ZONING: R-6.
APPLICANT'S REQUEST: Owner of the property, Tom Daly, requests
approval of a lot split to create two new lots each containing
approximately 8,987.5 s.f. The existing one story house in the
center of the property would be demolished.
APPLICABLE SECTIONS OF THE CODE: Section 24-11 .2 (d) of the
Municipal Code, as amended, (attached) permits a GMP exemption
for splitting of merged lots in the Aspen Townsite and early
additions for construction of single-family houses on each lot
created.
Section 20-19(c) states the criteria for City Council's review of
a subdivision exception as follows:
"The City Council may grant exceptions from the application
of the standards or requirements of this chapter and grant
final subdivision approval when the City Council, in its
sole discretion and judgement, deems certain requirements to
be redundant, serve no public purpose and to be unnecessary
in relation to the land use policies of the City of Aspen
under the facts and circumstances presented and, notwith-
standing the exception, finds that the proposed subdivision
will substantially comply with the design standards of this
chapter. In cases where a public hearing is required prior
to the granting of any final approval, the City Council may
choose to conduct the public hearing itself or refer the
application to the Planning and Zoning Commission or a
hearing officer. Prior to the granting of any such excep-
tion, the City Council may request a recommendation from the
Planning and Zoning Commission."

PROBLEM DISCUSSION: PLANNING OFFICE COMMENTS:
The Planning Office believes that this proposal substantially
complies with the land use policies of the City of Aspen and
meets our subdivision standards. The proposed lots meet the
minimum area requirement of 6,000 s.f. for single family houses.
All utilities are available to the property, as it is located in
a developed area of the City. The site is relatively flat and
there are few outstanding environmental concerns other than the
protection of trees. Six (6) trees over 6" in diameter have been
identified, located toward the back property line. Removal of
trees is subject to Section 13-76, which requires a permit issued
by the Building Inspector and Parks Director prior to removal.
The existing house to be demolished was designed by architect
Frederic (Fritz) Benedict. In the Aspen Area Comprehensive Plan:
Historic Preservation Element, one of the implementation actions
is "designation of significant modern buildings." The Planning
Commission was concerned that demolition of notable post-victor-
ian architecture could negatively effect the community; and
modern buildings should be evaluated for their significance.
While there has been no formal evaluation, the Planning Office
inspected the house and found it to be a fairly typical one story
organic style house, common from the 1950's and 60's. In
addition, Fritz Benedict was contacted and stated he saw no
particular architectural significance to this house indicating
that it should be preserved. Consequently, we do not believe the
structure should be preserved.
We would like to bring to the attention of the applicant that 7th
Street may handle an increased volume of traffic if the Meadows
property is developed. We have identified nothing that the City
should do in preparation for added traffic that effects this
property ( for example, adequate right-of-way exists) . But the
applicant may desire to design the house and landscape scheme
with this concern in mind.
ADVISORY COMMITTEE VOTE: This application has been treated as an
expedited review and no Planning and Zoning Commission review has
been conducted.
RECOMMENDED MOTION:
"Move to grant subdivision exception and GMP exemption for
the North Street Lot Split, subject to the following
conditions:
1) A subdivision exception plat conforming to Section 20-
15 and 20-16 of the Municipal Code and to be approved
by the City Engineer shall be filed with the County
Clerk and Recorder's Office. Included on the plat
shall be a statement meeting the provisions of Section
24-11 .2 (d) (4) .

2) A statement of subdivision exception shall be filed
with the County Clerk and Recorder's Office to the
satisfaction of the City Attorney.
3) The applicant shall agree to join any future improve-
ment districts that would encompass this property in
the event they are formed. This agreement shall be
included in the statement of subdivision exception.
4) Removal and relocation of trees must be done in
accordance with Section 13-76 of the Municipal Code.

(1) The tract of land is not located in a subdivision
approved by either the Board of County Commis-
sioners or City Council; or the tract of land is
described as a metes and bounds parcel which has
not been subdivided after the adoption of subdivi-
nion regulations by the City of Aspen on March;24,
1969. Any tract of land granted a subdivision
exemption by the City Council after January 1,
1984, shall be eligibile for a lot split GMP
exemption if all other applicable Code provisions
are satisfied;
(2) No more than two (2) lots were created by the
subdivision;
(3) The lot under consideration, or any part thereof,
was not previously the subject of an exemption
under the provisions of this section or a "lot
split" exception or exemption pursuant to Section
20-19.
(4) A subdivision plat is submitted and recorded by
the applicant after City approval indicating that
no further subdivision may be granted for these
lots nor additional units be built without receipt
of applicable approvals pursuant to Chapter 20 and
an allocation pursuant to Section 24-11.1.
(5) The application was reviewed by the City Council
at a public hearing held pursuant to the standards
of Sections 24-12.5(c)(1) and (2).
If any section, subsection, sentence, clause, phrase or
portion of this Ordinance is for any reason boAll .iavalid---or
unconstitutional, by any court of competent* such

RE: Subdivision Exception for the North Street Subdivision
Dear Council Members:
This application requests an exception from the full subdivision
process pursuant to Sec. 20-19(c) of the Aspen Municipal Code for Lots
A, B, C, D, E and F; Block 14 of the city and townsite of Aspen, Pitkin
County, Colorado. The new parcels shall be known as Lots 1 and 2, North
Street Subdivision, (see attached subdivision exception map) and each
new lot will be approximately 8,987.5 sq.ft.
The applicant intends to demolish the existing single family
residence and construct one new single family residence on each new lot
in compliance with the current zoning and building codes of the city of
Aspen.
Although this application is for an exception from subdivision, it
meets the intent of the subdivision regulations. There will be no adverse
effect on the existing water, sewer, storm drainage, electric, natural
gas or telephone systems. This exception will not be a detriment to
the public welfare or injurious to other properties in the area. The
new lot sizes are larger than required in the R-6 zone (6,000 sq_.ft.
required.) Setbacks will be consistant with the R-6 zone. Off-street
parking will be provided at a ratio of 1 car/bedroom. All existing
trees larger than 6" in diameter measured V -6" above grade will be
conserved.
