The applicant, Rick Head, is asking that you review the record associated
with a parcel of land to confirm that it is a non -conforming lot
of record. The City Attorney has suggested that this application
be processed as a subdivision exception.
The question of
the
formation of the parcel owned
by
Rick Head in
Block 30, City
and
Tow nsite
of Aspen was raised as a
result of an
application for
variance that
was made at the Board
of
Adjustments.
The parcel consists
of Lots
D and the west 1/2 of
Lot
E for a total
of 4500 square
feet
in the
R-6 zone. The minimum
lot
size in the
R-6 zone is 6000
s.f., making
this a non -conforming lot.
A plat was not submitted with the application, however, an improvement
survey shows the structure to be non -conforming on two sides in terms
of setback requirements. This is not a significant fact in terms
of recognizing this lot as a non -conforming lot of record, but it
is worthwhile to note in this review.
The Engineering Department felt that they would have more information
if a formal plat was filed with the application and recorded following
the review. Since this application is for exemption from subdivision,
a plat is not required. The City Attorney and the applicant both
asked for this subdivision exemption review so that the history of
the lot (and its status as a legitimate lot) could be made a part
of the public record.
The chain of title is as follows:
1. On October 25, 1957, by deed recorded in Book 182 at Page
462 of the Pitkin County, Colorado records, Albert P. and
Nadene P. Johnson ("Johnsons") acquired title to Lots E,
F and G in Block 30;
2. On September 30, 1957, by deed recorded in Book 182 at
Page 463 of. the Pitkin County, Colorado records, the Johnsons
acquired title to Lot D in Block 30;
3. On October 29, 1957, by quitclaim (Mayor's) deed recorded
in Book 182 at Page 483 of the Pitkin County, Colorado
records, the City of Aspen quitclaimed to the Johnsons
any interest it may have had in Lots D, E, F and G, Block
30;
4. On September 13, 1960, by deed recorded in Book 191 at
Page 540 of the Pitkin County, Colorado records, the Johnsons
conveyed title to Lot D and the west 1/2 of Lot E to Frances
L. Higbie ("Higbie");
5. On February 6, 1984, by deed recorded in Book 191 at Page
591 of. the Pitkin County, Colorado records, the Johnsons
conveyed title to Lots F, G and the east 1/2 of Lot E to
Clyde and Alberta Bowlby;
6. On February 6, 1964, by deed recorded in Book 206 at Page
89 of. the Pitkin County, Colorado records, Higbie conveyed
Lot D and the west 1/2 of Lot E to Mabel Carter ("Carter");
7. On April 5, 1966, by deed recorded in Book 220 at Page

36 of the Pitkin County, Colorado records, Carter conveyed
Lot D and the west 1/2 of Lot E to Bette F. Gallagher ("Gal-
lagher") ;
8. On May 24, 1974, by deed recorded in Book 288 at Page 757
of the Pitkin County, Colorado records, Gallagher conveyed
Lot D and the west 1/2 of Lot E to Beatrice and Gary Johnson;
9. On December 15, 1975, by deed recorded in Book 306 at Page
753 of the Pitkin County, Colorado records, Beatrice and
Gary Johnson conveyed title to Lot D and the west 1/2 of
Lot E to Mr. Head.
The lot owned by the applicant has been a lot of record since September
of 1960. The subdivision and conveyance was legal at the time, since
subdivision laws were not instituted until March of 1969. The Municipal
Code defines a non -conforming lot of record in Section 24-13.6 as:
"(a) Where, at the effective date of the adoption of this or
any code or amendment hereto, a lot of record was in separate
ownership and cannot meet the minimum requirements for area
or width, s single-family dwelling and customary accessory buildings
may be erected on any single lot of record provided:
(1) Such lot is in separate ownership and not of continuous
frontage with other lots in the same ownership;
(2) This provision shall apply even though such lot fails
to meet the requirements for area or width, or both, that
are generally applicable in the district, provided that
yard dimensions and requirements other than those applying
to area or width, or both, of the lot shall conform to
the regulations for the district in which the lot is located.
Variances of yard requirements shall be obtained only through
action of the board of adjustment."
Also of significance to this review is proof that Lot C was not owned
by the same person as Lot D, according to Section 24-13.6(d).
"(d) If two (2) or more lots or combination of lots and portions
of lots with continuous frontage in single ownership (including
husband and wife as in all cases a single owner) are of record
at the effective date of adoption or amendment of this zoning
code, regardless of diverse times of acquisition, and if all
or part of the lots do not meet the requirements established
for lot width and area, the lands involved shall be considered
to be an undivided parcel for the purposes of this code, and
no portion of said parcel shall be used or occupied which does
not meet the width and area requirements established by this
code."

The applicant has also
submitted a notarized
statement
from Elizabeth
Fergus, which attests
to her ownership of
Lots A,

30, City and Townsite
of Aspen since June
of 1973.
COUNCIL ACTION
Since the applicant has requested that his parcel be inventoried
and confirmed as a non -conforming lot of record through the public
process, we recommend the following motion:
"I move to submit to the public record Lot D and the west 1/2
of Lot E, Block 30, City and Townsite of Aspen, as a non -conforming
lot of record with the following condition:
1. The applicant agrees to join any future improvement
districts according to the standard form of such commitment

2. Should the applicant choose to record a plat, it must
be approved by the Engineering Department and recorded
within ninety (90) days of City Council approval (as
per Section 20-14[c])."

Having reviewed the above application and having made a site
inspection, the Engineering Department has the following
comments:
1. This is the first review of this nature that I know of to
come to the Engineering Department. The application letter
indicates that this review amy become a model for future, similar
reviews. Therefore, the reviewing agencies must proceed with
the knowledge that this will be a precendent setting review.
2. A plat was not received with this application. In matters
regarding property and boundaries, it is always good to obtain
a surveyor's opinion in the form of a plat. Platting serves such
purposes as installing property corners which assist the Building
Department with setbacks as well as identifying encroachments
which may exist and which can only accurately be determined by
a surveyor. Monumentation is a requirement of subdivision (Sec.
20-15(g) and 20-17(d)). Monumentation also protects a property
owner from encroachment, and associated expenses, onto neighbors
property. Platting provides a recorded document, and the City
Engineering Department also receives a reproducible of the plat.
Neither recording nor Engineering Department records are obtained
with the "lower level" improvement survey required by the Building
Department. With platting, the Engineering Department is better
able to monitor encroachments into the public right-of-way.
If other agencies decide against platting, the Engineering
Department will need to record its approval on the subdivision
exception statement. In this instance, the Engineering Department
will still maintain the requirement that the applicant agree
to join improvement districts per standard language available from
the City Attorney's office.
3. There is an element of subdivision law which was not addressed
in the application which needs to be addressed prior to any
approvals. We were not presented with full histories of adjacent
parcels which are needed in order to confirm that the parcel in
question was never recombined with an adjacent parcel as discussed

in Sec. 20-4(c). If, as stated in the application, the subdivision
laws were effective March 24, 1969, then we should see title
reports on adjacent parcels (Lots C and east � of E, Block
30, O.A.T.) from that time in order to verify that there was
never common ownership with Lots D and west z of E.
4. The applicant is also cautioned that the final plat must be
recorded within 90 days following approval by the City Council
(Sec. 20-14(c).

Forwarded herewith is a copy of an April 17, 1984 letter from Bob
Hughes requesting a waiver of the $680.00 processing fee with
regard to Rick Head's subdivision exemption application. Also
attached is a copy of my reply.
In my view, this application presents an excellent opportunity
to adopt a policy of encouraging all unplatted lots conveyed out
prior to the adoption of the subdivision regulations to be
brought up to the status of "lots of record." As a means of
encouraging such applications I recommend that the processing fee
be waived or "exempted."

I have your letter of April 17 in the above captioned matter.
Although I am recommending that the fees be waived for this type
of application, I feel that your letter is slightly misleading
and therefore, requires the following clarification:
1. The application for subdivision exemption was not made
at my request. Rather, I suggested that the subdivision exemp-
tion process might be used as a vehicle for legitimatizing what
presumptively appears to be a "illegal" lot.
2. I think it is misleading and totally inaccurate to rep-
resent that you only agreed to the process on the "strength of...
assurances and those of the Planning Office that the process
would be 'essentially ministerial and painless'." Nonetheless,
should the Planning Office not follow my recommendation with re-
gard to the fee and should you feel that you and Rick have been
mislead, you can withdraw your application and rely on your
client's rights as you perceive them.
3. I am bothered by your feeling that the application has
been submitted "essentially as an accommodation to the City," re-
quiring needless energy on your part. In an effort to assist
your client, I have probably spent considerably more time on this
matter than you have.
Please don't hesitate to call if you have any questions.

Dear Paul:
On April 6, 1984, at your request, we made application
on behalf of Rick Head for a subdivision exemption for the above -
referenced property of his. A copy of our application is en-
closed. As you will recall from our earlier meeting on the
matter, you had urged us to go ahead with this formality in order
that the status of the property as a non -conforming lot of record
could be suitably confirmed by the City. While I believed at the
time and continue to believe that this process is not necessary
in the circumstances applicable to Rick's property, we nonethe-
less agreed to proceed on the strength of your assurances and
those of the Planning Office that the process would be essen-
tially ministerial and painless. I have now been advised by Alan
Richman that the application we filed is being regarded as
incomplete inasmuch as it was not accompanied by a $680.00
application fee. Such a fee is hardly painless. Furthermore, in
order to prepare the application, Rick has had to procure an
abstract of title at a cost of $170.00 and has had to pay for
approximately 2 hours of attorney's time.
In all the circumstances, and since we have only gone
forward with the application essentially as an accommodation to

the City, I believe that the $680.00 subdivision application fee
should be exempted. I trust that you can seek such an exemption
on the strength of the within request. At the present time, both
I and my client are sufficiently frustrated that neither of us
wants to spend any more time on the matter.

We represent Frederick Head, who is the owner of the
above -referenced property. The property is zoned R-6, is 4500
square feet in area and is improved with a single -story frame
(Victorian) home.
At the request of the City Attorney and of the Planning
Office, who are interested in seeing that the situation below -
described and similar situations be suitably and formally con-
firmed by the City, this letter is intended to serve as the
request of Mr. Head under Section 20-19 of the City Code for an

records, the City of Aspen quit claimed to the Johnsons any
interest it may have had in Lots D, E, F and G, Block 30;
4. On September 1.3, 1960, by deed recorded in Book
191 at Page 540 of the Pitkin County, Colorado records, the
Johnsons conveyed title to Lot D and the west ? of Lot E to
Frances L. Higbie ("Higbie");
5. On September 12, 1960, by deed recorded in Book
191 at Page 591 of the Pitkin County, Colorado records, the
Johnsons conveyed title to Lots F, G and the east ? of Lot E to
Clyde and Alberta Bowlby;
6. On February 6, 1964, by deed recorded in Book 206
at Page 89 of the Pitkin County, Colorado records, Higbie con-
veyed Lot D and the west i of Lot E to Mabel Carter ("Carter");
7. On April 5, 1966, by deed recorded in Book 220 at
Page 36 of the Pitkin County, Colorado records, Carter conveyed
Lot D and the west z of Lot E to Bette F. Gallagher
("Gallagher");
8. On May 24, 1974, by deed recorded in Book 288 at
Page 757 of the Pitkin County, Colorado records, Gallagher
conveyed Lot D and the west �; of Lot E to Beatrice and Gary
Johnson;
9. On December 15, 1975, by deed recorded in Book 306
at Page 753 of the Pitkin County, Colorado records, Beatrice and
Gary Johnson conveyed title to Lot D and the west 3-2 of Lot E to
Mr. Head.

F and G, Block 30 prepared by Stewart Title of Aspen, Inc., dated
March 28, 1984, and bearing number 785TI.
As is clear from the foregoing, Mr. Head's property has
been a lot of record since September of 1960, when Lots D, E, F
and G were split (albeit unequally) and separately conveyed by
the Johnsons who had acquired the lots, in the first instance, at
diverse times. That date, of course, long antedated the effec-
tive date of the City's subdivision laws (March 24, 1969), as
well as the effective date of the adoption of the City Code
(January 1, 1972), and was a perfectly valid division of land at
the time. Hence, we believe Mr. Head's property falls foursquare
within the meaning of a non -conforming lot of record [Section
24-13.6, Aspen Municipal Code]:
"(a) Where, at the effective date of the
adoption of this or any code or amendment
hereto, a lot of record was in separate
ownership and cannot meet the minimum re-
quirements for area or width, a single-family
dwelling and customary accessory buildings
may be erected on any single lot of record
provided:
(1) Such lot is in separate ownership and
not of continuous frontage with other lots in
the same ownership;
(2) This provision shall apply even though
such lot* fails to meet the requirements for
area or width, or both, that are generally
applicable in the district, provided that
yard dimensions and requirements other than
those applying to area or width, or both, of
the lot shall conform to the regulations for
the district in which the lot is located.

And, since the division occurred long before the adoption of the
subdivision laws, it is axiomatic that the division lay outside
the intent and purpose of Chapter 20 of the City Code regarding
subdivisions. A subdivision exemption thus is in order.
