Request is hereby made on behalf of Theodore B. Okie,
Trustee of the Theodore B. Okie Children's Trust ( hereinafter
referred to as "applicant") under §20-19 (a) of the Aspen,
Colorado, subdivision regulations for an exemption from the
definition of the term "subdivision" with respect to real
property described as

Pitkin County, Colorado
An exemption in this case would be appropriate.
The application involves subdivision of an existing
structure. Requiring strict compliance with subdivision regu-
lations for the subdivision of a lot with a seven (7) unit
apartment on it creates conditions which will deprive the
applicant of reasonable use of land. If an exemption is
granted, owners of the property will have a common interest in
the land; and there will be either a condominium declaration
or use and occupancy agreement applicable to the property which
will not in any way increase the land use impact of the property.
An exemption in this case will not conflict with the intent
and purpose of the subdivision regulations which are directed
to assist the orderly, efficient and integrated development of
the City of Aspen, to ensure the proper distribution of
population, to coordinate the need for public services and to
encourage well planned subdivisions.
The granting of this application will not undermine the
intent of the subdivision regulations, as it is clearly within
the area intended for exemption under §20-19. The building is
already in existence; there will be no change in the density
which is presently in line with the prescribed population
density for the property.
Follow-up letter addressing Ordinance 39 compliance
will follow.
The applicant would appreciate your consideration of
this application at your next regular meeting.

Having reviewed the above application for subdivision exemption
and made a site inspection, the Engineering Department recommends
the following:
This application for the purpose of condominiumization should be
treated as an exception procedure eliminating conceptual approval
before Council and preliminary approval before the Planning and Zoning
Commission. The Engineering Department recommends conceptual approval
of the improvement survey as submitted and that the owner/applicant
supply the following information prior to final approval before
Council:
1) The owner/applicant shall revise and resubmit the improvement
survey to include the following:
a) Show existing curb and gutter on Hopkins Street.
b) Existing utility lines and meter locations.
c) Common areas (trash facility, open space, etc.) .
d) Indicate zone district.
e) Disclosure of ownership.
2) The owner/applicant shall supply schematic floor plans
and cross -sections indicating the following:
a) Individual units.
b) Common elements (mechanical rooms, utility areas, entry-
ways, etc.).
c) Elevations of floors and ceilings.
d) Limited elements for each unit (storage, etc.).
3) Owner/applicant shall agree to enter into a sidewalk im-
provement district in the event one is formed.
4) Owner/applicant shall provide adequate on -site trash faci-
lities for all seven units.
The Engineering Department recommends conceptual approval at
this time provided the onwer/applicant supplies the above information
prior to final presentation to Council.

This letter will address the Ordinance 39 questions
that are raised whenever an existing structure is condo-
miniumized. The property in .question contains seven units.
A three -bedroom unit of 1,290 square feet; four one -bedroom
apartments of 400 square feet each and two studio apartments
of 330 square feet each. The rental history reflects a
rental for each unit as follows:
One one -bedroom, $330.00 per month; three one -bedrooms,
$300.00 per month; the two studios rent for $275.00 per month
and the three -bedroom rents for $525.00 per month. Under
the present guidelines, only the three -bedroom unit would
fall within the low -moderate, middle income guidelines as
set by Ordinance 39.
Because the applicant intends to do extensive
remodeling to the three -bedroom unit, he would be willing
to rent restrict two of the other units for a five year
period instead of the one three -bedroom unit. This would
allow the applicant to do a total renovation of the
three -bedroom unit and at the same time preserve the spirit
of Ordinance 39 thereby granting five year set rents for
two units.
