Referral Comments: Engineering Department The Engineering Department had the following comments regarding the application: 1. The plat submitted is not sufficient as it does not comply with the Code requirements for condominium plats. The plat should be reviewed and approved by the Engineering Depart- ment prior to Council review. 2. The division of the existing unit into four units creates ingress and egress problems which need to be solved to the satisfaction of the Engineering Department. Unit 202 -E will need to be used and dedicated for access purposes. 3. Any and all conditions applied to the original Unit 202 should be extended to cover the four new units. 4. An on-site parking space must be deeded to each of the four office units created. Planning Office Review: The proposed re~condominiumization of Unit 202, Park Central East will result in four new office units and a potential for four new office ownerships. No new floor area will be added since existing space is being divided to create the new units, therefore, no GMP allocation is required. The creation of four units will result in increased impacts on traffic and parking. The applicant has stated that each new office will have its own deeded on-site parking space in order to reduce parking problems. Ingress and egress problems will have to be solved prior to final plat review. As proposed, Unit 202~E will have to be used for ingress and egress for the four units, 202-A, 202-B, 202-C and 202-0. An access easement through Unit 202-E will need to be dedicated, or the entire office should be made a public corri.dor. .. ", .., Memo: Park Central East Page Two August 5, 1982 The Planning Office review of the previous conditions applied to the Park Central East project shows that the only pertinent condition whi ch should sti 11 apply to the new units is that the owner be required to join a sidewalk improvement district in the future, should one be formed. Planning Office Recommendation: The Planning Office recommends conceptual approval to the request to re-condominiumize Unit 202, Park Central East, subject to the following conditions: 1. Ingress and egress problems must be solved to the satis- faction of the Engineering Department prior to Council review by indicating on the plat that Unit 202-E is common area used for access. 2. A condominium plat meeting the final plat requirements of Section 20-15 of the Code must be submitted to and reviewed by the Planning Office prior to Council review.. 3. The owner be required to join any special improvement district which may be formed in the future. 4. The Engineering Department can make the following comments: 1. The re-condominiumization of the unit is to form additional units and so more ownerships. 2. This change does not increase the total floor area of the building. 3. This request is to re-subdivide a portion of an existing condominium and should be required to comply with the subdivision regulations for condominium plats. 4. The plat's submittd are not sufficient for the re-subdivision of this unit. 5. The division of the existing unit into 5 units does create problems of ingress and egress for all the new units. 6. Does this re-subdivision effect the growth management quota system? 7. Any and all conditions that applied to the original unit should be extended to the new units. The Statement of Exception document is acceptable as to form. I have made some changes to the Restrictive Covenants and my changes are included in the enclosed draft form. The new paragraph #2 is the City's standard paragraph for inclusion in improvements districts. The Engineering Department tells me the blueprints appear to be acceptable, but they will reserve final judgment until the mylars are received for review. with respect to your request to convey the property prior to recording of the recondominiumization documents, the City will need at least a document signed and acknowledged by the present owners and the purchasers confirming that the new owners are aware of the City's requirements for the recondominiumization and agreeing to abide by the requirements as express successors and assigns. These Covenants shall be binding on all parties and all persons claiming under them for a period of fifty (50) years, unless an instrument signed by the City of Aspen and the then record owners of the property has been recorded, agreeing to change said covenants in whole or in part or agreeing to release said covenants.
