RECITALS Marshall is the owner of the real property described as follows: Lot 1, in Block 6 and the South one-half('h) of Dale Avenue lying between Riverside Addition and Park Avenue lying between Park Avenue and Riverside Avenue adjacent to said Lot 1, all in Riverside Addition to the City and Townsite of Aspen. A portion of the Marshall property is improved with a public road as same exists in place. This portion of the property is described as Parcel "A" on Exhibit "A" attached hereto and is designated Parcel "A" on the Map attached hereto as Exhibit "B". Marshall has agreed to dedicate the property described on Exhibit "A" for public roadway purposes under the terms and conditions set forth below. 1. Roadwav Dedication A. Marshall is the owner of the property described on Exhibit "A" attached hereto and designated as Parcel "A" on Map attached hereto as Exhibit "B". The land being granted is shown on Exhibit "A" as the land dedication. Marshall hereby grants, dedicates and conveys unto the City of Aspen, a municipal corporation, to hold in trust for the public, the property described on Exhibit "A" for the purpose of a public road right-of-way and utility easement. B. Marshall being the sole owner of the real property does hereby grant and convey that property described on Exhibit "A" attached hereto unto said City of Aspen, a municipal corporation. This grant and dedication is made upon the condition that said strip of land shall be forever kept open and used as a public road right-of-way and utility easements, and that the actual pavement of any public road and use of the land hereby dedicated, shall be limited as much as is practicable, as determined bv the engineer. to the existing paved roadway as in place. This conveyance is made for the purpose of a public road and utility easements to the City of Aspen, a municipal corporation when said strip is no longer so used, it shall revert to the grantors as said strip is shown hereon. It is further agreed by Marshall and the City of Aspen that for purposes of determining the floor area ratio of the Marshall property, that the square footage of the property described on Exhibit" A" shall be included in the square footage of the Marshall property for purposes of calculating the allowable floor area ratio pursuant to the Aspen Municipal Code. 11111111111111111111111\\11111\1111111\ III 11\1\\11\1111 439049 12/29/1999 03:06P DEDICATI DAVIS SILVI 1 of ! The rightto establish grades and to bring the dedicated private road into conformity with all City regulations and specifications is hereby granted to the City of Aspen, and all claims for damages which may arise by reason of changing the present surface of said street to conform to said grades or street improvement required to be made to conform to said regulations and specifications are hereby waived. D. This dedication of the private road easement for a public road right-of-way and utility easements may be executed in counter parts, the recording of said counter parts being shown hereon, all of which when taken together shall be deemed to be as effective as if all parties had executed this one original document. 2. Acceptance bv the Citv of Aspen. The Dedication as described above is hereby accepted by the City of Aspen under the terms and conditions contained herein. 3. Heirs and Assigns. The terms, conditions and obligations shall be deemed to run with the land and be binding upon the heirs, executors and assigns of the parties hereto.
