'~Jl ..!:>. f, -, ".~ ,""'. N {D STATEMENT OF EXCEPTION FROM FOR THE PURPOSE OF l,lfe WHEREAS, patricia R. McFarlin, Clyde E. McFarlin, Robert W. Andrews and Jane Andrews (hereinafter "Applicant") are the owners of a parcel of real property (and the improvements thereon) more particularly described as follows: See Exhibit "A" attached hereto and incorporated herein by this reference. also known as 410-414 North Mill Street, Aspen, Colorado 81611; and WHEREAS, applicant has requested an exception pursuant to Section 20-19(a), Aspen Municipal Code, as amended, from the full subdivision process for the purpose of condominiumizing the sub- ject property (including the improvements thereon, being a 12-unit building and an 8-unit building); and WHEREAS, the Aspen Planning and Zoning Commission at its meeting of April 6, 1982, determined that such exception would be appropriate and recommended that the same be granted, subject, however, to certain conditions; and WHEREAS, the City Council determined at its meeting of April 12, 1982, that the Applicant's request for such exception was appropriate and granted said request, subject, however, to certain conditions; NOW, THEREFORE, the City Council of Aspen, Colorado, does determine that the Applicant's application for exception from the full subdivision process for the purpose of condominiumization of THE ANDREWS-McFARLIN BUILDING is proper because the Applicant's proposed condominiumization is within the requirements of Section 20-19(a) of the subdivision ordinance and hereby grants, for such reason, an exception from the full subdivision process for such condominiumization; PROVIDED, HOWEVER, that the foregoing exception is expressly . conditioned o~ the Applicant's' strict compliance, for themselves, their heirs, personal representatives, successors and assigns, -''''1 ...._~--'" roOK 443 rAGE 515 with the obligations contained in that certain "Declaration of Grants, Covenants, Conditions and Restrictions Establishing a Plan for Condominiumization Ownership of Andrews-McFarlin Condominium", recorded in Book 'ff '3 Colorado, on ~ ditions of approval on Page ~ of the records of pitkin County, /5 , 1983, and all other binding con- this condominiumization set by the Planning and Zoning Commission and/or City Council.
