December 16, 1986 memorandum shall be filed wi th the
Pitkin County Clerk and Recorder's Office for these
units prior to issuance of a Certificate of Occupancy.
Deed restrictions shall meet the approval of the City
Attorney and Housing Authority prior to recordation.
2) The cash-in-lieu payment for the equivalent of .4 low
income employees, as calculated at the time of building
permit application, shall be made to the Housing
Authority prior to issuance of any building permit.

shall be installed prior to issuance of a Certificate
of Occupancy.
Site improvements stated in the 700 E. Hyman Residen-
tial GMP application submitted December 1, 1986,
including, but not limited to: 9 Cleveland Maples or
an equivalent specy acceptable to the Parks Department
(minimum 3 1/2-4" caliper), 13 clusters of Aspen,
shrubs, bluegrass sod, benches, tree grates, bicycle
rack, fire hydrant, sidewalks (surfaced with exposed
aggregate and/or brick pavers) curbs and gutters and a
handicap ramp, shall be completely installed prior ~o
issuance of a Certificate of Occupancy. An improve-
ments agreement and guarantee shall be filed pursuant
to section 20-16 of the Municipal Code to the accept-
ance of the City Engineer and City Attorney prior to
review of final plat by City Council.
A subdivision exception plat shall be recorded with the
County Clerk and Recorder's Office prior to issuance of
any building permits, conforming to Section 20-15 of
the Municipal Code and meeting the requirements of the
Engineering Department. This plat shall be reviewed by
the Council prior to its granting final approval.

A statement of subdivision exception shall be filed to
the satisfaction of the City Attorney prior to recorda-
tion of the plat. Included in this statement shall be
a development schedule including construction and land-
scaping improvements and appropriate financial guaran-
tees.

A soils sample analysis shall be submitted to the
Environmental Health Department prior to issuance of -i

The applicant shall agree to join any improvement
district formed that encompasses this property and
state such agreement in the statement of subdivision
exception. .

B. GMP REDUCTION REQUEST: In a February 13, 1987 letter
-(attached), Sunny Vann has requested reduction of the residential
GMP allocation required to develop the four unit 700 E. Hyman
project. It is argued in Sunny Vann's letter that it would be
appropriate to apply Section 24-11.2(d), GMP exemption for a lot
split to construct one single family residence, to one half of
the duplex.

700 EAST HYMAN GMP AMENDMENT
On February 2, 1988 P&Z passed a motion to recommend rescoring
the 700 E. Hyman project and modifying the scope of improvements
through use of $1,100 committed for site improvements as stated
below.
On March 14, 1988 City council passed a motion to reduce the
original score of the 700 East Hyman residential GMP application
to 1 point in Neighborhood Compatibility and 1 point in site
Design, considering the proposed modifications to (1) change the
west stairway entry as built and (2) use $1,100, which had been
committed for installation of street furniture on the site and
adjacent rights-of-way, for additional on-site landscaping as
shown on an amended landscape plan to be presented to the
satisfaction of the Planning Office. The amended landscape plan
shall be presented to the Planning Office by no later than May 1,
1988 and installation of landscaping shall be completed by no
later than July 1, 1988.

SUMMARY: The Planning and Zoning commission and Planning Office
recommend that Council affirm the allotment of residential units
to the revised 700 E. Hyman project, downscore the project in
site Design and Neighborhood Compatibility and allow the
applicant to use the funds set aside for street furniture for
additional on-site landscaping.
LOCATION: Lots K,L,M and N, Block 104, Townsite and City of
Aspen.
APPLICANT'S REQUEST: The applicant requests approval for revision
of the entry steps to unit A of the project's west duplex and to
eliminate benches, tree grates and cages and bicycle racks
depicted on the Plan. The applicant agrees to apply the money
that would have been spent on the landscape amenities to the
installation of additional on-site landscaping or to offer the
money to the City for installation of benches and/or bicycle
racks where they would benefit the community.
PRIOR COUNCIL AND ADVISORY COMMITTEE ACTIONS: The 700 East Hyman
project was one of two GMP applications approved in the 1986
residential competition. The Planning and Zoning commission
scored the application on January 27, 1987. Council allocated the
requested two dwelling units to the project through adoption of
Resolution 4 (series of 1987).
On February 2, 1988 P&Z passed a motion to recommend rescoring
the 700 E. Hyman amended GMP application reducing the points in
the categories of site Design from "3" to "1" and in Neighborho:>d
Compatibility from "2.5" to "1". The Commission recommends
Council to affirm the allotment of residential units to the
amended project subject to condition that the $1,100, which had
been committed for installation of benches, bicycle racks and
tree grants, be applied to additional on-site landscaping as
shown in a plan to be presented to the satisfaction of the
Planning Office.

APPLICABLE SECTION OF MUNICIPAL CODE: Section 24-11.7(b) of the
Municipal Code requires rescoring of substantial changes to GMP
proposals to determine whether the allocation should be confirmed
or rescinded. If the scoring remains above the minimum threshold
and the applicant's position relative to others in the competi-
tion does not change, the Planning and Zoning commission "shall
make a recommendation to council as to the appropriateness of the
changes and any further conditions of approval."
PROBLEM DISCUSSION:
A. Referral Comments:
1. Engineering Department: Jim Gibbard noted in his January
18, 1988 memorandum that the Engineering Department recom-
mended the maximum number of points on site design because
the applicant proposed to install benches, bicycle racks,
extensive landscaping, and a corner ramp. Since the appli-
cant has agreed to apply the funds for installation of
benches and bicycle racks to the provision of streetscape
improvements in some other appropriate location, the
Engineering Department recommends no change in the pre-
viously suggested score.
2. Parks Superintendent: Bill Ness recommended in his
January 12, 1988 memorandum that the landscape improvements
funds be committed towards a bike rack and planter box at
the entrance of the Aspen Ice Garden. As an alternative,
these funds could be used to purchase three trees which
could be planted in the mall or a park.
B. Staff Comments: When the Planning and Zoning commission
learned that the entry stairway had not been constructed accor-
ding to the plans in the GMP application, they determined
that this consti tuted a deviation warranting re-hearing.
Consequently, the applicant was notified. Architectural represen-
tations in the application, including the graphic on the front
cover, showed a rather elaborate stairway design entering the
building on Spring Street. The stairway served to break up
massing of the long, straight wall and to add a decorative
element to the structure. P&Z scored 700 East Hyman 2.5 in the
GMP scoring category of "neighborhood compatibility".
No special mention was made by staff or the Planning commission
about the stairway, al though the general concept of broken-up
massing was noted as a positive design feature. As pointed out in
Sunny Vann's letter, the straight staircase built is very
functional and allows for more landscaped open space than shown
in the original design. There are now a few aspen trees and lawn
in the area adjacent to the staircase.

The applicant had shown some six benches and two bicycle racks.
Tree grates were specified in the application (p.26). $1,100 has
been bonded for these site amenities. The applicant now claims
that street furniture is not needed for the seasonal, second-home
residences, and this money could be better spent on additional
landscaping or city street furniture where needed. Please note
that 700 East Hyman obtained a "3" in site design and "2.1" in
green space. staff recommended "3" for site design acknowledging
the relative abundance of open space (40% of the site), the
landscape scheme, and walkways.
The Planning Commission determined that the most appropriate
action would be to reduce the original score for the project and
to use the committed funds for additional landscaping on the
property. While some P&Z members felt the resultant design is
inferior to that originally represented, the Commission believed
that the proposed "trade-offs" in architecture and site design
remain appropriate. P&Z felt the proposed. alternative off-site
improvements were not appropriate because the applicant would be,
in a sense, "buying" GMP points through a deal for amenities
conceived as an afterthought. While the Planning Office had
originally recommended using the funds for Ice Garden landscape
improvements, we now concur with P&Z. Please note that the
reduction in GMP score does not place the proj ect below the
threshold or behind another competitor in the 1986 competition.
RECOMMENDED MOTION: "Move to reduce the original score of the
700 East Hyman residential GMP application to 1 point in
Neighborhood Compatibility and 1 point in site Design, consider-
ing the proposed modifications to (1) change the west stairway
entry as built and (2) use $1,100, which had been committed for

Please consider this letter an application to amend the
growth management approval granted to the 700 East Hyman
project, a 1986 residential GMP allocation recipient. The
application is submitted by the project's developer, the
Hodge Companies Inc., of Sausalito, California, pursuant
to Section 24-11.7(b) of the Municipal Code. The Ap-
plicant's representative is Peter Rosell.

As you know, modification number I has already been
implemented in conjunction with the construction of the
building. The site furnishings referred to in modifica-
tion number 2 have yet to be installed.
In general, it should be noted that the Site Development
Plan contained in the Applicant's GMP application was a
conceptual drawing which was included solely for illustra-

tive purposes. The drawing, in conjunction with the
application text, was intended to give the staff and P&Z
an idea of the quality of the project's site design and
the various site furnishings to be provided.
The modifications outlined above were identified during
the design development phase of the project, which was
initiated subsequent to receipt of a GMP allocation. Both
the Applicant and the project architect, however, believe
the changes to be consistent with the spirit of the ap-
plication's representations. A detailed description of
the modifications, and the reasoning behind them, is
provided below.
Unit A Entry Steps
As noted above, the entry steps to Unit A were revised
during the design development phase of the project in
order to enhance the Unit's visual appearance from Spring
Street and to improve upon the original Site Development
Plan. Upon further study, it was concluded that it was
unnecessary to duplicate the city sidewalk within the
property line in order to provide adequate access from
Unit A to the parking area at the rear of the site.
The removal of the superfluous walkway allowed the
creation of more landscaped open space and eliminated the
need for the original double-access steps. Retention of
the steps as originally designed would have resulted in a
substaintial brick wall located immediately adjacent to
the project's wrought iron fence. The revised single-
access entry steps, however, utilize the same materials as
their predecessor and maintain the same basic "feeling" of
the original schematic representation. The revised
design, the Applicant believes, results in a much simpler
and less forceful entry experience, thereby sOftening and
enhancing the effect of the project on the surrounding
streetscape.
Site Furnishings
with respect to site furnishings, the Applicant believes
that the items in question are inappropriate given the
nature and design of the project. For example, the
principal purpose of tree grates is to allow adequate
watering of the trees when they are planted in impervious
surfaces. In this case, the area around the project's
trees is planted in grass.

Similarly, the inclusion of benches and bicycle racks is
more appropriately suited to a commercial project as
opposed to seasonal, second-home residences. Bicycles
will normally be stored in the units' parking garages and
no need for curbside seating is envisioned. Inasmuch as
the cost of these items has already been bonded with the
City's Engineering Department, the Applicant will agree to
apply the money to the installation of additional on-site
landscaping or to contribute it to the City for the
installation of benches andlor bicycle racks at such other
locations as may be deemed appropriate by the CCLC and the
Planning Office.
Swmnary
In summary, the Applicant believes that the modifications
discussed above are consistent with the intent of the
general representations contained in the original GMP
application and, in fact, represent a significant improve-
ment in the quality of the project. The Applicant further
believes that the proposed modifications would have
enhanced as opposed to adversely affected the project's
GMP score had they been incorporated in the original
submission, and that they reasonably fall within the realm
of design refinement which occurs subsequent to receipt of
a GMP allocation. The Applicant, therefore, respectfully
requests that the Planning Office recommend to the P&Z
that the modifications discussed above be approved.

LOCATION: Lots K,L,M and N, Block 104, Townsite and City of
Aspen.
PRIOR P&Z AND COUNCIL ACTIONS: The 700 East Hyman project was one
of two GMP applications approved in the 1986 residential competi-
tion. P&Z scored the application on January 27, 1987. Council
allocated the requested two dwelling units to the project through
adoption of Resolution 4 (Series of 1987).
APPLICANT'S REQUEST: The applicant requests approval for revision
of the entry steps to unit A of the project's west duplex and to
eliminate benches, tree grates and cages and bicycle racks
depicted on the Plan. The applicant agrees to apply the money
that would have been spent on the landscape amenities to the
installation of additional on-site landscaping or to offer the
money to the City for installation of benches and/or bicycle
racks where they would benefit the community.
DEVELOPMENT APPROVAL AMENDMENTS: This review closely follows the
Hunter Plaza GMP amendment (January 5, 1988), a similar case in
which portions of the project were constructed with minor
modifications to the approved plans without prior approval by P&Z
or through staff sign-off as technical changes. As noted in the
Hunter Plaza memorandum, the Planning Office has sent a letter to
local architects, planners and attorneys about the problem of
enforcing development approvals. We believe that the misunder-
standing in the level of detail in GMP representations has been
resolved, and that the language in the New Code for GMP technical
clarifications, which the Planning Director can approve, will be
more workable in all future GMP competitions.
APPLICABLE SECTION OF MUNICIPAL CODE: Section 24-11.7(b) of the
Municipal Code requires rescoring of substantial changes to GMP
proposals to determine whether the allocation should be confirmed
or rescinded. If the scoring remains above the minimum threshold
and the applicant's position relative to others in the competi-
tion does not change, the Planning and Zoning commission "shall
make a recommendation to Council as to the appropriateness of the
changes and any further conditions of approval."

PROBLEM DISCUSSION:
A. Referral Comments:
1. Engineering Department: Jim Gibbard noted in his January
18, 1988 memorandum that the Engineering Department recom-
mended the maximum number of points on site design because
the applicant proposed to install benches, bicycle racks,
extensive landscaping, and a corner ramp. Since the appli-
cant has agreed to apply the funds for installation of
benches and bicycle racks to the provision of streets cape
improvements in some other appropriate location, the
Engineering Department recommends no change in the pre-
viously suggested score.
2. Parks Superintendent: Bill Ness recommended in his
January 12, 1988 memorandum that the landscape improvements
funds be committed towards a bike rack and planter box at
the entrance of the Aspen Ice Garden. As an alternative,
these funds could be used to purchase three trees which
could be planted in the mall or a park.
B. Staff Comments: When the Planning and zoning commission
learned that the entry stairway had not been constructed accor-
ding to the plans in the GMP application, the applicant was
notified that this constituted a deviation warranting re-hearing.
Architectural representations in the application, including the
graphic on the front cover, showed a rather elaborate stairway
design entering the building on spring Street. The stairway
served to break up massing of the long, straight wall and to add
a decorative element to the structure. P&Z scored 700 East Hyman
2.5 in the GMP scoring category of "neighborhood compatibility".
No special mention was made by staff or the Planning commission
about the stairway, al though the general concept of broken-up
massing was noted as a positive design feature. As pointed out in
Sunny Vann's letter, the straight staircase built is very
functional and allows for more landscaped open space than shown
in the original design. There are a few aspen trees and lawn in
the area adjacent to the staircase. We agree that the design of
the building is not substantially compromised by the new stairs
and appreciate that there is a gain in landscaping amenity
through the modification. Our finding that there is a positive
trade-off leads us to conclude that this modification is appro-
priate.
The applicant had shown some six benches and two bicycle racks.
Tree grates were specified in the application (p.26). $1,100 has
been bonded for these site amenities. The applicant now claims
that street furniture is not needed for the seasonal, second-home
residences, and this money could be better spent on additional
landscaping or City street furniture where needed. Please note

The Planning Office agrees with the Engineering Department that
the alternate commitment to contribute money for off-site
improvements is appropriate. We do not recommend lowering the
score in the site design GMP category. Additional landscaping of
the 700 East Hyman property would not seem to be the best use of
the funds, as there is now a well thought out landscape scheme.
We recommend that you follow the Parks Superintendent's recommen-
dation that the funds go towards site improvements at the Ice
Garden. Verbally Bill Ness elaborated that the mall area does not
need more benches or trees, but there is a real need for im-
proving the Ice Garden. Additionally, if that facility were
moved, the street furniture could go with it.
PLANNING OFFICE RECOMMENDATION: The Planning Office recommends
the Planning and Zoning Commission to confirm your original score
of the 700 East Hyman residential GMP application, considering
the proposed modifications to (1) change the west stairway entry
as built and (2) contribute a sum of $1,100, which had been
committed for installation of benches, bicycle racks and tree
grates as part of the original site development plan, to the city
of Aspen's Parks Program for the purpose of installing a bicycle
rack and planter box at the entrance of the Aspen Ice Garden.
