ORDINANCE NO. ~
(Series of 1985)
AN ORDINANCE APPROVING AND AUTHORIZING THE CITY MANAGER TO
ORGANIZE THE EXISTING CITY DEPARTMENTS INTO FIVE AGENCIES, TO BE
KNOWN AS "PLANNING AND DEVELOPMENT AGENCY',, "PUBLIC SERVICES
AGENCY"~ "PUBLIC SAFETY AGENCY", ADMINISTRATIVE SERVICES AGENCY
AND "LEISURE SERVICES AGENCY" ~
WHEREAS, pursuant to Section 6.3(g), the City Manager is
required to exercise supervision and control over all executive
and administrative departments, and recommend to the Council any
proposal he thinks advisable to establish, consolidate or abolish
administrative departments; and
WHEREAS, pursuant to Section 6.9 of the Aspen City Charter,
the City Council, upon the recommendation of the City Manager, may
by ordinance, consolidate or merge City departments performing
various administrative functions of the City of Aspen; and
WHEREAS, the City Manager has recommended the organization of
existing City departments into five agencies as a means for pro-
viding more efficient administration, including cost saving,
improved communication, and increased productivity; and
WHEREAS, the City Council, recognizing the benefits to the
City to be derived therefrom, desires to approve and authorize the
City Manager to organize the existing City departments into agen-
cies as hereinafter set forth.
NOW, THEREFORE~ BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the existing City departments are hereby organized into
five agencies, as follows:
- Plannin~ and Development Agency; which shall include the
"City" function of the joint City/County departments of Planning,

Building and Environmental Health, to be headed by the Planning
Director.
- Public Service Agency, including the City departments of
Engineering, Electric, Water, and Streets, to be headed by the
City Engineer.
- Public Safet~ A~ency, including the City police department
and the "City" function with regard to the joint City/County
departments of Communication and Animal Control, to be headed by
the Police Chief.
-Administrative. S~rv~..ce~. A~nc~, including the Finance
Department, Municipal Court and City Clerk, to be headed by the
Finance Director.
- Leisure Services ~ge.ncy, including Parks, Recreation and
the Wheeler Opera House, to be headed by the Parks Director.
Section 2
In those instances where ordinances of the City with respect
to existing City departments provide that certain functions and
authority may be performed or exercised by the City Manager, the
City Manager is hereby empowered to delegate in writing such func-
tions and authority to the department head designated hereinabove
as an agency head; however, nothing herein shall be construed to
diminish or take away from the City Manager any authority or
responsibilities of the City Manager currently prescribed by City
Charter or ordinance.
Section 3
This ordinance shall supercede provisions of any existing
ordinances of the City to the extent they are in conflict with
organization approved and authorized hereby, and the City Manager
is hereby empowered to render interpretations to the extent of any

conflict, which interpretations shall be binding upon the ~minis-
trative service.
Section 4
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional in a court of competent jurisdiction, such portion shall
be deemed a separate, distinct and independent provision and shall
not affect the validity of the remaining portions thereof.
Section 5
A public hearing on the ordinance shall be held on the ~
day of ~ , 1985, in the City Council Cham-
bers, Aspen Cl~ty Hall, ~s'pen, Colorado.
