Box 4949 Aspen, Co1oado 81611 APPLICATION FOR EXEMPTION Pursuant to Section 20-19 of Chapter 20 of the Municipal Code of the City of Aspen, Creative Mountain Development Company, a Colorado Corpor- ation, hereby applies for an exemption from the definition of the term "Subdivision" with respect to the real property described as: Lots 2 and 3 Alpine Acres Subdivision City and Townsite of Aspen Pitkin County, Colorado The applicant submits that the exemption in this case would be appro- priate. The application involves subdivision of two approved duplexes. The owners of the property will be subject to a condominium declaration of restrictions applicable to the property and subdivision does not in any way increase the land use impact of that property. The applicant sub- mits that such an exemption in the instant case would not conflict with the intent and purpose of the subdivision regulations which are directed to assist, among other things, orderly, efficient and integrated develop- ment of the City of Aspen; to insure the proper distribution of population; to coordinate the need for public services; and to encourage well planned subdivision. They are directed to considerations of subdivision design and improvements and to restrict such building where it is inappropriate after considering its land use impact. In the present application those decisions cannot be made as the buildings are already approved, and the density would not affect the prevailing contemplated or desired population density on this property. M E M 0 RAN DUM TO: Aspen City Council FROM: Planning Office (HC) RE: Alpine Acres Condominiums - Subdivision Exemption DATE: April 20, 1977 This is a request by Creative Mountain Development Company to condo- miniumize two proposed duplexes (4 dwelling units total) to be located on Lots 2 and 3 Alpine Acres Subdivision. These lots were recently annexed to the City of Aspen and are subject to the terms and conditions of an extensive annexation agreement. The property is zoned R-15. The Planning and Zoning Commission recommended approval at their April 20, 1977 meeting subject to the conditions of the Planning Office as described below: 1. A minimum six month lease restriction. 2. Payment of the Park Dedication Fee. 3. Compliance with the conditions already imposed which are contained in the annexation agreement. lmk
