Commissioners in attendance: Mark Goodman, Stan Hajenga, Don Sheeley and Shae Singer. Terry Butler and John Starr were excused. Council member I.E. DeVilbiss Debbie Braun, ACRA Moratorium: Bill stated that he feels the moratorium is a drastic measure. What is the fear to take such an extreme measure without a good dialogue before doing so. We need the opportunity to have a real dialogue before making any more amendments to the moratorium ordinance. What mechanisms are needed and what are you (council) looking for etc. Bill also wanted J. E. to address what the implications are about going inside an historic building. J.E. DeVilbiss: What you see is a council that is a different composition than previous councils. The votes were there to do the moratorium. The most recently enacted moratorium is broader than what I would like. There is substantial sentiment on council and among others that we should regulate the ability to change the interiors of buildings to which the public has normal access. That is what this ordinance is aimed at. This ordinance is designed to keep the Red Onion as the Red Onion. This is the first step to regulate the change of use in an interior of a building. Shae said it would always have to be for example a pet store or a retail store in that certain usage. Debbie said if the Red Onion goes under as a restaurant only a restaurant can go in that space. J. E. responded yes, as the ordinance is written right now. Bill asked what is the concern? J. E. said loss of change. The ordinance should say preservation of significant buildings. The Red Onion would be the loss of an historic use. . Don interjected, you mean capitalization v.s. socialism. Don said he has a problem with the ordinance. A person has a right to put whatever they want in their space. 1 COMMERCIAL CORE & LODGING COMMISSION MINUTES OF JANUARY 3, 2007 Shae pointed out that if you talk to in town managers most ofthe people that shop at the high end stores ship their merchandise. Bill said Aspen has reinvented itself at least three times. Is your concern that c.ouncil doesn't want Aspen to change? J.E. said that is part of it. I. E. pointed out that Telluride hasn't changed at all. Bill said Telluride is struggling. I. E. said Telluride's council just met with our council and we did not hear anything about Telluride struggling. J.E. asked the board what they see wrong with what council is doing now. Bill said why would a business what city council to describe what can happen inside someone's property. Bill Where has this been tried before. I. E. said Telluride does it but they are under the National registration for the entire town. Debbie Braun said from the members their fear is if someone sells their business after a successful business season that the City will have empty businesses. Will this moratorium cause the economy to turn down. Debbie asked about the process. Chris Bendon said they would come to the Community Development director first and there is an appeal officer. J. E. said the purpose is to provide for reasonable discussion. Shae said council has changed the first floor commercial by not allowing real estate companies on the first floor. Thing are always changing. J. E. said thqnoratorium by its nature is for a limited duration. During the period the landuse code will be amended or not amended. It is to hold on and look at the city. It is to prevent things from going away. Bill said businesses apply to the Community Director and there is an appeal which might involve another board and then to council. Bill said you mean the ordinance is to establish where historic or significant things are inside the building. E. said you need to outline the concerns and get on council's agenda. Stan said Council needs to know the proposed amendments before they go to a public hearing. Chris Bendon said he will circulate the drafts of the proposed ordinance to the lodges and CCLC. Shae said council is trying to restore what aspen is. The historical nature can be retained with a change in use. Debbie said people come to Aspen to see our historic buildings. Bill said he would not preserve interior use at all. People have property rights. Don asked if other members of council would be willing to listen. J. E. said he feels the majority of them would. Don said he agrees with Bill the invasion of property rights is inappropriate. Stan said he gets people every day talking about the loss of the Mother Lode. The Hotel Jerome process worked. He is holding back and wants to see if this process is going to work. We need a lot of input. There needs to be moderation in the ordinance. The real issue is how do we put ourselves in the decision process. Mark said legislation puts an upward pressure on realestate and rentals by limiting the supply. Debbie suggested having meetings like we had in the spring in order to get input from the community. Bill said he would like a list of towns where a moratorium such as this has worked. Mark said he is not sure that council should legislate. Meeting adjourned at 10:00 3
