Aspen (Smuggler Street between 5th and 6th)
Lot Size: 18,000 square feet
Application This application is for subdivision exception to permit
Request: waiver of conceptual plan review by City Council and
preliminary plat review by P & Z. The applicant requests
splitting off of Lots K, L and M, which are presently
undeveloped, from Lots N, 0 and P, which presently contain
a condominiumized duplex. Said lot split is subject to
the provisions of Section 20-19 of the Municipal Code
under which subdivision exception may be granted when
undue hardship will result from strict compliance with the
full subdivision procedure. Since the subject property
is located in a residential neighborhood the applicant
feels that the granting of the exception will not be
detrimental to the public welfare or injurious to other
property in the vicinity of the site. As provided under
Section 24-11.2 of the Code, following approval of the
subdivision exception, applicant would be eligible to
construct one single family residence outside of the
GMP process. Exception to GMP review would be due to
the original lot having a pre-existing dwelling and as
a result of no more than two lots being created by this
subdivision.
Engineering The Engineering Department states that the condominium plat

P & Z Action: At its regular meeting on January 6, 1981, the Aspen
Planning and Zoning Commission recommended approval of the
applicant's request for subdivision exception. P & Z
concurred with the one condition contained in the Planning
Office recommendation shown above.
Council Action: Should Council concur with the Planning Office and P & Z's
recommendation, the appropriate motion is as follows:
"I move to except the Oliver -Carr Subdivision from full
compliance with the subdivision regulations for purposes
of condominiumization subject to the following condition:
- The applicant's submission of a revised plat to the
Engineering Department reflecting the deletion of
Lots K, L and M from the common elements of the existing
condominium project. The revised plat should be sub-
mitted to Engineering following final approval of this
application by City Council."

Gentlemen,
On behalf of Michael Oliver, application is made pur-
suant to Section 20-19 for an exception from strict applica-
tions of the provisions of Chapter 20 for the splitting off
of Lots K, L and M, Block 20 from Lots N, 0 and P, Block 20.
Presently, Lots K, L, M, N, 0 and P, Block 20 are subject to
the Condominium Declaration of Oliver -Carr Condominiums.
Michael Oliver was the developer of the condominiums and he
reserved the right in paragraph 28 of the Condominium De-
claration for the Oliver -Carr Condominiums to develop Lots
K, L and M. I am enclosing copies of the Condominium Declara-
tion for verification of that statement.
I am also enclosing three copies of the Condominium Map
of the Oliver -Carr Condominium which actually reflects the
state of the improvements on the property. If this Map is
not sufficient for purposes of this application, please
contact me and it will be revised.
Obviously, upon approval by the Planning and Zoning
Commission and City Counsel, the condominium plat will be
amended to reflect the deletion of Lots K, L and M from the
common elements of the condominium project.
Please advise me as to whether any additional informa-
tion is required by the City in furtherance of this applica-
tion and also of the scheduling for the hearing before the
Planning and Zoning Commission.

Having reviewed the above application for subdivision exception, and made
a site inspection, the Engineering Department has the following comments:
1. The condominium plat as submitted is an adequate conceptual
subdivision application. Since the subdivision represents the
re-establishment of a prior lot line, an exception procedure
eliminating conceptual review before Council and preliminary
before the Planning & Zoning Commission would be appropriate.
2. The applicant shall, as stated in the application, submit a
revised plat upon final approval.
3. In the event a duplex is constructed on Lots k, 1, and m,
condominiumization of the stucture would require further
submission of a condominium plat.
The Engineering Department has no particular problems with the lot split
as presented and recommends conceptual approval at this time.

OLIVER-CARR CONDOMINIUMS
(A Condominium)
WHEREAS, the undersigned is the owner of Lots K, L,
M, N, O and P, Block 20, City and Townsite of Aspen, Pitkin
County, Colorado; and
WHEREAS, the undersigned has filed a condominium map
for the Oliver -Carr Condominiums which is recorded in Book
at Page( of the records of Pitkin County and has
submitted Lots N, O and P, Block 20, City and Townsite of Aspen
to a Condominium Declaration for the Oliver -Carr Condominiums
which is recorded in Book ? S at Page �.�j ; and
WHEREAS, it was not the undersigned's intention to
submit all six lots referred to above to the condominium map
and Condominium Declaration referred to above, but such action
is required for compliance with the City of Aspen Subdivision
Regulations; and
WHEREAS, it is the intention and the desire of the
undersigned to develop at some future point in time Lots K, L,
and M, Block 20, City and Townsite of Aspen with a single family
residence or duplex structure as permitted by the Zoning Ordinances,
Subdivision Regulations, and Growth Management Plan of the City
of Aspen in effect from time to time; and
WHEREAS, the Condominium Declaration for the Oliver -Carr
Condominium must be amended to provide for the additional sub-
mittal of Lots K, L and M, Block 20, City and Townsite of Aspen,
NOW THEREFORE the Condominium Declaration for the
Oliver -Carr Condominiums is hereby amended as follows:
1. Paragraph 1(f) is amended as follows:
l(f) "Common Elements" means: (i) all of the
Real Property excluding that portion shown on
the Condominium Maps as Lots K, L and M, Block 20,
City and Townsite of Aspen; (ii) the foundations,
columns, girders, beams, supports, main walls,

roofs and crawlspaces contained in each of the
building improvements which are the subject of
this Declaration, and the "party wall" dividing
Units A and B as shown on the Condominium Map;
(iii) the installations in such buildings
consisting of the equipment and materials making
up the central services such as tanks, pumps,
motors, fans, compressors, ducts, power, sewer,
light, gas, hot and cold water, heating, ventila-
ting and air conditioning and, in general, all
apparatus and installations existing for common
use; and (iv) all other parts of the Duplex
necessary or convenient to its existence, main-
tenance and safety or normally in common use.
Paragraph 1(h) is amended as follows:
1(h) "Real Property" means Lots K, L, M, N, O
and P, Block 20, City and Townsite of Aspen.
Paragraph 28 shall be added as follows:
28. Future Development: (i) Declarant hereby
reserves the right to develop at his sole cost,
and for his sole benefit and profit, Lots K, L,
and M, Block 20, City and Townsite of Aspen,
with a single family residence or duplex structure
as may be allowed under the applicable zoning
ordinances, subdivision regulations, or growth
management plans of the City of Aspen in effect
from time to time. Said right to develop shall
be fully assignable.
(ii) The Owners of Unit A and Unit B shall
have no right to use of any of Lots K, L, and
M, Block 20, City and Townsite of Aspen, for any
purpose. Any expense incurred in connection with
Lots K, L, and M, Block 20, City and Townsite of
Aspen, including real property taxes and special
assessments shall not be deemed to be a common
expense of the project, but shall be paid by the
declarant or the assignee of the development rights
reserved herein. The declarant shall notify the
assessor of Pitkin County that aforesaid lots
shall be assessed separately to the declarant
or his assigns.
Paragraph 29 shall be added as follows:
29. In the event that the undersigned develops
Lots K, L, and M, Block 20, City and Townsite
of Aspen, the improvements constructed thereon
shall be subject to all of the terms and conditions
of this Declaration and of a Supplemental Declara-
tion, and the condominium units therein shall
be subject to condominium ownership with all the
incidence pertaining thereto as specified herein,
upon placing the Supplemental Condominium Map
and Supplemental Condominium Declaration of public
record in the Pitkin County, real estate records.
