Box 300 Aspen, Colorado 81612 Dear Mr. Burks, Last October a ~onditional use hearing was held before the Aspen Planning and Zoning Commission to consider temporary uses in the Upper Elementary School. Ei9ht applicants were given approval, along with the City/County Building Depart- ment who had received approval in an earlier review, to occupy space in the building until August 31,1983. A condition of this conditional use permit was that a plan be submitted for the total use of the school whi ch deals with long term use of the structure. This plan was to be reviewed at a time during the permit period. This letter is to remind you of that requirement of the approval. Since the end of the permit period is 8/31/83, we would like to have the plan for staff review at least 30 days before it would be reviewed by the Planning and Zoning Commission. Zoning: App 1 i cant "s Request: R-6 The City/County Building Department is requesting conditional use approval to locate their offices in the Upper Elementary Scnool in, tne R-6 Zonein a space including l,620 square feet. Planning Office Review: Public administration buildings are a conditional use in the R-6 zone. This is the provision of the Code under which this application is being made. Permanent plans for the use of the building have not been finalized, so the agreement between the school system and the Building Department is for only a 60-day period, with a verbal indication of a l-year period being likely. The Building Department must vacate its present space in the basement of the County Courthouse for the County Finance Department. Thei,r location Ca temporary building behind the Courthouse} is being removed for the construction of the new Jai 1 Facil ity. The Finance Department must stay in the Courtbouse ~ecause of tie~in to the Computer Terminals. Other current renters of the Upper Elementary Scllool include Ruth Stone "s Ghfl dren 's Pl ayshop, The Aspen Development Center (both daycare centers), the Roaring Fork Energy Center, Aspen Recreation Department, Aspen Wilderness Workshop, The Cbristian Science Society, Roaring Fork Kennel Club, Filmfest and Aspen Leaves. None of these other uses have made application through the Planning Office for converstion of the space which was formerly used as the Upper Elementary School, despite the fact that many are either conditional or illegal uses in the zone district., Section 24-3.3 of the Code provi,des criteria for the review of conditional use appl ications, as follows; l. Compliance, with Zoning Code - The proposal does not involve an expansion i,nto any building but simply converts an existing use from one "public" purpose to another., Parking requirements for "all other uses" in the residential zone must be set by review of the Planning and Zoning Commission based on the traffic generation of the proposed development, site characteristics, pedestrian access and the availabil ity of public transportati,on., Information provided by the appl icant indicates that traffic in and out of their offices on a typical day amounts to approximately 25 to 30 people. Parking for tbese clients will be largely on-street parking, Six parking spaces are being provided in the rear of the buil ding for employee and Department vehicles. Hours of business are from 8:00 a..m., to 5,00 p.,m., Thi,s location can be easi.ly acces.sed from the Courthouse/City Hall/Commercial Core by the Post Office_Elementary School Trail for pedestri.an users. However, many of the persons who visit this office are contractors, architects and others involved in construction who must rush from a site to the office and who likely will be using their car or truck. The surrounding residential neighborhood likely wi 11 be impacted by the on-street parking which will be used by these visitors. However, it is conceivable that this impact will be no Worse than, and possibly even less than that caused by the drop-off and pick-up of children when the building was used as a school. Furthermore, since the building can be accessed by North Monarch, North Aspen and North Garmisch Streets, there should be ample, locations for on-street parking. We therefore recommend that you permit the Building Department to operate in this location with the six spaces for employee and Departmental vehicles and on-street parking for visitors. 2. Consistency with Zoning Di,strict - The intent of the R-6 district is "To provide areas for residential purposes with customary accessory uses. Recreational and institutional uses customarily found in proximity to residential uses are included as conditional uses. It While the propOsed use of the elementary school dOes not appear to fit within the above description, the term "publ ic admini,stratIon building" does appear as a conditiona 1 use in this zone., 3. Land Use Compatibility - The proposal only involves a change in the internal use of the building rather than a development proposal for a site. However, since this building is being used by many groups without the required approvals under the zoning code, we must be concerned about its overall use., We recommend that your granting of a conditional use permit be conditioned upon a requirement that a plan be submitted for the total use of the school which deals with the various current and eventual uses of the building. I feel this application can only be recommended in light of these much broader policy questions. Galena Aspen, CO 81611 Re: Relocation of Building Department Dear Planners: Please conslddr t'1s letter as a formal application to the Aspen Planning and Zoning Commi~sion for a review of a conditional use for a public administration building in an R-6 Zone (Aspen/Pitkin Regional Building Department, Inspections and Zoning Enforcement) as required by Section 24_3.2 of the Aspen Municipal Code. The enclosed drawings show the location of the proposed offices at the upper elementary school. There is open parking on Hallam Street as well as parking at the rear of the building for the employees and Department vehicles. The area is accessible from Main Street by both North Monarch and North Aspen Streets. It is not so far removed from other City and County offices as to be impractical administratively as far as Planning and Zoning, Engineering and Finance Departments. The proposed location will provide us with much needed working space. In an ordinary day we see 25 to 30 contractors, homeOWners, attorneys, architects, real estate sales people and others. Our hours are from 8:00 a.m. to 5:00 p.m. and therefore should not interfere witb the residential peace and quiet.
