Since this is a re- quest to condominiumize a commercial structure, the applicant need not comply with Sections 20-22 of the Municipal Code which concern the applicant's impacts on the supply of low and moderate income housing. In a memorandum dated May 5, 1981 (attached for your review) the Engineer makes the following comments: 1) The applicant should obtain an encroachment license for the intrusion of the building into the S. Spring Street right-of-way. 2) The applicant should construct a five foot wide by four inch thick concrete sidewalk adjacent to the East Hyman Avenue property line. 3) The applicant should revise the site plan to include the following corrections: - completion of the site plan title; - completion of the index listing; and designation of the existing parking area in the north- east corner of the property. The Building Inspector performed a site inspection of the premises and reported to the Planning Office that numerous life, health and safety violations were found during the visit. A detailed listing of the violations is attached for your review within the memo from Herb Paddock dated June 15, 1981. The Planning Office recommends that you approve the applicant's request for subdivision exception for the purposes of condo- miniumization subject to the following conditions: 1) The applicant obtaining an encroachment license for the intrusion of the building into the S. Spring Street right-of-way; 2) The applicant agreeing to construct a five foot wide by four inch thick concrete sidewalk adjacent to the East Hyman Avenue property line; 3) The applicant revising the site plan to meet the comments contained in the Engineering Department memorandum dated May 5, 1981 and re-submitting the plat prior to recorda- tion. City Council Action: Should Council concur with the recommendations of the Planning Office and P & Z, the appropniate motion is as follows: "I move to approve the Vicenzi/Goldstein Subdivision Exception for the purposes of condominiumization, subject to the following conditions: 1) The applicant obtaining an encroachment license for the intrusion of the building into the S. (1) Add sprinkler system per section 11 & 38 of 76 U.B.C. (2) Provide separation at basement with 3/4 hour door assembly per chapter 3305 of 76 V.B.C. (3) Incomplete I-hour construction and rated doors (20 minute rating) shall be added at basement. (4) Exit doors adjacent to courtyard shall be replaced with 3/4 hour rated doors and closures rather than sliding doors. These shall comply with height, width, and swing requirements of section 33 of the 76 V.B.C. (5) Additional glazing at court area shall be replaced with wired glass. (6) Exit signs shall be placed at all exits at court area per section 3312 of 76 V.B.C. (7) Missing fire hoses shall be replaced, see 76 V.B.C. (8) Handrails shall be installed throughout the building in compliance with section 33 of 76 V.B.C. (9) All exits shall swing in the direction of travel at courtyard. (10) Guardrails shall meet requirements of section 33, minimum 42" height. These reflect all changes required by the Building Department. If some question about waivers by the Board of Appeals on those items arise we need to contact Paul Taddune. The site plan title needs to be completed. 2. The index listing needs to be completed. 3. An encroachment license must be obtained for encroachment of building into the S. Spring Street right-of-way. 4. The site plan is missing designation of existing parking area in the northeast corner. 5. Planning Office The applicant should comply with Sections 20-22(a) and (b) Comments: of the Code by meeting the following conditions: - Existing tenants should be given written notice when their unit is offered for sale with a 90-day option to purchase their unit at preliminary market value. Tenants should be provided a 90-day right of first refusal to purchase thei r unit; and Building Inspector's Comments: Planning Office Recommendation: - All units shall be restricted to six month minimum leases with no more than two shorter tenancies per year. The Building Inspector performed a site inspection of the premises and reported to the Planning Office that numerous life, health and safety violations were found during the visit. A detailed listing of the violations was not made available to the Planning Office, but the Inspector will be at your meeting on June 2 to report on the results of his inspections. GOLDSTEIN, (hereinafter collectively referred to as "applicant") under !;20-19(a) of the City of Aspen, Colorado, subdivision regulations for approval through the subdivision exception process of applicant's plan for condominiumization with respect to real property described as: Lots A & B, Block lOS, City of Aspen, Pitkin County, Colorado An exception in this case would be appropriate. I The application involves subdivision of an existing I structure. Requiring strict compliance with subdivision regu- I lations for the subdivision of a lot with a nine (9) unit I commercial building on it creates conditions which will I deprive the applicant of reasonable use of land. If this exception application is granted, owners of the property will have a common interest in the land; and there will be a condominium declaration applicable to the property which will not in any way increase the land use impact of the property. An exception in this case will not conflict with the intent and purpose of the subdivision regulations which are directed to assest the orderly, efficient and integrated development of the City of Aspen, to ensure the proper distribution of population, to coordinate the need for public services and to encourage well planned subdivisions. , . ,'~ . The granting of this application will not undermine Ithe intent of the subdivision regulations, as it is clearly within the area intended for exception under S20-19.
