Lots K, L, M and the West 27 feet of Lot N, Block 16, City
and Townsite of Aspen (northeast corner of Hallam Avenue
and 7th Street).

This is an application by Studios West Apartments, a Colorado
limited partnership, requesting subdivision exception for
the purposes of condominiumizing an existing 14 unit resi-
dential complex (Section 20-22). The applicant is requesting
a waiver to conceptual plan approval before City Council,
and Preliminary Plat and Final Plat approval before P & Z,
i.e., short subdivision procedure (Section 20-19).
The owner/applicant should be required to provide a 10 foot
by 7 foot electric/communications easement on the northeast
corner of Lot N.
Prior to Council approval, the applicant should obtain the
surveyor's signature and seal as well as the owner's signa-
ture on the condominium plat.
Following Council approval, the owner/applicant should submit
two mylar sets to this office for signatures and recording.
Full compliance with Section 20-22 is required:

This 14 unit apartment complex constitutes a non-conforming
structure in the R-6 zone. The condominium conversion of
non-conforming structure is not specifically regulated in
the Code. There are no specific parking requirements imposed
on a conversion project. Adequate off-street parking does
appear to exi st to the rear or north si de of the structure.
In evaluating the rental history of these 14 units, it
appears that none of the units have rented for terms in
excess of one month periods at a price within the current
guidelines for low, moderate and middle income housing
within the past eighteen (18) months.

request for subdivision exception for the purposes of
condominiumization subject to the following conditions:

Aspen, pitkin County, Colorado.
WHEREAS, there exists on said property a structure
in which the partnership wishes to create separate interests
without parceling the land on which said structure is situated;
and
WHEREAS, there has been made an application for Exception
from the Definition of Subdivision for such conveyance of interests
pursuant to S20-19 of Chapter 20 of the Municipal Code of the
City of Aspen; and
WHEREAS, the Aspen Planning and Zoning Commission, at
its meeting held March 3, 1981, has determined such exception.

RE: Studios West Subdivision Exception
Having reviewed the above application and made a site inspection,
the Engineering Department has the following comments:
1. First, it should be noted that this condominiumization
requires an exception procedure rather than an exemption
as stated in the application.
2. The owner/applicant should be required to provide a 10
foot by 7 foot electric/communications easement on the north-
east corner of Lot N.
3. Prior to Council approval, the applicant should obtain the
surveyor's signature and seal as well as the owner's sig-
nature on the condominium plat.
4. Following Council approval, the owner/applicant should submit
two mylar sets to this office for signatures and recording.

This is an application by Studios West Apartments,
a Colorado limited partnership, whose address is 600 East
Hopkins Avenue, Aspen, Colorado, pur ~20-19 of the
Aspen City Code as amended, for an exemption from the defini-
,
tion of the term "subdivision" for 'the-eon ominiumization of
14 units located in Aspen, Colorado.
The applicant submits that since this is merely a
subdivision of an existing building, to require that the appli-
cant proceed through the entire subdivision procedure would
deprive the applicant of the reasonable use of its land.
Furthermore, the applicant submits that exemption is necessary
for the preservation and enjoyment of its substantial property
right. Finally, since this is merely a subdividing of an exist-
ing structure, there will be absolute"l"y no..,~. crease in density
as a result of the granting of this(exemption and therefore the
granting of the exemption will not be detrim ntal to the public
welfare or injurious to other property in the area.
For the past eighteen (18) months, the amount of
rental for each unit has been in excess of the current guide-
lines established for low and moderate income housing; thus no
decrease in the amount of such housing would result from conver-
sion. Historical rental figures for the units in question have
been compiled by the applicant and will be made available to the
Commission.
The applicant submits that due to the prior history of
the units, no detrimental change in use or occupancy of the units

that the requirements of ~20-22 of the Aspen City Code will be
