MEMORANDUM TO: Design Review Appeal Committee THRU: Stan Clauson, Community Development Directoft,~2 Julie Ann Woods, Deputy Direftor FROM: Christopher Bendon, Planner U\M RE: Conant Residence 55 Smuggler Grove Drive DATE: March 12,1998 SUMMARY: The applicant, Richard Conant, is requesting a waiver of the Residential Design Standard concerning "volume" for a redevelopment of an existing home at 55 Smuggler Grove Road. Waiving this standard will allow for the construction of windows between 9 and 12 feet above finished floor on the Southwest elevation. This request does not fulfill the requirements of a design variance. The larger windows do not address the AACP in a more appropriate way. The larger windows do not result in a better design, other than a larger house. And, the site does not pose any specific hardship in which larger windows are required. Staff recommends the Design Review Appeal Committee deny this variance. APPLICANT: Richard Conant. Represented by Gibson Reno Architects. LOCATION: 55 Smuggler Grove Road. ZONING: R-15A (Moderate-Density Residential) LOT SIZE: 21,494 square feet. FAR: 4,890 square feet allowable Onay be lower with slope reduction) 3,519 square feet existing. PREVIOUS ACTION: DRAC has not previously considered this case. REVIEW PROCEDURE: DRAC may grant relief from the Residential Design Standards if the variance is found to be: a) in greater compliance with the goals of the AACP; or, 1 .. b) a more effective method of addressing standard in question; or, c) clearly necessary for reasons of fairness related to unusual site specific constraints. All hearings are public hearings open to the public. Applicants are required to post the property at least five (5) days in advance. STAFF COMMENTS: The applicant's proposed development is not in compliance with the following Residential Design Standard: 26.58.040(F)(12) Volume. For the purpose ofcalculating jloor area ratio and allowable.floor area for a building or portion thereofwhose principal use is residential, a determination shall be made as to its interior plate heights. All areas with an exterior expression Of a plate height greater than ten (10) feet, shall be counted as two (2) squarefeet for each one (1) squarefoot offloor area. Exterior expression shall be defined as facade penetrations between nine (9) and twelve (12) feet above the level ofthe jinishedfloor, and circular, semi-circular or non-orthogonalfenestration between nine (9) and fifteen (15) feet above the level of the finished floor. In response to the review criteria for a DRAC variance, Staff makes the following findings: a) in greater compliance with the goals of the AACP; or, Staff Finding: The proposed variance is not in greater compliance with the goals of the Community Plan. b) a more effective method of addressing standard in question; or, Staff Finding: The proposed variance is not a more effective method of addressing the volume standard. c) clearly necessary for reasons offairness related to unusual site spec(tic constraints. Staff Finding: This property is relatively flat and there does not appear to be any extenuating circumstances about the site which would require larger windows. RECOMMENDATION: Staff recommends the Design Review Appeal Committee deny the request to vary the volume standard for the Conant Residence. RECOMMENDED MOTION: "I move to deny the request to vary the Residential Design Standard regarding "volume", finding that the variance does not meet any of the necessary criteria for a variance, for the Conant Residence, 55 Smuggler Grove Road." If substantially equivalent mortgage insurance coverage is not available.
