Zen n- zr- -i~ 7<> ~o n:;~ Co .-..::: &ESS N HAP - N = -a STATEMENT OF EXCEPTION FROM THE FULL SUBDIVISIaI FOR THE PURPOSE OF CREATING THE SUBDIVISION EX OF THE NORTH STREET SUBDIVISON ,.. WHEREAS, Thomas J. Daly and Judith J. Daly (hereinafter col- lectively referred to as "Owners") are the owners of the follow- ing described real property (the "property"): Lots A, B, C, D, E and F, Block 14, City and Townsite of Aspen, pitkin County, Colorado, and; WHEREAS, Owners have requested from the City of Aspen, Colorado an exception from the full subdivision process for the purpose of dividing the Property into two separate parcels to be known as Lots 1 and 2, Subdivision Exception Map of the North Street Subdivision, Pitkin County, Colorado, and; WHEREAS, Owners have submitted to the City of Aspen for approval, execution and recording a plat map entitled: "Subdivi- sion Exception Map of the North Street Subdivision", and; WHEREAS, the Aspen City Council at its meeting of November 24, 1986 determined that the Owners' request for such exception was appropriate and granted the same, subject, however, to the conditions described below; and NOW, THEREFORE, the City of Aspen does hereby determine that the application for exception from the full subdivision process for the purpose of subdividing the Property is proper and hereby grants such exception. PROVIDED, HOWEVER, that the foregoing exception is expressly conditioned upon: 1. Recordation of that certain plat map entitled "Subdivi- sion Exception Map of the North Street Subdivision"; 2. Removal and relocation of any and all trees located on the Property must be performed in accordance with Section 13-76 of the City of Aspen Municipal Code; 3. The Owners shall covenant and agree to join any future improvement districts that would encompass the Property in the event such improvement districts are formed; and 4.
