The Applicant has provided an affidavit in which the property owner has indicated that he constructed the units without obtaining permits or land use approvals in the 1960s. The units have been occupied intermittently over time and each contain a sleeping area, a kitchen with full-size appliances, and a bathroom. The Applicant believes that the three units would be considered Bandit Units under Section 26.104.100, Definitions, which defines Bandit Units as `a dwelling unit or other structure developed or used in violation of the land use or building regulations in effect at the time of its construction', and would therefore be exempt from GMQS multi -family replacement provisions in the Land Use Code as outlined in Section 26.4 70. 100. E Exemptions. This GMQS section contains a list of exemptions from the affordable housing mitigation provision, and the Applicant is requesting exemption under: 26.470.100(E)(8)(d), Exemptions: "The demolition, combining, conversion, replacement, or redevelopment of Multi - Family Housing Units which were illegally created (also known as "Bandit Units'). STAFF EVALUATION: Staff believes the information provided establishes the three units as Bandit Units as defined in Section 26. 104.100 Definitions. Declaring the units as Bandit Units is a basis to approve the GMQS exemption from multi -family housing replacement requirements. Staff finds that the Applicant has provided sufficient proof to justify the exemption from Multi -Family Replacement. The Bandit Units will be subject to the current Land Use Code, and require approvals and subsequent building permits. DECISION: The Community Development Director finds the units identified at 333 Park Avenue to meet the definition of Bandit Units in Section 26.104.100 Definitions, and to be consistent with the review criteria for GMQS Multi -Family Replacement Exemption and thereby, APPROVES the exemption with conditions as specified below: CONDITIONs: • The kitchens contained within the three bandit units will be required to be removed to decommission the units as dwelling units. • The Applicant will need to apply for a Building Permit for the structure just as if it were a new building. Background As the attached Improvement Survey illustrates, the Bibbig property is described as a meets and bounds parcel containing approximately 10,418 square feet (see Exhibit 8). The adjacent parcel is depicted as Adjusted Parcel II on the attached Bibbig Subdivision Exemption - Lot Line Adjustment Plat which was approved by COMDEV in January of 1997 (see Exhibit 9). Existing improvements to the property consist of a historically designated Victorian single-family dwelling that was apparently moved to the property in the 1960s and three additional units attached thereto. Each of the three units contains a sleeping area, a kitchen with full-size appliances and a bathroom. The units meet the Regula- tions' definition of a "Dwelling Unit" with the exception of the prohibition against internal connections to any other unit. Various existing doors connect one or more of the units. All of the units, however, have separate entrances. Requested Determination Pursuant Section 26.104.100 of the Regulations, a Bandit Unit is defined as "A dwelling unit or other structure developed or used in violation of the land use or building regulations in effect at the time of its construction. " As the attached Disclo- sure Statement from Mr. Bibbig states, he constructed the three additional units without obtaining required building permits or applicable land use approvals (see Exhibit 10). As presently configured, the units constitute multi -family dwelling units which are prohibited in the R-6 zone district. As Schedule B of the attached Title Commitment indicates, no prior land use approv- als are referenced therein other than the Bibbig Subdivision Exemption Lot Line Adjustment noted above (see Exception No. 18), and no further such approvals are believed to have been granted to the property. In addition, the Building Department's files apparently contain no permits for the construction of the three additional units (see Exhibit 11, Building Department files). Finally, the existing improvements are classified as a single-family residence in the Pitkin County Assessor's records (see Exhibit 12). Based on the above, I believe that the three units in question clearly meet the defini- tion of Bandit Units. As a result, I would appreciate it if you would provide me with COMDEV's written confirmation that they are in fact considered Bandit Units for regulatory purposes, and as such the demolition of the units is exempt from the replacement provisions of Section 26.470. 100. The adjacent parcel is depicted as Adjusted Parcel II on the attached Bibbig Subdivision Exemption - Lot Line Adjustment Plat which was approved by COMDEV in January of 1997 (see Exhibit 9). Existing improvements to the property consist of a historically designated Victorian single-family dwelling that was apparently moved to the property in the 1960s and three additional units attached thereto. Each of the three units contains a sleeping area, a kitchen with full-size appliances and a bathroom. The units meet the Regula- tions' definition of a "Dwelling Unit" with the exception of the prohibition against internal connections to any other unit. Various existing doors connect one or more of the units. All of the units, however, have separate entrances. Requested Determination Pursuant Section 26.104.100 of the Regulations, a Bandit Unit is defined as "A dwelling unit or other structure developed or used in violation of the land use or building regulations in effect at the time of its construction. " As the attached Disclo- sure Statement from Mr. Bibbig states, he constructed the three additional units without obtaining required building permits or applicable land use approvals (see Exhibit 10). As presently configured, the units constitute multi -family dwelling units which are prohibited in the R-6 zone district. As Schedule B of the attached Title Commitment indicates, no prior land use approv- als are referenced therein other than the Bibbig Subdivision Exemption Lot Line Adjustment noted above (see Exception No. 18), and no further such approvals are believed to have been granted to the property. In addition, the Building Department's files apparently contain no permits for the construction of the three additional units (see Exhibit 11, Building Department files). Finally, the existing improvements are classified as a single-family residence in the Pitkin County Assessor's records (see Exhibit 12). Based on the above, I believe that the three units in question clearly meet the defini- tion of Bandit Units.
