RE: Aspenhof Condominium - Final Plat Amendment

Mr. Bob Hughes, representing the condominium declarant of the Aspenhof
condominium in the Cooper Building, requests that you consider an amendment
to the approved final plat. The amendment involves redrawing the boundaries
of commercial units on the first and second floors in order to reflect
actual changes in configurations made by commercial unit tenants.
The applicant represents that there will be no change in the number of
commercial units and no increase in commercial space (only interior
partitions have been moved). Pursuant to the Condominium Declaration,
all owners and holders of mortgages or deeds of trust must be notified
and their consent recorded. Such consents should be obtained by you
prior to any approval.
Assuming that those consents can be obtained, the Planning Office, recom-
mends that you approve the requested plat change subject to the written
consent of all the owners. Since the change does not affect a substantial
or material change in the subdivision design standards previously improved,
or an increase in density, we believe you can find that this case warrants
an exemption from the full subdivision procedure.
NOTE: Original floor plans are attached. The amendment will be shown at
the Tuesday meeting.

This application is for an amendment to the final condominium plat of the
Aspenhof Condominiums (the Cooper Building). The revision requested
involves redrawing partition boundaries separating commercial units on
the first and second floors. The number of units will remain the same
and there will be no increase in square footage. In fact, the amendment
is requested in order that the plat will conform to the actual physical
configuration which now exists in the building. Interior partitions
were moved by tenants several years ago inasmuch as the arrangement
appeared more practical for the commercial tenants.
There was some question whether the request requires review under the
Municipal Code inasmuch as the building was built and condominiumized
prior to city subdivision regulations. The City Attorney has advised
us that such review is required.
In view of the fact that there will be no change in either use or square
footage characteristics of the building, the planning office recommends
that subdivision exemption be granted subject to the written consent of
all the building owners (this is a condition of the condominium decla-
ration). The Planning and Zoning recommended approval at their June 7th
meeting.
The applicant is John Cheek, Jr. We have asked his representative, Bob
Hughes, to bring the proposed amended plat on Monday night.

Re: Aspenhof Condominium - Application for
exemption from definition of subdivision
Ladies and Gentlemen:
We represent John B. Cheek, Jr., the condominium
declarant of the Aspenhof Condominium (the Cooper Building),
a mixed residential -commercial condominium complex consisting
of one below grade and three above grade levels situate
on part of Lots N and Q and all of Lots O and P in the City
of Aspen.
Since the time of the initial submission of this
property to condominium ownership on November 27, 1970,
several of the commercial unit (first and second floors only)
tenants have undertaken to alter the configuration and
dimension of their respective units. These changes have
resulted either from the construction of new partition walls
or the removal of existing walls. Although the number of
actual units has not changed, the existing condominium map
no longer accurately reflects what it purports to show in
terms of the physical dimension and boundaries of the commer-
cial units. Consequently, it has become necessary to seek
your approval to the filing of the enclosed proposed First
Amended Map of Aspenhof, which depicts the current physical
layout of the first and second floors, in order to conform
the condominium documents of record to the actual location
and dimension of the commercial units.

The proposed amended map reflects the older boundaries
of the commercial units by broken line; the current unit
boundaries are designated by the solid lines. Neither the
basement unit nor any of the residential units, occupying
the third floor, are affected. In order to assist you in
more readily detecting the changes above discussed, I am
also enclosing for your comparison a copy of the initial
condominium map of Aspenhof depicting the first and second
floor plans. I apologize for the rather poor reproductive
quality of the copy.
Pursuant to the original Condominium Declaration for
Aspenhof, it is necessary to record, along with the amended
map, the consents of each of the unit owners and the holders
of any recorded mortgage or deed of trust affecting the units.
The names and addresses of the unit owners and secured parties,
each of whom have been individually contacted to this end
and whose written consents we anticipate shall shortly be
forthcoming, are as follows:

Naturally, we recognize that the recording of an
amended condominium map in the respects set forth above
plainly implicates the subdivision process contained in
Chaper 20 of the Municipal Code of the City of Aspen.
See e.g., 520-21 which, in pertinent part provides:
"(a) Resubdivision of land or any change
to a recorded plat shall be considered a
subdivision and shall require full compli-
ance with this regulation."
However, given that (1) the sole purpose of the recording
of the amended map is to conform the condominium documents
of record to the current actual physical configuration and
dimension of the commercial units within the condominium
project; (2) the changes depicted on the amended map have
resulted only from the relocation of interior partition
walls consistent with the practical needs of each of the
commercial tenants in relation to one another; and (3) no
change in the number of units, commercial or otherwise, is
involved, we would hereby request that the contemplated
recording of the First Amended Condominium Map of Aspenhof
be exempted from the definition of a subdivision pursuant to
§20-19 of the City Code.

WHEREAS, John B. Cheek, Jr. (applicant) in his own
right and as successor in interest to Aspen Construction Corpora-
tion, a dissolved Colorado corporation, is the Condominium
Declarant of that certain Condominium Declaration For Aspenhof
(sometimes also known as "The Cooper Building") recorded
November 27, 1970, in Book 252 at Pages 49-60 of the records of
the Clerk and Recorder of Pitkin County, Colorado, by which the
following described real property was submitted to condominium
ownership under the Condominium Ownership Act of the State of
Colorado:
The easterly 23.75 feet of Lot N,
all of Lots O and P, and the
westerly 28 feet of Lot Q, Block 95,
City and Townsite of Aspen, Pitkin
County, Coloaado.
WHEREAS, in connection with the submission of the !

did cause to be filed for record in Plat Book 4 at Page 136 of

Pursuant to City Council motion approving the
Cooper Building Subdivision exemption, conditional on
my approval of the floor plans as conforming with the
Building Code, I inspected the premises and noted
several violations as in the attached memorandum.
I now have a written commitment that the noted
objections will be corrected within the week, so I
will waive my objections. I will follow-up with an
inspection within two weeks.

RE: ASPENHOF PLAT REVISION
I have checked the First Ammended Condominium Map of Aspenhof
as requested by City Council and further inspected the
building.
The first and second floor plans are in conformance with the
building and fire codes. Permits have been issued for
partition changes that have occured from time to time.
There is a problem, however, in the parking garage and rear
exit from the Magic Pan located in the basement. The ceiling
of the parking garage has had holes poked through destroying
the fire integrity of that ceiling. These holes should be
patched with cement plaster.
Doors have been changed in the rear of the Magic Pan plus
addition of illegal hardware on the 2nd. exit from the
parking garage which for all practical purposes makes only
one exit from the parking garage. The corridor from the
parking garage to the stairway to the first floor has been
changed to a locker room and one of the rear exit signs has
been turned around.
I have no problem with the first and second floor but the
basement violations should be resolved before approval is
given.

Attached is the plat proposed for subdivision exemption by the Aspenhof
Condominiums. Council approved the exemption subject to your checking
the.proposed plat change for compliance with the building, fire, and
other codes. As we discussed yesterday, one or several building permits
may cover the partition changes which have already been made.
I would appreciate your reviewing the plat changes and letting me know
whether they comply with current codes. Please return the plat when
through.
