REQUEST: Approval of a Subdivision Exception for a Boundary Line
Adjustment.
APPLICANT: Frank Woods and Carol Hall.
LOCATION: Janss Subdivision lots 4 and 5 on Sneaky Lane.
ZONING: R-30.
EXISTING USES: Two Single Family Houses.
DESCRIPTION OF THE PROPOSAL: The applicants are requesting that
they be granted an exception from the full procedural require-
ments of the subdivision regulations in order to accomplish a
boundary line adjustment between their two lots. The amount of
land requested to be exchanged is 182.2 square feet of each lot.
The purpose of the Boundary Line Adjustment is to correct an
encroachment problem with an existing garage structure.
REFERRAL COMMENTS:
1) Engineering Department: In a memorandum dated November
10, 1987, Chuck Roth of the Engineering Department made
several comments regarding platting requirements. In
addition, Mr. Roth commented to the Planning Office
that the Engineering Department had no objections to
the proposed boundary line adjustment in concept,
however, the applicants must demonstrate to the Engi-
neering Department and the Planning Office that the
adjustment meets the required setbacks of the zone
district.
STAFF COMMENTS: The request is an insubstantial change and is an
attempt to straighten out a problem boundary line situation for
both land owners. The application meets the criteria in Section
20-19(a)(4) for lot line adjustments in that both owners consent
to the adjustment, development rights on the two properties are
not affected and, provided setback requirements are met, both
lots will conform to underlying zoning regulations.
RECOMMENDATION: The staff recommends that the Council make the
following motion of approval.
"The City Council grants approval of the Woods/Hall subdivi-
sion exception for a Boundary Line adjustment with the
following conditions":
1) The proposed lot line adjustment represents a change to
an existing plat which is titled Janss Subdivision.
The new plat shall be titled Janss Subdivision Amend-
ment No. 1. The subtitle may be Woods/Hall Subdivision
Exception.
2) The final plat shall illustrate that the boundary line
adjustment meets the setback requirements of the R-30
zone district and shall meet the requirements for a
final plat, as identified by the City Engineer and as
stated in Section 20-15 of the Municipal Code.

Having reviewed the above referenced application and having made
a site inspection, the Engineering Department has the following
comments:
1. The proposed lot line adjustment represents a change to an
existing plat which is titled Janss Subdivision. Please title
the new plat Janss Subdivision Amendment No. 1. The subtitle may
be Woods -Hall Subdivision Exception.
2. The Engineering Department has no comment to the contrary
towards approval of this subdivision exception. However, if it
is approved, it must be conditioned upon submission of complete
platting. The platting as submitted lacks many of the require-
ments of Sections 20-12 and 20-15 of the Municipal Code. The
surveyor's certificate or notes must reference the title commit-
ment or ownership and encumbrance report in order to verify that
all easements of record are platted.

Dear Cindy:
When we last discussed the referenced matter, you asked
me to submit a diagram indicating the new proposal. Enclosed
is a copy of an improvement survey on which I have sketched
the proposal.
Basically, all I am doing is readjusting the lot line so
that no part of the house on Lot 5 would project into the
front yard setback of 10 feet and the nonconformity with
respect to the lot width of Lot 4 will not be increased
because the adjustment will begin at 25 or more feet from the
front lot line. Since lot width is measured between side lot
lines congruent with the front yard setback line (25 feet),
this should, presumably, resolve the problem which we had.
Please give me a call after you have had an opportunity
to review this.

Submitted herewith is an application for a subdivision
exception to permit the lot line adjustment between Lots
4 and 5 of the Janss Subdivision pursuant to §20-19(a)(4) of
the Municipal Code. My client, Frank J. Woods, III, owns Lot
5 and Carol Hall, who is represented by Bill Clark, owns
Lot 4. If approved, the exception would permit the parties
to respectively exchange 182.2 square feet to each other so
as to adjust the boundary line between the parcels.
I am enclosing herewith two Memoranda of Ownership
confirming that Woods and Hall respectively own Lots 4 and 5,
legal descriptions for the exchange parcels prepared by
Alpine Surveys, and two preliminary draft plats indicating
the location of the new boundary line and the respective
exchange parcels.
The application satisfies all of the conditions of
§20-19(a)(4) in that the boundary change between consenting
landowners is for equal amounts of property which will not
have any effect on the development rights or permitted
densities and there will be no land use impacts whatsoever.
Since this is a one-step process, I understand that the
requisite fee is $680.00. Would you please have someone call
me to confirm that fee and I will obtain and deliver to you a
check in that amount immediately. I would also appreciate
your advice as to the number of original plats and copies

Submitted herewith is an application for a subdivision
exception to permit the lot line adjustment between Lots
4 and 5 of the Janss Subdivision pursuant to §20-19(a)(4) of
the Municipal Code. My client, Frank J. Woods, III, owns Lot
5 and Carol Hall, who is represented by Bill Clark, owns
Lot 4. If approved, the exception would permit the parties
to respectively exchange 182.2 square feet to each other so
as to adjust the boundary line between the parcels.
I am enclosing herewith two Memoranda of Ownership
confirming that Woods and Hall respectively own Lots 4 and 5,
legal descriptions for the exchange parcels prepared by
Alpine Surveys, and two preliminary draft plats indicating
the location of the new boundary line and the respective
exchange parcels.
The application satisfies all of the conditions of
§20-19(a)(4) in that the boundary change between consenting
landowners is for equal amounts of property which will not
have any effect on the development rights or permitted
densities and there will be no land use impacts whatsoever.
Since this is a one-step process, I understand that the
requisite fee is $680.00. Would you please have someone call
me to confirm that fee and I will obtain and deliver to you a
check in that amount immediately. I would also appreciate
your advice as to the number of original plats and copies
