitted density of the
affected lots by providing the opportunity to create a new
lot for resale or development.
RESPONSE: The lot line adjustment will not impact development
rights or density of any of the properties involved.
RECOMMENDATION: Staff recommends approval of the lot line
adjustment between the Smuggler Mobile Home Park and Ms. Peterson's
parcel 860 Gibson Avenue, with the following condition:

AN ORDINANCE OF THE ASPEN CITY COUNCIL GRANTING A POD AMENDMENT
FOR THE SMUGGLER MOBILE HOME PARK PIJINNED UNIT DEVELOPMENT
WHEREAS, pursuant" to section 7-908 B. of the Municipal Code,
the Smuggler Homeowners Association as represented by Brooke
Peterson, submitted an application for an amendment to the
PUD; and
WHEREAS, there are several documents that address the
development of the Park, those are: Chapter 14 of the Municipal
Code, the Mobile Home Park Zone District in the Land Use Code,

the Declaration of Protective Covenants of the Mobile Home Park,
) Rule and Regulations of the Architectural Control Committee, and
the Precise Plan (used as the PUD Plan); and
WHEREAS, the applicants requested to amend the Final PUD
(Precise) Plan to formalize the dimensional requirements and
eliminate the necessity to file an insubstantial amendment every
time a change is made on a parcel in the Park; and
WHEREAS, a duly notice Public Hearing was held by the Aspen
Planning and Zoning commission (hereinafter "Commission") on May
22, 1990 to consider the amendment to the PUD; and
WHEREAS,
after review and consideration of the
representations made by the applicant and Planning staff, the
commission recommends approval to Council, with conditions, of

WHEREAS, the Board of Directors of Smuggler Mobile Home Park

for the 1991 UBC. (Appendix Chapter 12 section 1235,1237.)

The parking requirements shall remain the same as is
defined in Rules and Regulations of the Architectural Committee.

For any mobile home over 1,500

SUMMARY: The Smuggler Mobile Home Park Homeowners Association
seeks to adjust the southern boundary of the Mobile Home Park
Subdivision to convey approximately 2,664 square feet of land to
the adjacent property owner Anne Peterson, 860 Gibson Avenue.
The Homeowners Association also requests an extension from Council
for filing a PUD/Subdivision plat that was amended in 1990.
BACKGROUND: Smuggler Mobile Home Park received a PUD/Subdivision
amendment approval from city council in July of 1990. The PUD
amendment formalized the dimensional requirements of the Mobile
Home Park. The applicants were required to file an amended plat
within 180 days of final approval pursuant to section 24-7-906.
The plat and amended PUD/Subdivision agreement were never filed.
Because the lot line adjustment requires filing an amended plat,
the Homeowners request Council's consent to file the 1990 PUD
amendments concurrently with the lot line adjustment.
CURRENT ISSUES: The fence between the Mobile Home Park and Ms.
Byard's property is situated approximately 12 feet off of the
property line. According to the application, the Mobile Home Park
fence has been in this location for at least 20 years and the
Mobile Home Park has had no effective use of this property. Please
see the property survey attachment "C". It is the Mobile Home Park
Homeowner's position that Ms. Peterson has acquired this property
by adverse possession. Therefore, it is proposed that the lot line
be adjusted to the existing and actual fence line.
Pursuant to Section 7-1003, the following criteria for a lot line
adjustment are as follows:
1. It is demonstrated that the request is to correct an
engineering or survey error in a recorded plat or is to permit
an insubstantial boundary change between adjacent parcels.

RESPONSE: This is an insubstantial change in the boundary between
the Mobile Home Park and Ms. Peterson. While this will increase
the size of Ms. Peterson's parcel by approximately 2,664 square
feet it is the position of the Smuggler Homeowners that the
property has effectively become Ms. Peterson's property through
adverse possession and should be legally corrected.
2. Both landowners whose lot lines are being adjusted provide
written consent to the application.
RESPONSE: Both the Smuggler Homeowners and Ms. Peterson have
provided written consent to the lot line adjustment.
3. It is demonstrated that the request is to address specific
hardship.
RESPONSE: The adjustment is necessary to clear up the property
boundary that has been in effect for at least 20 years.
4. The corrected plat will meet the standards of this division,
and conform to the requirements of this chapter, including
the dimensional requirements of the Zone District in which
the lots are located, except in cases of an existing
nonconforming lot, in which the adjustment shall not increase
the non-conformity of the lot.
RESPONSE: According to the application, an amended plat will be
filed that accurately reflects the new property boundary between
the Mobile Home Park and Ms. Peterson. The amended plat will
comply with the requirements of the Land Use Code and will be
reviewed by the city of Aspen Engineering Department. Although Ms.
Peterson's single family residence is non-conforming with respect
to several dimensional requirements the lot line adjustment does
not increase the non-conformities.
5. It is demonstrated that the lot line adjustment will not
affect the development rights or permitted density of the
affected lots by providing the opportunity to create a new
lot for resale or development.
RESPONSE: The lot line adjustment will not impact development
rights or density of any of the properties involved.
RECOMMENDATION: Staff recommends approval of the lot line
adjustment between the Smuggler Mobile Home Park and Ms. Peterson's
parcel 860 Gibson Avenue, with the following condition:
1. An amended plat shall be reviewed and approved by the
Engineering Department and shall be filed within 180 days of final
approval and shall include the adjusted lot line as represented on
the survey submitted with the lot line adjustment application.

AN ORDINANCE OF THE ASPEN CITY COUNCIL GRANTING A PUD AMENDMENT
FOR THE SMUGGLER MOBILE HOME PARK PLANNED UNIT DEVELOPMENT
WHEREAS, pursuant to Section 7-908 B. of the Municipal Code,
the Smuggler Homeowners Association as represented by Brooke
Peterson, submitted an application for an amendment to the
PUD; and
WHEREAS, there are several documents that address the
development of the Park, those are: Chapter 14 of the Municipal
code, the Mobile Home Park Zone District in the Land Use Code,
the Declaration of Protective Covenants of the Mobile Home Park,
) Rule and Regulations of the Architectural Control Committee, and
the Precise Plan (used as the PUD Plan); and
WHEREAS, the applicants requested to amend the Final PUD
(precise) Plan to formalize the dimensional requirements and
eliminate the necessity to file an insubstantial amendment every
time a change is made on a parcel in the Park; and
WHEREAS, a duly notice Public Hearing was held by the Aspen
Planning and Zoning commission (hereinafter "Commission") on May
22, 1990 to consider the amendment to the PUD; and
WHEREAS,
after review and consideration of the
representations made by the applicant and Planning staff, the
commission recommends approval to Counci 1, with conditions, of

Section 1:
That is does hereby grant the following amendments to the
PUD:
Permitted uses: Mobile Home, Modular Home, or site Built Home is
permitted within the Smuggler Mobile Home Park pursuant to the
dimensional requirements set forth in this PUD Amendment.
New additions and redevelopment: All additions to any Mobile
Home or structure in the Smuggler Mobile Home Park shall meet the
ci ty of Aspen Building Regulations Chapter 7 of the Municipal
Code.
Basements: Any basement and floor system upon which one
relocates a mobile home must be capable of supporting the
relocated mobile home. All newly constructed basements shall
incorporate the radon mitigation technique that is being proposed
for the 1991 UBC. (Appendix Chapter 12 Section 1235,1237.)
Height: a) reduction of minimum service building height from 25
feet to 15 feet; b) the height of the residential units shall
remain at 15 feet as measured from the midpoint of the lots
average slope.
Minimum Lot size:
The minimum lot size shall be 2400 Square
feet.
Front Yard Setback: The minimum front yard setback shall be O.

The parking requirements shall remain the same as is
defined in Rules and Regulations of the Architectural Committee.
They are:
there shall be a minimum of 2 off-street parking
spaces for each lot on the combination of lot and the adjacent
part of the roadway easement which may be used for parking in
accordance with the covenants.
For any mobile home over 1,500
square feet in living area, three parking spaces are required.
For any mobile home in excess of 2,000 square feet, 4 parking
spaces are required, and for any mobile home in excess of 2,500

client's position is that Ms. Byard has acquired this property by
adverse possession.
Enclosed herewith, as required is a letter signed by Beverly
Campbell as the President of Smuggler Mobile Home Owners'
Association authorizing me to represent them in this matter.
This property is located on Gibson Avenue, the legal
description is: A portion of the Common Area of the Smuggler Mobile
Home Park as shown on the First Amended Plat thereof recorded in
the records of Pitkin county, Colorado. I hereby certify as an
attorney licensed to practice law in the State of Colorado that the
owners of the property is the Smuggler Mobile Home Owners'
Association, a Colorado non-profit corporation. There are no
mortgages, judgments, liens, easements, contracts or agreements
affecting the parcel. As this property is owned by the Smuggler
Mobile Home Owners' Association, I submit that it is appropriate
for them to apply for this development application. You will see
on the accompanying plat, the vicinity map as required by the

this is an insubstantial boundary change, both land owners whose
lot lines are being adjusted are consenting to this application,
and that this request is to address the hardship created by the
adverse possession. The corrected plat will conform to all the
requirements of the Aspen Municipal Code and the lot line
adjustment will not affect the development rights on the permitted
density on the respective pieces of property.
I would appreciate it if you after your review of this
document, you place this lot line adjustment matter and our request
for permission to record the amended plat of the Smuggler Mobile
Home Park containing those amendments which have been done
previously but which inadvertently was not recorded on the next
council agenda.
Also enclosed you will find our application fee in the amount
of One Thousand Two and No/I00 Dollars ($1,002.00).
Lastly, as you know, the Association wishes to have permission
to file the plat amendments previously approved by the city
council, but which were never recorded in Final Plat form, and to

Dear Leslie,
I enclose herewith a "blue line" drawing of the Second Amended
Plat for the Smuggler Mobile Home Park. This plat shows all of the
changes approved by Council in 1988, 1990, and in 1992, including
the lot line adjustment with Ms. Byard.
I would appreciate it if you would forward this Plat to the
City Engineer's Office and the other appropriate departments for
review. If you need additional copies of this plat, please do not
hesitate to contact me.
I do not believe that we need the signatures of the Planning
and Zoning Commission, or the Parks Department. I also think the
language in the statement of Subdivision should probably be revised
to reflect only what this Plat does rather than what previous plats
did. What do you think?
