SUMMARY: The property owners of Lot 18 and 19 of Block 103,
Hallam's Addition seek to adjust the common property boundary with
a lot line adjustment.
BACKGROUND: During the construction of the new residence on Lot
19 a discrepancy between the survey work conducted on behalf of
each owner was discovered. The discrepancy involved the street
side (front) common corner pin between the two properties. As a
result the common property line in the front of the properties did
not close. The property owners have decided to split the
difference and file a property line agreement plat.
CURRENT ISSUES: Pursuant to Section 24-7-1003, the following
criteria for a lot line adjustment are as follows:
1. It is demonstrated that the request is to correct an
engineering or survey error in a recorded plat or is to permit
an insubstantial boundary change between adjacent parcels.
RESPONSE: This is an insubstantial change in the boundary between
lots 18 and 19. It is apparent that a survey error led to this
problem.
2. Both landowners whose lot lines are being adjusted provide
written consent to the application.
RESPONSE: Both Peter and Jonathan Lewis owners of Lot 18 and Lloyd
Schermer the owner of Lot 19 have provided written consent for this
adjustment.
3. It is demonstrated that the request is to address specific
hardship.
RESPONSE: The adjustment is necessary to clear up the property
boundary that was incorrectly surveyed.
4. The corrected plat will meet the standards of this division,
and conform to the requirements of this chapter, including
the dimensional requirements of the Zone District in which
the lots are located, except in cases of an existing
nonconforming lot, in which the adjustment shall not increase
the non -conformity of the lot.
RESPONSE: A boundary adjustment plat will be recorded. The
Engineering Department has reviewed the draft plat. The Department
made several recommendations that should be complied with prior to
filing the final plat. A final plat shall be reviewed and approved
by the Engineering Department and Planning Department. The plat
must be recorded with the Pitkin County Clerk and Recorder within
180 days of final approval of this lot line adjustment or this
approval is void.
5. It is demonstrated that the lot line adjustment will not
affect the development rights or permitted density of the
affected lots by providing the opportunity to create a new
lot for resale or development.
RESPONSE: The lot line adjustment will not impact development
rights or density of any of the properties involved.
RECOMMENDATION: Staff recommends approval of the lot line
adjustment between Lots 18 and 19 of Block 103 Hallam's Addition,
Aspen, with the following conditions:
1. The final plat shall contain title certificates to verify that
the indicated owners are the owners of record.
2. The final plat shall contain City Planning Director and City
Engineer certificates.
3. The final plat shall contain a note stating that there are many
improvements on the property, including but not limited to
residential structures, that are not indicated on the plat. The
property owner certificate shall also reflect their willingness to
sign a boundary agreement plat that does not show structures and
other improvements.
Suggested language for property owner certificate:
The undersigned acknowledge that this boundary agreement
plat meets their mutual needs and that it is not
necessary to indicate existing structures and
improvements.
4. An adjustment plat shall be reviewed and approved by the
Engineering and Planning Departments and shall be filed within 180
days of final approval and shall include the adjusted lot line as
represented on the survey submitted with the lot line adjustment
application.
Pursuant to Section 24-7-1003, I hereby
approve the Schermer/Lewis lot line
adjustment for Lots 18 and 19, Block 103,

Having reviewed the above referenced application, the Engineering Department has the
following comments:
1. The final plat should contain title certificates to verify that the indicated owners are
the owners of record.
2. The final plat should contain City Planning Director and City Engineer certificates.
3. The final plat should contain a note stating that there are many improvements on the
property, including but not limited to residential structures, that are not indicated on the
plat. It would be the Engineering Department preference for the plat to show all of the
existing improvements. This would clarify for the property owners what it is that they are
agreeing to for the boundary adjustment line. However, if such a requirement would be
onerous and if the property owners agree, then the property owner certificate also should
reflect their willingness to sign a boundary agreement plat that does not show structures
and other improvements.
Suggested language for property owner certificate:
The undersigned acknowledge that this boundary agreement plat meets their
mutual needs and that it is not necessary to indicate existing structures and
improvements.

This application for lot line adjustment is being submitted on behalf of the owners of
the above mentioned properties. During the construction of the new residence on
Lot 19 a discrepancy between the survey work conducted on behalf of each owner

between the two properties. To resolve this dispute the owners have agreed to split
the difference with a new comprise line (new property line). Please see attached
survey.
This lot line discrepancy was discussed last year with Diane Moore and the owners
are now ready to resolve it. Attached are the required application form and
submission requirements. A copy of the proposed boundary line agreement is
enclosed for your review. A mylar copy will be submitted upon your approval. Lot
19 is owned by the Schermers. The city planning office has ownership information in
it's files for this property. Lot 19 (210 Lake Ave.) went through an HPC approval last
year. Please call me with any questions or additional requirements.
