SUMMARY: The Planning Office recommends approval of the requested
condominiumization plat amendment.
LOCATION: 926 E. Waters, Lots P and Q, Block 119, City and Townsite
of Aspen.
ZONING: R-MF
APPLICANT'S REQUEST: The Chateau Snow Condominium Association
requests approval of a condominiumization plat amendment plat amend-
ment for the enclosure of eight (8) decks and/or patios.
BACKGROUND: The condominium map of the Chateau Snow was filed with
the County Clerk and Recorder on February 5, 1970. This was accom-
plished prior to the City's condominiumization ordinance, first
adopted in 1977, and was exempt from City approvaL The Board of
Adjustment granted a variance of PAR for the deck and patio enclosures
on Pebruary 21, 1985 (see Resolution No. 85-3 attached).
APPLICABLE SECTIONS OF MUNICIPAL CODE: Section 20-22 of the ~lunicipal
Code establishes the standards for condominiumizing a building.
Section 20-l9(c) states the standards for a subdivision exception by
which this application has been given an expedited (Council only)
review, including a finding that no land use impacts are associated
wi th the proposal and the review by P&Z would be redundant and serve
no publ ic purpose.
PROBLEM DISCUSSION: The proposed amendment does not appear to effect
any of the issues of a ne~1 condominiumization. The purpose of the
appl ication is to record an accurate plat showing the actual in-
dividual unit air spaces and the Limited and General Common El ement
areas.
The Engineering Department noted in a memorandum of May 1, 1986, that
the signature blocks should be corrected.

ADVISORY COMMITTEE VOTE: This case has been treated as an expedited
review and has not been reviewed by the Planning Commission. As
mentioned, the Board of Adjustment granted a variance for the project
on February 5, 1986.
RECOMMENDED MOTION: "Move to approve the requested subdivision
exception for the purpose of a condominium plat amendment for the
Chateau Snow subject to the fOllowing condition:
An amended condominiumization plat shall be filed with the County
Clerk and Recorder to the satisfaction of the Engineering
Department and speci fically del eting the signature block f or the
Planning and Zoning Commission Chairman and adding the signature
block for the City Engineer."

Dear Steve,
As we discussed last month, Chateau Snow Condominium
Association was granted the right to enclose 8 decks and/or
patios by the Board of Adjustment on February 21, 1985. I
enclose a copy of that Resolution. Pursuant to that ruling,
the Association obtained a building permit in September, 1985
and certificate of occupancy in December, 1985.
Our intention now is to conform the recorded Condominium
Map to the actual building and reflect the change in
designation of Limited Common Elements to individual air spaces
of individual units. I enclose the proposed Amendment to the
Condominium Map of Chateau Snow. I have a duplicate mylar if
needed.
I also enclose a check for $680.00 payable to the City of
Aspen. It is my understanding that this fee is based on an
estimated 5 hours work which will be refunded at the rate of
$135.00 an hour for time not expended. Please let me know how
I may help you to keep these costs down.
Please set this matter on the City Council agenoa and let
me know the date. Thanks for your help.

OF THE
BOARD OF ADJUSTMENT
CITY OF ASPEN, STATE OF COLORADO
Resolution #85-3
WHEREAS, Application No.85-1 was made by the Chateau Snow
Condominium Association and Application was heard and approved
by the Board of Adjustment on February 21, 1985.
WHEREAS the Board specifically finds that the applicant is
experiencing practical difficulty and unnecessary hardship as
set forth in the application as presented.
WHEREAS the Board incorporates the minutes of the
February 14, 1985 and February 21, 1985 hearings in this
Resolution and finds that: the special conditions and
circumstances of this application do not result from the
actions of the applicant; that special or extraordinary
circumstances applied to the subject property do not apply
similarly to other properties in the same vicinity or zone;
that the applicant is being denied a property right and the
granting of the variance is essential to the enjoyment of a
substantial property right enjoyed by other properties, but
denied the subject property because of the special conditions
or extraordinary circumstances; that the minimum variance to
accomplish the preservation of the building is requested; that
the applicant has attempted to remedy this situation for a
period of 10 years with many and various legal alternatives and
is now without reasonable legal alternative to remedy the
unnecessary hardship or practical difficulty.
NOW, THEREFORE, BE IT RESOLVED; the Board of Adjustment
grants a variance of the F.A.R. otherwise obtaining with
respect to Chateau Snow Condominiums to allow the applicant the
right to enclose all the existing decks and/or patios of the
ground floor, and second and third floors to the existing
footprint and perimeters of each.
