Townsite of Aspen (West Main between Second and Third Streets)
Lot Size: 5450 square feet
Applicant's The applicant is requesting a subdivision exception for the
Request: purposes of condominiumization of an existing four -level
frame office building which is used principally for medical
arts purposes, Typically, an office building condominiumiza-
tion would not have any concern regarding Section 20-22 of the
Code. However, at the P & Z review stage, it was determined
that the building manager does occupy a residence in the
building which the applicant intends to convert back into an
office. The applicant has provided information documenting
that the unit has been renting for $500 for a 700 square foot
unit ($0.71 per square foot) which exceeds the current maximum
employee housing rental guideline ($0.68 per square foot). It
can therefore be stated that this proposal to condominiumize
the building will have no impact upon the supply of low and
moderate income housing in the community.
Review Comments: The Engineering Department has reviewed the revised plat sub-
mitted by the applicant following conceptual approval by P & Z.
The Engineering Department finds the plat to be acceptable as
submitted.
The Planning and Zoning Commission requested that the appli-
cant submit to an inspection of the building prior to recorda-
tion of the condominium documents. Despite the fact that this
requirement was not part of the Code at the time of P & Z review
of this application, the applicant did agree to this condition.
The Planning Office notes that the lot on which the building is
located is only 5450 square feet and would be substandard under
current zoning requirements. However, the applicant properly
points out that at the time the building was moved to this site,
the Code requirements were less stringent. Similarly, we note
that the parking arrangement at the site does not meet current
code requirements. Nevertheless, condominiumization review is
not the appropriate time for correction of either of these
problems.
Finally, the Environmental Health Department has informed the
Planning Office that there is a need to improve the trash
service to the building because a complaint has been lodged
that discarded medical supplies (i.e., syringes) are being dug
out of bagged trash by neighborhood children. This situation
should be rectified by the provision of an adequate number of
dumpsters to hold the trash which is collected on a routine
basis.
Planning Office The Planning Office recommends that you approve the request to

and Zoning Commission concurred in this recommendation at their
meeting on January 20, 1981.

Office and P & Z, the appropriate motion is as follows:
"I move to approve the subdivision exception for the purposes
of condominiumizing the Aspen Medical Center, subject to the
following conditions:
1) The applicant will permit the Building Department to
inspect the building prior to recordation of the condo-
minium plat; and
2) The applicant will install a sufficient number of dump-
sters to handle its routine trash collection needs."

Re: Rental History of Caretaker Unit in the Basement of
the Aspen Medical Center
Gentlemen:
As you are aware, Dr. J. Sterling Baxter has applied for and
obtained conditional approval from the Planning and Zoning
Commission for an exception from the strict applications of the
provisions of the subdivision regulations of the City of Aspen.
Pursuant to that application, it was revealed by the applicant
that in the basement of the Aspen Medical Center, which has
principally a medical arts orientation, that there exists a
dwelling unit which was installed at the time the building was
placed upon the property upon which it is now situated. The
Planning Department and City Council have asked that we provide
the City with Dr. Baxter's position on the rental history of the
unit so that a recommendation can be made by the Planning Office
to the City Council and the City Council can determine as part of
final approval of the exception application whether or not that
said unit does in fact constitute an employee housing unit
deserving of being preserved under the provisions of the Code.
Essentially, the unit is 700 square feet more or less in size.
It has been occupied by a single individual for the last eighteen
(18) months at a cash rental figure of $500.00 per month. In
addition to the payment of the $500.00 per month rental, the
occupant of the unit, according to Dr. Baxter, has been required
to perform duties on behalf of the building in the form of snow
removal, minor general maintenance and security. Dr. Baxter has

indicated that although he has not been a strict task master in
terms of the performance of these duties, that he believes that
an accurate estimation of the time spent under the guidelines
which were set down when occupancy first occurred would be that
the occupant should spend no less than forty (40) hours per month
in the performance of these duties. Therefore, given the rent
alone of $500.00 per month for 700 square feet, is the equivalent
of $f. 40 per square foot. That amount, when coupled with the
value of forty hours per month multiplied by a conservative value
of $6.00 per hour for services rendered, clearly demontrates the
fact that the unit cannot be construed as low or moderate cost
housing within the guidelines as established pursuant to the
provisions of Section 20-22(c) of the Aspen Municipal Code.
This letter will confirm that Dr. Baxter will submit to a health
and safety inspection by the City's health and/or zonign officer
as a condition of the subdivision exception.

Dear Ladies and Gentlemen:
We represent Dr. J. S. Baxter, who is the long time owner of the
Aspen Medical Center Building. The Aspen Medical Center Building,
as you know, is a four level frame office building situate on Main
Street and bears the street address of 323 West Main Street. The
property is legally described as follows:
The easterly 9.5 feet of Lot B, all of Lot C,
and the westerly 15 feet of Lot D, in Block 45,
City and Townsite of Aspen.
Dr. Baxter seeks, by this application, that the subject property
be excepted from the strict application of the subdivision require-
ments of the Municipal Code of the City of Aspen, in order that he
may condominiumize the same. An improvement survey of the subject
property, together with the ownership and encumbrance report indi-
cating the ownership of the property, issued by Stewart Title of
Aspen, Inc., accompanies this application, together with our check
in the amount of $50.00 as a filing fee.
The Aspen Medical Center was constructed in 1973 by moving an
existing structure, formerly situate on Cooper Avenue between Stefan

Kaelin's Sport Shop and the Aspen Country Store, and consists of
three above grade and one below grade levels. It is situate in the
O (Office) zone district. It contains approximately 4,450 net (i.e.
leasable) square feet. Sufficient off-street parking spaces are
appurtenant to the building, as well as an enclosed trash access
area consistent with code requirements. The building is currently
exclusively of a medical arts orientation, and hopefully these uses
will be maintained, but the improvements do lend themselves to other
appropriate office and business uses. There are multiple tenancies
within the leased premises, occupied by several physicians. Other
uses in the block are the Applejack Inn and the Herron Condominiums.
The Planning Office has requested information from the applicant with
respect to the creation of the property interest which is the subject
of this application. I enclose herewith Dr. Baxter's deed delivered
in 1973. Any problems which may have existed were well known to the
City and discussed fully in 1973, and it is clear that because of the
lapse of time that there is no basis for raising any concerns about
the property at this point in time. As of the time that Dr. Baxter
constructed the improvements, the property was zoned AR-1, which
required only a thirty foot lot width in order for there to exist a
standard lot. Of course we recognize that things have changed since
then, and that the lot would be substandard. However, the fact that
it is substandard at this point in time for the use, does not consti-
tute a matter for consideration in the subdivision of the property.
The applicant understands that the condominiumization of existing
buildings under single ownership, technically is a subdivision under
the Municipal Code of the City of Aspen. However, given that the
typical subdivision concerns related to a new division of land, such
as growth patterns, extension of public services, geologic hazards,
subdivision design standards, and the like, obviously are not involved
with respect to these City and Townsite Lots, the applicant believes
that the condominiumization does not require the strict application
of the subdivision regulations of the City, and it would be appropriate
to except the same therefrom. Since the building is exclusively com-
mercial in nature, concerns with impact of condominiumization upon
local housing inventories similarly are not involved.
We will be happy to supply you with any further information that you
might require and answer any questions which you might have.

Dear Alan:
I want to thank you for accommodating me in putting
off the Aspen Medical Center presentation before the City
Council. Hopefully, you got my note and/or spoke to Sunny
prior to the City Council meeting. August 10 was the first
opportunity which I had had to review the Planning Office's
memorandum as prepared by you. I have forwarded a copy to Dr.
Baxter for his review and comment. The only comment which I
have is with respect to the existing residential unit within
the project. It indeed may be Dr. Baxter's intention to
convert this into an office, but not necessarily so. It has
never been used for office space and may continue to be used
for a period of time as residential space. Hopefully this
would not alter the Planning office's position with respect to
the application.
In addition, we have, subsequent to the submission of
the rough condominium plat, determined that certain changes are
necessary which really do not affect the public interest.
These are internal changes with respect to unit layouts. Dave
Russell of Alpine Surveying is currently in the process of
making certain modifications to the plat. These should not
cause any concern to the Engineering Department but, of course,
we will submit it as soon as I receive it for your review.
The reason I requested the delay until September is
that it is my intention to be on vacation until the first week
in September and we will need time to get everything together
after my return.

Having reviewed the above application for exception from the full require-
ments of subdivision for the purpose of condominiumization, and having made
a site inspection, the Engineering Department has the following comments:
1. An exception procedure would seem appropriate excepting the applicant
from conceptual review before Council and preliminary plat before the Planning
and Zoning Commission. The improvement survey included with the application
is an adequate conceptual submission.
2. The improvement survey as submitted is not an adequate condominium
plat and will require revision following conceptual approval. The revised
plat shall include schematic floor plans, cross sections, common elements,
off-street parking, and trash and utility service areas.
3. The owner/applicant shall provide an electric transformer easement
10 feet deep by 7 feet measured along the alley. This easement would allow
a transformer location in the event the alley is undergrounded at some
future date. The easement shall be shown on the final condominium plat.
The Engineering Department recommends approval of the Aspen Medical Center
subdivision exception provided the applicant complies with items 2 and 3
above.

Medical Center Building
Dear Ladies and Gentlemen:
We represent Dr. J. S. Baxter, who is the long time owner of the
Aspen Medical Center Building. The Aspen Medical Center Building,
as you know, is a four level frame office building situate on Main
Street and bears the street address of 323 West Main Street. The
property is legally described as follows:
The easterly 9.5 feet of Lot B, all of Lot C,
and the westerly 15 feet of Lot D, in Block 45,
City and Townsite of Aspen.
Dr. Baxter seeks, by this application, that the subject property
be excepted from the strict application of the subdivision require-
ments of the Municipal Code of the City of Aspen, in order that he
may condominiumize the same. An improvement survey of the subject
property, together with the ownership and encumbrance report indi-
cating the ownership of the property, 'issued by Stewart Title of
Aspen, Inc., accompanies this application, together with our check
in the amount of $50.00 as a filing fee.
The Aspen Medical Center was constructed in 1973 by moving an
existing structure, formerly situate on Cooper Avenue between Stefan

Kaelin's Sport Shop and the Aspen Country Store, and consists of
three above grade and one below grade levels. It is situate in the
O (Office) zone district. It contains approximately 4,450 net (i.e.
leasable) square feet. Sufficient off-street parking spaces are
appurtenant to the building, as well as an enclosed trash access
area consistent with code requirements. The building is currently
exclusively of a medical arts orientation, and hopefully these uses
will be maintained, but the improvements do lend themselves to other
appropriate office and business uses. There are multiple tenancies
within the leased premises, occupied by several physicians. Other
uses in the block are the Applejack Inn and the Herron Condominiums.
The Planning Office has requested information from the applicant with
respect to the creation of the property interest which is the subject
of this application. I enclose herewith Dr. Baxter's deed delivered
in 1973. Any problems which may have existed were well known to the
City and discussed fully in 1973, and it is clear that because of the
lapse of time that there is no basis for raising any concerns about
the property at this point in time. As of the time that Dr. Baxter
constructed the improvements, the property was zoned AR-1, which
required only a thirty foot lot width in order for there to exist a
standard lot. Of course we recognize that things have changed since
then, and that the lot would be substandard. However, the fact that
it is substandard at this point in time for the use, does not consti-
tute a matter for consideration in the subdivision of the property.
The applicant understands that the condominiumization of existing
buildings under single ownership, technically is a subdivision under
the Municipal Code of the City of Aspen. However, given that the
typical subdivision concerns related to a new division of land, such
as growth patterns, extension of public services, geologic hazards,
subdivision design standards, and the like, obviously are not involved
with respect to these City and Townsite Lots, the applicant believes
that the condominiumization does not require the strict application
of the subdivision regulations of the City, and it would be appropriate
to except the same therefrom. Since the building is exclusively com-
mercial in nature, concerns with impact of condominiumization upon
local housing inventories similarly are not involved.
