Aspen Employee Housing No. 1- Subdivision Exception

This application for a subdivision exception was filed by Monroe
Summers on behalf of the City of Aspen. It involves several technical
changes to the recorded plat for the subdivision known as Aspen Employee
Housing No.1. The changes include:
1. Title Statement;
2. Surveyors Certificate;
3. Council Approval;
4. Vicinity Map; and
5. City engineers Approval.
These technical changes are necessary solely to satisfy the require-
ments of Stewart Title Company and do not involve any planning issues.
The Engineering Department and City Attorney's Office support the
application. Their comments are attached.
We recommend that you approve the Aspen Employee Housing No. 1
Subdivision Exception with the following motion:
"Move to approve the Aspen Employee Housing No. 1
Subdivision Exception subject to the approval of
the City Engineer prior to recording."

Re: Aspen Employee Housing No. 1 Subdivision
Dear Alan:
Please accept this letter as an application, on behalf of the City
of Aspen, for review and approval of an amended map of the refer-
enced subdivision.
This application is made pursuant to Sections 20-21(a) and 20-
19(c) of the Aspen Municipal Code, as amended. Further, the
applicant requests expedited review of this matter, pursuant to
Ordinance No. 16-1983, for the following reasons:
1. The changes to the recorded plat are being done to satisfy
the requirements of Stewart Title Company of Aspen, which has
issued title commitments for the sale of two of the condominium
units on the property.
2. The changes are largely technical in nature -- requiring
certain forms of certificates and acknowledgements.
3. There are, upon information and belief, no substantive
changes to the descriptions of the two lots involved or to their
respective rights, restrictions or encumbrances as a result of the
requested changes.
4. The changes involve changes to language and mapping of the
plat and, as such, are primarily reviewable by the engineering
department and have no planning impact.
5. The subdivision is completely developed with four (4) condo-
minium units and this action will clear title to all four units,
according to Stewart Title.
Enclosed are the required number of copies of the revised plat.

This appears to be an appropriate application for expedited sub-
division exception review.
Because this approval is being sought largely to satisfy Stewart
Title Company, which has issued title commitments on some of the
condo units, I've sent a copy of the plat to them for their
review.
I do note that the ownership certificate appears to be incomplete.
Although the City had title to the property at the time of the
original subdivision, title is now held by at least four parties
and an ownership certificate should be signed by all of the owners
and possibly all of the mortgagees.
The plat changes appear to be mostly to satisfy technical engi-
neering and platting requirements and I can see no open legal
issues at this time.

Having reviewed the above application, the Engineering
Department has the following comments:
I. The purpose of this plat is to provide certificates
which were lacking on the original platting, and to
complete the documentation of monuments found and set.
2. The plat is in good order with the exception of some
language changes which need to be made as followson Sheet
1:
a. Beneath the Title, change the word "supersedes"
to lIamends.1I
b. In the Certificate of Ownership, change the
wording to read ". , , have by these presents
amended the plat titled "Aspen Employee Housing
No.1" which is recorded in Book 9 at Page 69
in the pitkin County Clerk and Recorder Office."
c. In the City approval certificate, change the
word "supersedes" to "amend" and add the title
"City Clerk" beneath the attestation line.
