SUMMARY: The Community Development Department received a request for an
Insubstantial Amendment to the Meadows SPA Plat to officially change the name of the
portion of "Meadows Road" on which the Trustee Townhomes are located to "Meadows
Trustee." Pursuant to Section 26.80.040, Amendment of Final SPA Development Plan, the
requested plat amendment can be administratively approved by the Community
Development Director; however, street name change requests require City Council approval.
Staff recommends that City Council approve with conditions the request to officially re-
name the portion of "Meadows Road" on which the Trustee Townhomes are located to
"Meadows Trustee."
APPLICANT: Trustee Townhomes Homeowners Association, represented by John Sarpa.
BACKGROUND: When the Aspen Meadows SPA was approved by City Council in 1992,
the eight existing Trustee Townhomes were all located on an extension of Meadows Road.
Since the units were all under the same ownership (Savanah Limited Partnership), all
correspondence and communication with anyone staying in the units was conducted through
the main office of the Meadows complex located at 845 Meadows Road.
As part of the SPA, the Aspen Institute took ownership of the main office building, but the
Trustee Townhomes remained under Savanah's ownership. There was no street name
change discussed or contemplated from 1992 until 1995. In 1995, Savanah entered into
negotiations to sell the eight existing Trustee Townhomes and Savanah's rights to build three
more townhomes to the Institute. During these negotiations, the Institute was informed by
Marta Steinmetz, who was in charge of addressing for the Sheriff's Office, that the addresses
for all eleven of the Trustee Units would be "Meadows Trustee." This address was not
requested, but rather given to the Institute as the appropriate new address.
When a townhome owner tried to arrange for the Post Office to place mail boxes at the site,
he was told by the Institute that the address was "Meadows Trustee." Accordingly, the
owner told the Post Office of that address and many residents arranged for address notices,
stationary, etc. to reflect the "Meadows Trustee" street name. Currently, all mail is delivered
to the individual boxes of each unit at 21 Meadows Trustee through 91 Meadows Trustee.
The current plat of record shows the street as an extension of "Meadows Road;" however,
earlier this year, City staff informed the manager of the Townhome Association that an SPA
plat amendment would be necessary to keep and make official the "Meadows Trustee" street
name. The homeowners have subsequently requested the street name change and plat
amendment stating that they have used the "Meadows Trustee" address given to them by the
City and, in reliance on that information, have spent funds and made all the necessary
arrangements to establish those addresses with all their acquaintances.
STAFF COMMENTS: With respect to the requested street name of "Meadows Trustee,"
staff has solicited the Engineering, Fire, Water, Streets, and Police Departments as well as
the City GIS (mapping) division and U.S. Post Office to find out whether there are any
concerns with the proposed street name change. Staff has not been told of any problems or
concerns regarding the proposed name, nor would the proposed name duplicate the name of
any existing street within Pitkin County. In fact, "Meadows Trustee" does not even sound
enough like any other street names to give cause of concern to emergency dispatch.
There are eleven affected units, of which eight were built in the mid-1960s and three were
built within 1997-98. All of the owners are in agreement with and support the proposed
street name change. The homeowners association approved at their annual meeting on June
15, 1998 that John Sarpa be authorized to act on their behalf regarding the clarification of the
street address as "Meadows Trustee."
If the street name change is approved by City Council, the Community Development
Department will administratively process the Insubstantial Plat Amendment. In order to
qualify as an Insubstantial Amendment to the final SPA development plan, the request must
not violate any of the provisions of Section 26.80.040(E)(1). The provisions of said section
of the code follow, along with staff s response to each.
1. The proposed amendment does not change the use or character of the project;
RESPONSE: Changing the name of a street will have no affect on the use or character of the
project.
2. The proposed amendment does not increase the overall coverage of structures on the
land by more than three (3) percent;
RESPONSE: The proposed amendment would not change the approved site coverage at all.
3. The proposed amendment does not substantially increase trip generation rates or the
demand for public facilities;
RESPONSE: Trip generation rates would be unaffected. The proposed amendment would
not increase the demand for public facilities either.

4. The proposed amendment does not reduce the amount of approved open space by
more than three (3) percent;
RESPONSE: The proposed amendment would not change the amount of approved open
space.
S. The proposed amendment does not reduce existing off-street parking or loading
space by more than one (1) percent;
RESPONSE: The proposed street name change would not affect existing/approved off-street
parking or loading zones.
6. The proposed amendment does not reduce required pavement widths or rights -of -
way for streets and easements;
RESPONSE: The amendment would not have the affect of reducing required pavement
widths or rights -of -way for streets and easements.
7. The proposed amendment does not increase the approved gross leasable area of
commercial buildings by more than two (2) percent;
RESPONSE: This criteria is not applicable as there are no commercial buildings.
8. The proposed amendment does not increase the approved residential density of the
development by more than one (1) percent; and,
RESPONSE: The proposed amendment would have no affect on densities.
9. The proposed amendment is consistent with the conditions and representations of the
project's original approval and does not require a further variation from the
project's approved use or dimensional requirements.
RESPONSE: The proposed amendment would not change the approved use of the subject
parcel. Variation from the project's approved dimensional requirements are not needed, nor
are any sought, for the proposed amendment. All conditions of the project's prior approvals
would continue to be met.
RECOMMENDATION: The Community Development Department recommends that
Council approved the attached Resolution, allowing the Trustee Townhomes Homeowners
Association to change the name of the Trustee Townhomes portion of "Meadows Road" to
"Meadows Trustee," with the following conditions:
1. Within 180 days of this approval, the applicant must complete an Insubstantial SPA
Plat Amendment to update the Meadows SPA plat in accordance with the approvals
contained herein.
2. If new street signs are needed, said signs shall be purchased by the applicant through
the City Streets Department. The sign(s) shall be installed in a location approved by
the Streets Department, and any costs associated with the installation of the sign(s)
shall be borne by the Trustee Townhomes Homeowners Association.

3. All material representations made by the applicant in this application shall be adhered
to and shall be considered conditions of approval, unless otherwise amended by the
Community Development Director or City Council.
RECOMMENDED MOTION: "I move to approve Resolution Number Fi, Series of
1998, allowing the Trustee Townhomes Homeowners Association to change the name of the
Trustee Townhomes portion of "Meadows Road" to "Meadows Trustee."

The Trustee Townhomes at the Aspen Meadows Condominium Association has put in an
application to have the name of the road on which the townhomes are located "officially"
changed from Meadows Road to Meadows Trustee. The homeowners have been using the
Meadows Trustee addresses since 1996, and currently the post office delivers to these
addresses.
Please let me know if you have any questions or concerns by October 30, 1998, at which
point a resolution for the change in name will be presented to City Council.

2. APPLICANT understands and agrees that City of Aspen Ordinance No. 43 (Series of 1996)
establishes a fee structure for land use applications and the payment of all processing fees is a
condition precedent to a determination of application completeness.
3. APPLICANT and CITY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing
the application. APPLICANT and CITY further agree that it is in the interest of the parties to allow
APPLICANT to make payment of an initial deposit and to thereafter permit additional costs to be
billed to APPLICANT on a monthly basis. APPLICANT agrees he will be benefited by retaining
greater cash liquidity and will make additional payments upon notification by the CITY when they
are necessary as costs are incurred. CITY agrees it will be benefited through the greater certainty of
recovering its full costs to process APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete
processing or present sufficient information to the Planning Commission and/or City Council to
enable the Planning Commission and/or City Council to make legally required findings for project
approval, unless current billings are paid in full prior to decision.
5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay an
initial deposit in the amount of $��which is for hours of Planning staff time, and if
actual recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings
to CITY to reimburse the CITY for the processing of the application mentioned above, including
post approval review. Such periodic payments shall be made within 30 days of the billing date.
APPLICANT further agrees that failure to pay such accrued costs shall be grounds for suspension
of processing.

I am writing to you in my capacity as President of The Trustee Townhomes at the Aspen
Meadows. I have been asked by our Homeowners Association to file an application to amend the
Aspen Meadows SPA Plat to reflect the address given to us by the City planning staff in 1995.
BACKGROUND:
When the Aspen Meadows SPA was approved by the City Council in 1992, the existing
eight Trustee Townhomes were all located on an extension of Meadows Road. Since the units were
all part of the same ownership (Savanah Limited Partnership), all correspondence and
communication with anyone staying in the units was conducted through the main office of the
Meadows complex located at 845 Meadows Road. This is where the restaurant and the check in
desk for all guests of the lodge rooms and Trustee Townhomes was located.
As a part of the SPA, the Aspen Institute (Institute) took ownership of the restaurant/lobby
building located at 845 Meadows and the Trustee Townhomes remained owned by Savanah. There
was no street address change discussed or contemplated from 1992 until 1995.
In 1995, Savanah and the Institute entered into negotiations to sell the eight existing
Townhomes and Savanah's rights to build three more townhomes to the Institute. During these
negotiations, the Institute was informed by a member of the Aspen Community Planning staff
(Marta Steinmetz) that the addresses for all eleven of the trustee units would be "Meadow
Trustee". This address was not requested but rather given to the Institute as the appropriate new
address.
The Institute purchased the property in February of 1996 and simultaneously sold the
existing eight units (units 2 through 9) to the various people noted in the attached list. The other
three lots were sold shortly thereafter by the Institute to Mcpherson/Lind, LLC. Mr. Mcpherson
then built the three new units (Units 1, 10 & 11) and has sold Unit 1 (11 Meadows Trustee) to Mr.
Smooke. Units 10 and 11 are still under construction and owned by Mcpherson/Lind.

I was the first resident to move into the Townhomes as a full time resident. In December
of 1996, 1 moved into Unit 7 at 71 Meadows Trustee. I had to arrange for the Post Office to place
mail boxes at the site and was told by the Institute that the address was "Meadows Trustee".
Accordingly, I informed the Post Office of that address and arranged for all our address
notices, stationary, etc. to reflect that street name. The other homeowner's have done likewise and
all mail is delivered to our individual boxes at 21 Meadows Trustee through 91 Meadows Trustee.
REQUESTED PLAT AMENDMENT:
Earlier this year, it was discovered that the City still had questions about the official
address for these units. In the attached January 29, 1998 letter from Sara Thomas to Don
Schuster, manager of the Townhome Association, it was suggested that if the homeowners
preferred to keep the Meadows Trustee address, a SPA plat amendment would be necessary. The
current plat of record shows the street as an extension of Meadows Road. The homeowners have
used the Meadows Trustee address given to them by the City and in reliance on that information,
have spent the funds and made all the necessary arrangements to establish those addresses with
all their acquaintances. For these reasons, the Homeowners feel very strongly the plat should be
amended to reflect the correct address of "Meadows Trustee".
