SUMMARY:
The Aspen Consolidated Sanitation District is proposing work in the Roaring
Fork River to construct a grade modification drop structure for the purpose of
protecting a 12" service main from washing-out during peak flows. This drop
structure will alter the erosion pattern of the river to prevent damage to the
existing pipe and will prevent more extensive re-construction work.
Because the work is proposed within the floodway and below the top-of-slope,
this application is subject to Stream Margin Review and Special Review.
Staff recommends approval of the Stream Margin Review and Special
Review for the proposed "Drop Structure," with conditions.

BACKGROUND:
Continual changes in the stream bed has surfaced a portion of the Sanitation
District's infrastructure. "Drop structures" are essentially a series oflarge
boulders placed in the river in a crescent shape and function by slowing the water
locally to prevent further scouring of the river bed. This method has been used in
the Roaring Fork River successfully in the past. An example may be seen just
downstream ofthe new pedestrian bridge at Newberry Park.
STAFF COMMENTS:
Across the river from Herron Park is Creektree Condominimns. There has been
significant erosion along their river bank in the past few run-off seasons. The
owner of one of the units is obviously concerned about further erosion and is
interested in stabilizing the bank this Fall. Because access for their project would
most likely be through Herron Park, the construction schedules for these two
projects should be coordinated to the extent possible. This would limit impacts to
the river, Herron Park, and of the pedestrian path, and would be in the best interest
of the community. Staff suggests the Commission require the applicants of both
projects to coordinate to the extent practical, including contracting for the work.
Review criteria and Staff Findings have been included as Exhibit "A." Agency
referral comments have been included as Exhibit "B." The application has been
included as Exhibit "C."
RECOMMENDATION:
Staff recommends approval of this Stream Margin Review with the following
conditions:
1. For this project, this signed Planning and Zoning Resolution shall act as a building pennit,
enforceable by the Community Development Department. Failure to adhere to the conditions
of this approval shall result in a stop work order.
2. Prior to construction, the applicant shall obtain all necessary approvals from the Anny Corps.
of Engineers. To the extent possible, the Aspen Consolidated Sanitation District shall
coordinate construction schedules and contracting with the bank stabilization project at
Creektree Condominiums involving river disturbance in the Herron Park vicinity.
3. Only one access point to the river shall be used and shall be revegetated with only native
plantings to the approval of the Parks Department.
4. The applicant shall gain approval from the Parks Department and the Engineering Department
for the method of protecting the Rio Grande Trail from damage and the stream bank from
erosion during construction.

5. The applicant shall restore all portions of the Rio Grande Trail (bike path) disturbed as a result
of this project to approval of the Parks Department. This may include, but is not limited to,
repaving, patching, and sweeping.
6. The design Engineer shall perform eonstruction observation and, after construction is
completed, shall provide a signed and stamped letter to the City Engineer stating the project
was built substantially as designed.
7. The applicant shall record this Planning and Zoning Resolution with the County Clerk and
Recorder.
8. All material representations made by the applicant in the application and during public
meetings with the Planning and Zoning Commission shall be adhered to and considered
conditions of approval, unless otherwise amended by other conditions.
RECOMMENDED MOTION:
"1 move to approve the ACSD Stream Margin Review and Special Review for the
proposed drop structure with the conditions outlined in the Staff memo dated
October 7,1997."

STAFF COMMENTS: Stream Margin
Section 26.68.040, Standards Applicable to Development within 100 feet of the Roaring
Fork River and its tributary streams.
A. No development shall be permitted in the floodway, with the exception of bridges or
structures for irrigation, drainage, flood control or water diversion, which may be permitted
by the City Engineer, provided plans and specifications are submitted to demonstrate that
the structure is engineered to prevent blockage of drainage channels during peak flows and
the Commission determines the proposed structure complies, to the extent practical, with all
standards set forth below.
Staff Finding:
Tbis "development" will alter the river's sedimentation and erosion pattems near the
Sanitation District's infrastructure and prevent further damage form scouring during high
run-off periods. The City Engineer may approve of such development if the Commission
determines that the proposal meets, to the extent practical, the stream margin criteria below.
B. No development shall be permitted within one hundred (100) feet, measured horizontally,
from the high water line of the Roaring Fork River and its tributary streams, or within the
Special Flood Hazard Area where it extends beyond 100 feet from the high water line of the
Roaring Fork River and its tributary streams, unless the Commission makes a determination
that the proposed development complies with all standards set forth below:
Staff Finding:
Stream Margin Review is clearly necessary because the development is within the flood
way as stated in A, above. The purpose of this language is to address more typical
development that is not in the floodway but is next to, or near, the river. The Commission
should consider the " to the extent practical" language as stated in A, above.
1. It can be demonstrated that any proposed development which is in the Special Flood
Hazard Area will not increase the base flood elevation on the parcel proposed for
development. This shall be demonstrated by an engineering study prepared by a
professional engineer registered in the State of Colorado which shows that the base flood
elevation will not be raised, including, but not limited to, proposed mitigation techniques on
or off-site which compensate for any base flood elevation increase caused by the
development;
Staff Finding:
A professional Engineer has prepared a HEC-2 analysis of the project and has concluded
that the "drop structure" will cause no significant upstream or downstream effects and will
not affect the stream's velocity. Thestructure will increase the base flood elevation
approximately .21 feet. The Engineering Department has reviewed this analysis and agrees
with the findings that this increase is not significant.

The cover page from the engineering report has been included in the packet. The actual
analysis essentially appears as a long print-out of nwnbers and has not been included.
Commission members who wish to review the full analysis may specifically request a copy
from the Planning Office.
The Engineering Department has requested that the design Engineer be present during
construction and that a stamped and signed letter to the City Engineer be provided stating
the project was constructed substantially as designed.
2. Any trail on the parcel designated on the Aspen Area Community Plan,
Parks/Recreation/Open Spacerrrails Plan Map, or areas of historic public use or access are
dedicated via a recorded easement for public use. Dedications are necessitated by
development's increased impacts to the City's recreation and trail facilities including public
fishing access;
3. The recommendations of the Roaring Fork Greenway Plan are implemented in the proposed
plan for development, to the greatest extent practical;
Staff Finding:
The Rio Grande Trail is across the river from the subject site and no further trails are
planned in the area.
4. There is no vegetation removed or damaged or slope grade changes (cut/fill) made outside
of a specifically defined building envelope. A building envelope shall be designated by this
review and said envelope shall be barricaded prior to issuance of any demolition, excavation
or building permits, The barricades shall remain in place until the issuance of Certificates of
Occupancy;
Staff Findin.g:
A building envelope would be appropriate for construction of a building, but not for placing
boulders in the river. It would be appropriate, however, to designate the limits of
disturbance for this project and to establish sedimentation barriers downstream of the
proposed work. This has been addressed in the following review standard, #5. Also,
because access to the site is through Herron Park, an access corridor to the river should be
designated and barricaded for the duration of construction to the satisfaction of the Parks
Department and the access area should be revegetated to the approval of the Parks
Department. The Commission should make these conditions of approval.
5. . The proposed development does not pollute or interfere with the natural changes of the
river, stream or other tributary, including erosion and/or sedimentation during construction.
Increased on-site drainage shall be accommodated within the parcel to prevent entry into
the river or onto its banks. Pool or hot tubs cannot be drained outside of the designated
building envelope;

Staff Finding:
The purpose of the project is to alter the sedimentation and erosion patterns of the river to
prevent damage to the Sanitation District's infrastructure. The applicant intends to use
sedimentation barriers to limit sedimentation and erosion changes during construction.
Also, the construction schedule has been timed with the end of the trout spawning period to
limit damage to their habitat. The Commission should consider the 'to the extent practical'
language of standard A, above, in relation to the intent of the project.
6. Written notice shall be provided to the Colorado Water ConseNation Board prior to any
alteration or relocation of a water course, and a copy of said notice is submitted to the
Federal Emergency Management Agency;
Staff Finding:
A copy of this notice has been provided by the Planning Department.
7. A guarantee is provided in the event a water course is altered or relocated, that applies to
the developer and his heirs, successors and assigns that ensures that the flood carrying
capacity on the parcel is not diminished;
Staff Finding:
The drop structure is not expected to alter the course of the river. The Army Corps. of
Engineers 404 permit requires the applicant to maintain the development in perpetuity and
remove it if it becomes unnecessary.
8. Copies are provided of all necessary federal and state permits related to the work within the
1 OO-year floodplain; and
Staff Finding:
The applicant is applying for both a nation-wide 404 permit form the Army Corps. of
Engineers. The applicant has approval from the Pitkin County Floodplain Administrator.
These permits are required by the City Engineer. This has been included as a condition of
approval.
9. There is no development other than approved native vegetation planting taking place below
the top of slope or within fifteen (15) feet of the top of slope or the high waterline, whichever
is most restrictive. This is an effort to protect the existing riparian vegetation and bank
stability. If any development is essential within this area, it may only be approved by special
review pursuant to Section 26.64.040(D)

10. All development outside of the fifteen (15) foot setback from the top of siope does not
exceed a height delineated by a line drawn at a forty-five (45) degree angle from ground
level at the top of slope.
Staff Finding:
The applicant will need to revegetate the access areas disturbed by construction equipment.
This vegetation must be native riparian species approved by the Parks Department.
This development is considered essential. Staffhas considered the Special Review
standards on the following page of this section.
Also, heavy equipment access.to the river will most likely be through Herron Park along the
bikeway. The applicant will need to make the appropriate preservation considerations to
limit the extent of damage to the path. This may include covering the path with plywood
sheets or possibly with a temporary layer of road base, and will most likely include either
monitoring or completely blocking pedestrian and bicycle traffic during construction. The
applicant has been discussing the appropriate method with the Parks and Engineering
Departments.
11. A landscape plan is submitted with all development applications.
Staff Finding:
The applicant did not submit a landscape plan with this application. The applicant intends
to revegetate the disturbed areas with native grasses to the satisfaction of the Parks
Department. Staff believes that if this intent is included as a condition of approval, there is
no need to submit a landscape plan.
12. All exterior lighting is low and downcast with no lights directed toward the river or located
down the slope;
Staff Finding:
Does not apply; there are no lights proposed as part of this application.
13. Site sections drawn by a registered architect, landscape architect, or engineer are submitted
showing all existing and proposed site elements, the top-of-slope, and pertinent elevation
above sea level.
Staff Finding:
Site sections prepared by a registered Engineer have been included in the application,
14. There has been accurate identification of wetland and riparian areas.

26.64.040 Review Standards for Special Review
No development subject to Special Review shall be permitted unless the Commission
makes a determination that the proposed development complies with all standards and
requirement set forth below.
D.' . . . . encroachment into fifteen-foot setback from top of slope or height limit. Whenever a
special review is for development above or below grade within the fifteen-foot setback
from top of slope as identified on a site specific section drawing or above the height limit
established by the ESA, the development application shall be approved only if the
following conditions have been met:
1. A unique condition exists on the site where strict adherence to the top of slope
setback will create an unworkable design problem.
Staff Finding:
The proposed development is within the river. This is a unique condition that prohibits strict
adherence to top of slope setback.
2. Any intrusion into the top of slope setback or height limit is minimized to the
greatest extent possible.
Staff Finding:
The proposal is a minimum amount of intrusion and will hopefully limit the amount of future
improvements needed.
3. Other parts of the structure or development on the site are located outside the top
of slope setback line or height limit to the greatest extent possible.
Staff Finding:
The entire "development" proposed is within the river.
4. Landscape treatment is increased to screen the structure or development in the
setback from all adjoining properties.
Staff Finding:
These extra landscape treatments are not necessary.

Aspen Consolidated Sanitation District Stream Margin Review
The Development Review Committee has reviewed the above referenced application at their August 27,
1997 meeting. We have been awaiting the submittal and review of a related stream margin application
called Creektree Condominium Stream Margin Review. The Creektree application was reviewed at the
September 17, 1997, DRC meeting. We now have the following comments for the ACSD application:
I. Boulder Drop Structure - This project is similar to three previous drop structures within City limits
installed by ACSD to protect other wastewater lines crossings the Roaring Fork River. The work is
within an existing easement. The project will be constructed this fall during low water flows.
The drop structure will raise the I DO-year floodplain elevation by about 0.2 I feet. The City
ordinance does not permit any rise in floodplain elevation, but FEMA do not restrict the rise in floodplain
elevation. Since the proposed rise in floodplain does not affect any habitable structures, it is acceptable to
the Engineering Department.
The District is in the process of receiving their permit from the Army Corps of Engineers,
following their approval of river geomorphologic study. The City approval will be based on the District's
ability to receive a permit from the Army Corps. The District has already received a permit from the
County floodplain administrator.
2. Site Access - Access may be through Herron Park. The Parks Department has worked with the
Sanitation District concerning exact access routes and restoration plans as well as tree permits as needed.
Mats will be used on top of the trail for track equipment. A second stream margin review application,
known as Creektree Condominium Stream Margin Review, is being reviewed concurrently with this
application, and their access will bethe same, thereby reducing impacts to both the river and Herron Park.
Restoration work will be performed to Parks and Engineering Departments standards.
3. Contractor - The ACSD's contractor will be Aspen Earthmoving. The condition of approval for the
Creektree Condominium stream margin review application will be that they use the same contractor.
4. Erosion Controls - The area of disturbance must be protected by use of certain devices to minimize
erosion and sediment transport.

5. Construction Certification - The City has experienced one stream flow alteration project where the
improvements failed at a much lower flood event than the 100-year flood return frequency. In order to
prevent recurrence of such failures, we recommend that a condition of approval be that the design
engineer perform construction observation and provide a sealed and signed letter to the City Engineer at
the end of the project that it was constructed substantially as designed.
6. Other Permits - AU permits must be filed at the City Engineering Department prior to start of
construction work.
7. Work in the Public Ril!:ht-of.wav - Given the continuous problems of unapproved work and
development in public rights-of-way adjacent to private property, we advise the applicant as foUows:
The applicant must receive approval from city engineering (920-5080) for design of
improvements, including landscaping, within public rights-of-way, parks department (920-5120) for
vegetation species and for public trail disturbance, and streets department (920-5130) for mailboxes,
street and alley cuts, and shall obtain permits for any work or development, including landscaping, within
public rights-of-way from the city community development department.

The Aspen/Pitkin Enviromnental Health Department has reviewed the land use submittal under
authority of the Municipal Code of the City of Aspen, and has the following comments.
SEW AGE TREATMENT AND COLLECTION: Section 11-1.7 "It shall be unlawful for the owner or occupant of
ariy building used for residence or business purposes within the city to construct or reconstruct an on-site sewage disposal device."
This section is not applicable except to the extent that this work is necessary to allow the district to
provide sewage collection services in a safe manner.
ADEOUATE PROVISIONS FOR WATER NEEDS: Section 23-55 "All buildings, structures, facilities, parks, or
the like within the city limits which use warer shall be connected to the municipal water utility system. II
This section is not applicable.
WATER OU ALITY IMPACTS: Section 11-1.3 "For the purpose of maintaining and protecting its municipal waler supply
from injury and pollution, the city shall exercise regulatory and supervisory jurisdiction within the incorporated limits of the City of Aspen
and over all streams and sources contributing to municipal water supplies for a distance of five (5) miles above the points from which
municipal water supplies are diverted. II
By improving the protection of this sewage collection line from breakage during floods, the
protection of the Roaring Fork River's water quality will be enhanced.
AIR QUALITY: Sections 11-2.1 "It is the purpose of [the air quality section of the Municipal Code] to achieve the maximum
practical degree of air purity possible by requiring the use of all available practical methods and techniques to control, prevent and reduce air
pollution throughout the city...'! The Land Use Regulations seek to "lessen congestion" and "avoid transportation demands that cannot be met"
as well as to "provide clean air by protecting the natural air sheds and reducing pollutantsll.
This project will have no air quality impacts except during construction. The applicant should
make every effort to minimize interference with the bike path at this location, and has indicated
that this will be done.

A fugitive dust control plan is required to prevent mud from being tracked out onto paved roads,
and to prevent any windblown dust from creating a nuisance for neighboring properties. The
plan will need to include, but is not limited to, daily cleaning of adjacent paved roads to remove
mud that has been carried out, and, if nuisance dust becomes a problem, fencing, watering of
disturbed areas, speed limits, or other measures necessary to prevent windblown dust from
crossing the property line or causing a nuisance. Applications can be obtained from the
Environmental Health Department.
CONFORMANCE WITH OTHER ENVIRONMENTAL HEALTH LAWS:
NOISE ABATEMENT: Section 16-1 "The city council finds and declares that noise is a significant source of environmental
pollution that represents a present and increasing threat to the public peace and to the health, safety and welfare of the residents of the City of
Aspen and it its visitors. .....Accordingly, it is the poUcy of council to provide standards for permissible noise levels in various areas and
manners and at various times and to prohibit noise in excess of those levels. I!
During construction, noise can not exceed maximum permissible sound level standards, and
construction cannot be done except between the hours of 7 a,m. and 10 p.m.
It is very likely that noise generated during this project will have some negative impact on the
neighborhood. The applicant should be aware of this and take measures to minimize the
predicted high noise levels, It would be advisable to notify neighbors of the duration and purpose
of the project.

Dear Temple,
The Aspen Consolidated Sanitation District would like to request an Floodplain
Development Permit from the Pitkin County to construct a grade modification drop structure
project in the Roaring Fork River to protect its existing 12" nurln outfall sewer line adjacent to
Herron Park, approximately 350 feet below the Neale Street bridge. The line currently suffers from
inadequate cover as it crosses the river. The purpose of the project is to add 'cover over the pipe
and decrease the chances of a washout during peak flows. The existing pipeline will not be
replaced. .
I have enclosed application packets containing a drawing showing the site location, plan,-
a,nd construction details, a copy of the HEC-2 analysis, and a copy of the pre-application form. from
your office. .
We are in the process of applying concurrently for a 404 permit form the U.S. Army Corps
of Engineers and an insubstantial Stream Margin Review from the City of Aspen. We will keep you
posted as the status of these permits.
The work will be supervised by Allan Czenkusch of the Colorado Division of Wildlife. We
will also work with Mr. Czenkusch to provide stream bank stabilization as required in the-area of
the drop structure. In addition, trout habitat in these areas will also be enhanced. ,
I have enclosed drawings of the project location and typical details of the project
construction and configuration. The project will include a drop consisting of boulders with an
average diameter of 3-4 feet and a maximum diameter of 4-5 feet. Approximately 12-18 inches of
cover material, primarily obtained in the existing river bed, will be placed upstream of the drop
structure to protect the sewer line crossing. .
We do not anticipate an actual increase in the existing water level as described in the
enclosed letter from Leonard Rice Consulting Water Engineers, our Representative of the District.
I have also included the HEC-2 analysis from LRCWE for your review that shows that there will
be no net increase in the base flood elevation in this area.
We are attempting to coordinate our work in the Herron Park area with the Metcalf stream
bank stabilization project and City of Aspen Parks Department projects. Hopefully, all three
projects can be completed at the same time and minimize the impact to the area and potentially
realize some cost savings to each organization at the same time. Construction access to this site
will be off of Neal Street, .il1ong the District's easements and the pedestrian/bike path to the river.
At this point, we do not believe that it will be necessary to close the bicycle path full time during
construction. Very short duration closures will be required when equipment and materials areîbrought on and off the site. FJaggers and waming sigris will be used at t4at time.
During construction there will be disturbance tQ the river bed and the adjacent riparian
areas along the shore. Sedimentation barriers will be constructed along the river edges to reduce
sedimentation transport.

Construction is planned for the late fall of 1997 to avoid the brown trout spawning window
if we are able to receive in a timely manner all the permits from the various entities having
jurisdiction. If this is not possible, the construction will be delayed until late fall of 1998. We will
keep 'you informed on the status of all these permits.
The construction site will be restored as near as possible to pre-construction grading and
conditions, and the site will be re-vegetated.
The District will conduct neighborhood notification through handouts, newspaper
advertisements, and signs on site. Please give me a call if you have any questions.

Dear Mr. Claffy,
Please find enclosed our application for a 404 permit to allow the Aspen Consolidated
Sanitation District to construct a grade modification drop structure project in the Roaring Fork
River, in Aspen CO, to protect its existing 12" main outfall sewer line adjacent to Herron Park. The
line currently suffers from inadequate cover as it crosses the river. The purpose of the project is
to add cover over the pipe and decrease the chances ofa washout during peak flows. .The existing
pipeline will not be replaced. .
As you may recall from our recent site visit, the river has produced a significant scour hole
on the west end of the sewer line crossing west of Herron Park. Although the seWer pipe is not
currently exposed, the line only has a few inches of cover. at present in this location.
The drop structure will JJe built with the assistance of Mr. Allan Czenkusch of the Coiorado
Division of Wildlife. We will also work with Mr. Czenkusch to provide stream bank stabilization
as required in the area of the drop structure. In addition, trout habitat in these areas should also
be enhanced. We anticipate using Kenny Savoy from Aspen Earthmoving to construct the drop
structure.
. I have enclosed drawings of the project locations and typical details of the project
construction and configuration. The project will include a drop consisting of boulders with an
average diameter of 3-4 feet and a maximum diameter of 4-5 feet. Approximately 12-18 inches of
cover material, primarily obtained in the existing river bed, will be placed upstream of the drop
structure to protect the sewer line crossing. We do not anticipate an actual increase in the existing
water level as described in the enclosed letter from Leonard Rice Consulting Water Engineers, our
Representative of the District. I have also included the HEC-2 analysis from LRCWE for ypur
review that shows that there will be no net increase in the baseflood elevation in this area.
As we discussed in our previous meetings, ACSD has hired Noel Potter' from Cross Country
Surveys to profile this area. Kevin O'Connell of Leonard Rice Consulting Water Engineers will
produce the resulting plan and cross sections of the river in this area. We have contacted Mr.
Robert O'Brien, a fluvial geomorphologist, of Water Resources in Evergreen, CO. to review and
modify, if necessary, the resulting information. We will be sending this information to you as soon
. as possible.
We will try to coordinate the work with the Metcalf stream stabilization project upstream
of our project as well as' the work the City of Aspen Parks and Trails Department has scheduled
for Herron Park.
The applications with the City of Aspen for an insubstantial stream margin review and ,with
Pitkin County for a floodplain permit are being submitted concurrently with this permit.
Construction is plaimed for the fall of 1997, if We are able. to receive in a timely manner all
the permits from the various entities that have jurisdiction. If this is not possible, the construction
will be delayed until late fall of 1998. We will keep you informed on the status of these permits.

The Aspen Consolidated Sanitation District would like to reque.st an insubstantial Stream
Margin Review from the City of Aspen to construct a grade modification drop structure adjacent
to Herron Park in the Roaring fork River to protect its existing 12" main outfall sewer line. The.
line currently suffers from inadequate cover as it crosses the river. The purpose of the project is
to add cover over the pipe and decrease the chances of a washout during peak flows. The existing
pipeline will NOT be replaced. The structure will be built to withstand a 200 yr. event as required
by the USACE and the, Colorado Division of Wildlife in.the same location.
I have enclosed six application packets containing a draWing showing the site location,
plan, and construction details, a copy of the HEC-2 analysis, and a,copy of the pre-application
form from your office.
We are in the process of concurrently applying for a 404 permit form the U.S. Army Corps
of Engineers and a Flood Plain Development Permit from Pitkin County. We will keep you posted
as the status of these permits.
The work will be supervised by Allan Czenkusch of the Colorado Division of Wildlife. We
will also work with Mr. Czenkusch to provide stream bank stabilization as- required' in the area of
the drop ,!tructures. In addition, trout habitat in these areas will also be enhanced.

each organiZation at the same time. Our consultants will also attempt to coordinate our work with
the bank stabilization needed along the river in front of the Metcalf residence as required by Mr.
Mike Claffy of the USACE.

Construction access to this site will be off of Neal Street, along the bike path and within
the District's easements to the river. At this point, we do not believe that it will be necessary to
close the bicycle path full time during construction. Very short duration closures will be required
when equipment and materials are brought on and off the site. Flaggers and warning signs will
be used at that time.
During construction there will be disturbance to the river bed and the adjacent riparian
areas along the shore. Sedimentation barriers will be constructed along the river edges to reduce
sedimentation transport.
The Construction is planned for late fall of 1997 to avoid the brown trout spawning window
if we are able to receive in a timely manner all the permits from the various entities that have
jurisdiction. If this is not possible, the construction will be delayed until the early spring of 1998.
We will keep you informed on the status of all these permits.
Both sites will be restored as near as possible to pre-construction grading and conditions,
and the sites will be re-vegetated.

Review Standards: Stream Margin Review
Pursuant to Section 26.68.040(A), no development shall be permitted within the floodway, with
the exception of bridges or structures for irrigation, drainage, flood control or water diversion,
which may be permitted by the City Engineer, provided plans and specifications are submitted
to demonstrate that the structure is engineered to prevent blockage of drainage channels
during peak flows and the Commission determines the proposed structure complies, to the
extent practical, with all the standards set forth below.
Pursuant to Section 26.68.040(B), no development shall be permitted within one hundred (100)
feet, measured horizontally, from the high water line of the Roaring Fork River and its tributary
streams, or within the Special Flood Hazard Area where it extends beyond one hundred (100)
feet from the high water line of the Roaring Fork River and its tributary streams, unless the
Commission makes a determination that the proposed development complies with all the
standards set forth below.
A development application subject to Stream Margin Review must include a written response to
each of the following criteria:
1. It ean be demonstrated that any proposed development whieh is in the Special
Flood Hazard Area will not inerease the base flood elevation on the parcel proposed for
development. This shall be demonstrated by an engineering study prepared by a
professional engineer registered to practice in the State of Colorado whieh shows that
the base flood elevation will not be raised, including, but not limited to, proposing
mitigation techniques on or off-site which compensate for any base flood elevation
increase caused by the development; and
RESPONSE:
The base flood elevations will not be increased as described in the enclosed letter and
HEC-2 analysis from Mr. Kevin O'Connell, P.E. of.Leonard Rice Consulting Water
Engineers.
2. Any tran on the parcel designated on the Aspen Area Community Plan,
Parks/Recreation/Open Spaee/Trans Plan map, or areas of historie public use or
aecess are dedieated via a reeorded easement for publie use. Dedications are
neeessitated by development's inereased impacts to the City's recreation and traU
faeUities ineluding publie fishing aceess; and
RESPONSE:
The District is working with Mr. John Krueger of the City of Aspen Parks Department
to schedule his work in Herron Park and on the bike path with our proposed drop
structure project to minimize the impact to this area and potentionally realize some
cost savings to both the District and the City of Aspen. The Parks department needs
to replace and upgrade the bike path. We hope to perform our work prior to the bike
path replacement and thereby eliminate the impact to the new bike path.

3. The recommendations of the Roaring Fork River Greenway Plan are
implemented in the proposed plan for development, to the greatest extent practicable;
and
RESPONSE:
No development is proposed within the Roaring Fork Greenway Plan
4. There is no vegetation removed or damaged or slope grade changes (cut or fill)
made outside of a specifically defined buUding envelope. A buUding envelope shall be
designated by this review and said envelope shall be barricaded prior to issuance of
any demolition, excavation or buUding permits. The barricades shall remain in place
untU the issuance of Certificate of Occupancy; and
RESPONSE:
The existing vegetation will be preserved. Any disturbed grass vegetation will be
revegetated with native grasses or reseeded at the direction of the City of Aspen
Parks Department. Required barricades will remain intact and maintained
throughout the course of the construction.
5. The proposed development does not pollute or interfere with the natural
changes of the river, stream or other tributary, including erosion and/or
sedimentation during construction. Increased on-site drainage shall be accommodated
within the parcel to prevent entry into the river or onto its banks. Pools or hot tubs
cannot be drained outside of the designated buUding envelope; and
RESPONSE:
The proposed construction will not interfere with the natural changes of the
river, stream or other tributary of the Roaring Fork River. During construction
sedimentation barriers will be used and maintained throughout the duration of the
project to reduce the amount of silt entering the river. Site drainage and hot tubs
are not an issue.
6. Written notice is given to the Colorado Water Conservation Board prior to any
alteration or relocation of a water course, and a copy of said notice is submitted to the
Federal Emergency Management Agency; and
RESPONSE:
An application to Pitkin County's flood plain administrator, Ms. Temple Glassier for a
Floodplain Development Permit is being submitted concurrently with this
application.
7. A guarantee is provided in the event a water course is altered or relocated, that
applies to the developer and his heirs, successors and assigns that ensure that the
flood carrying capacity on the parcel is not diminished; and
RESPONSE:
The water course will not be altered or relocated.

8. Copies are provided of all necessary federal and state permits relating to work
within the one-hundred-year floodplain; and
RESPONSE:
The District is applying for a nation-wide 404 permit from the U.S. Army Corps of
Engineers concurrently with this permit as well as a Floodplain Development Permit
from Pitkin County.
9. There is no development other than approved native vegetation planting taking
place below the top of slope or within fifteen (15) feet of the top of slope or the high
waterline, whichever is most restrictive. This is an effort to protect the existing
riparian vegetation and bank stability. If any development is essential within this
area, it may only be approved by special review pursuant to Section 26.64.040(D) (refer
to Figure "A" below for illustrative purposes); and
RESPONSE; .
Only native grass will be planted in disturbed areas. Bank stabilization will be
enhanced at the direction of Mr. Allan Czenkusch of the Colorado Department of
Wildlife.
10. All development outside the fifteen (151 foot setback from the top of slope does
not exceed a height delineated by a line drawn at a forty-five (450 degree angle from
ground level at the top of slope. Height shall be measured and determined by the
Zoning Officer utilizing that definition set forth at Section 26.04.100 (refer to Figure
"A" below for illustrative purposes); and
RESPONSE:
No development is proposed outside the fifteen foot set back.
11. A landscape plan is submitted with all development applications. Such plan
shall limit new p1antings (including trees, shrubs, flowers, and grasses) outside of the
designated building envelope on the river side to native riparian vegetation; and
RESPONSE:
Revegetation of disturbed areas will be limited to native grasses.

2. APPLICANT understands and agrees that City of Aspen Ordinance No. 43 (Series of 1996)
establishes a fee structure for land use applications and the payment of all processing fees is a
condition precedent to a determination of application completeness.
3. APPLICANT and CITY agree that because of the size, nature or sCOpe of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing
the application. APPLICANT and CITY further agree that it is in the interest of the parties to allow
APPLICANT to make payment of an initial deposit and to thereafter permit additional costs to be
billed to APPLICANT on a monthly basis. APPLICANT agrees he will be benefited by retaining
greater cash liquidity and will make additional payments upon notification by the CITY when they
are necessary as costs are incurred. CITY agrees it will be benefited through the greater certainty of
recovering its full costs to process APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete
processing or present sufficient information to the Planning Commission and/or City Council to
enable the Planning Commission and/or City Council to make legally required findings for project
approval, unless current billings are paid in full prior to decision.
5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver oflts right to
collect full fees prior to a determinatiop of application completeness, APPLICANT shall pay an
initial deposit in the amount of $ / 3 ~ which is for hours of Planning staff time, and if
actual recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings
to CITY to reimburse the CITY for the processing of the application mentioned above, including
post approval review. Such periodic payments shall be made within 30 days of the billing date.

RE: Heron Park Drop Structure
Dear Tom:
I have enclosed the following; ten copies of the design drawing for the Heron Park drop structure, and three
copies of the two output files from the HEC-2 analysis we performed to evaluate the impacts of the proposed
drop structure on the Roaring Fork River.
The basis for our model was the original input data from the 1985 FEMA study of the area. Printout no. 1
represents the input and output for existing conditions, as modeled by FEMA. The model is oriented with
section numbers increasing in the upstream direction: the model begins at section no. 141.1, located
approximately 1800 feet downstream of the proposed Heron Park structure. The proposed drop structure will
be located between section no.'sl44 and 145, approximately 30 feet upstream of the pedestrian bridge. Because
there was no FEMA cross-section at the proposed drop structure location, we added cross-section no.'s 144.1
and 144.2 to estimate water surfuce elevation prior to construction of the drop structure. You can see from the
output that, prior to the structure being in place, the calculated water surface elevation ("CWSEL") at cross-
section no. 144.1 is 7881.98 and the channel velocity ("VCH") is 11.33 feet per second: the elevation at 144.2
is 7882.47 and the velocity is 9.78 feet per second.
Printout no. 2 represents the analysis with the structures in plaCe. With the structure in place, the calculated
water surface elevation at section 144.1 is 7882.19: the calculated water surface at section 144.2 is 7882.69.
This represents an increase of .21 feet at section 144.1, and an increase of .22 feet at section 144.2. The slight
increase in elevations accounts for the increase in the channel bottom elevation at the structures. No significant
upstream or downstream effects were detected by the model as a result of the structure. There was also no
significant change in velocity above or below the structure. It is important to note that the accuracy of the
modeling in this area is plus or minus .5 feet.
