HomeMy WebLinkAboutminutes.boa.20061207 ASPEN BOARD OF ADJUSTMENT - MINUTES - December 07, 2006 Rick Head opened the regular Board of Adjustment meeting at 4:05 pm in the Council Chambers. Charles Paterson, Mark Hesselschwerdt, Peter McClain, and Rick Head were present. Jag Pagnucco and Elizabeth Atkins were excused. Staff present were: Sara Adams, Community Development; Jackie Lothian, Deputy City Clerk. MINUTES MOTION: Charles Paterson moved to approve the minutes from August 3rd seconded by MarkHesselschwerdt. All infavor, APPROVED. PUBLIC HEARING: Case #004-06 Michael S. and Ellen B. Brown -1016 East Hopkins - Retaininl!: Wall Variance and Driveway Access Rick Head opened the hearing on Case #004-06. MOTION: Charles Paterson moved to continue the public hearing for Case #004-06 to January 11th; seconded by Mark Hesselschwerdt. All infavor, APPROVED. PUBLIC HEARING: Case #005-06 Kirshorn Family Ltd. -105 East Hopkins - Encroachment rear yard setback Rick Head opened the hearing for Case #005-06 Kirshom Family Ltd represented by Richard Wodehouse. Sara Adams explained that the stone veneer was encroaching into the setback and staff concluded that a variance should not be granted because the criteria had not been met. This was not a building eave or an architectural projection so the veneer does not qualify for the criteria. Adams said that the applicant was requesting the minimum variance that was required. Richard Wodehouse provided his notice and posting and introduced Mike Luciano that Wodehouse/Augello built the house for. Wodehouse displayed photos of the stone veneer pillars; the one survey showed that the foundation where the garage was located. Wodehouse said somehow the stone workers were not notified to use thinner stone. Wodehouse said to remove the stone would cost about $2500.00 and it will not look good without it. Wodehouse said that he volunteered the stone veneer problem to Community Development. Wodehouse said they could have moved the house over because they had an extra 10 inches on the other side that the house could have been moved so it was just an oversight that it happened. The Board agreed that this variance was minimal and an honest mistake. I ASPEN BOARD OF ADJUSTMENT - MINUTES - December 07, 2006 MOTION: Chales Paterson moved to approve Resolution #05-06 approving a rear yard setback variance of 2 inches for the property located at 105 East Hopkins Avenue,jinding that the review criteria have been met.
