AN ORDINANCE ADOPTING THE 1985 HOUSING ~UTHORI~Y;QUALIFICATION
GUIDELINES FOR LOW, MODERATE, AND MIDDLE INCOME OWNERSHIP HOUSING
PROJECTS, RENTAL HOUSING PROJECTS, LODGE AND COMMERCIAL DEVELOP-
MENT, AND DEVELOPMENT OF EMPLOYEE HOUSING~UNITS AS SET FORTH IN
RESOLUTION NO. 85-2 OF THE BOARD OF COUNTY COMMISSIONERS OF THE
HOUSING ~UTHORITY OF THE CITY OF ASPEN AND PITKIN COUNTY
WHEREAS, pursuant to the Municipal Code of the City of Aspen,
as amended, Housing Income - Eligilibity 'Guidelines and Housing
Price'Guidelines are to be established by the City Council; and
WHEREAS, pursuant to prior resolutions and ordinances of the
City, specifically Ordinance No. 12 (Series of 1984), Ordinance
No. 19 (Series of 1983), Ordinance No. 23 (Series of 1982) and
Ordinance No. 79 (Series of 1981), the City Council established
Employee Housing Income - Eligibility 'Guidelines and Housing Price
~Guidelines for prior year~; and
WHEREAS, Resolution No. 85-2 of the Board of Commissioners of
the Housing Authority of the City of Aspen and Pitkin County, a
copy of which is annexed hereto and incorporated herein, has been
submitted to the City Council which resolution sets forth the 1985
Housing Authority qualification guidelines for low, moderate and
middle income ownership housing projects, rental housing projects,
lodge and oo~mercial development, and development of employee
housing unit~; and
WHEREAS, the City Council desires to adopt said Housing Auth-
ority Resolution No. 85-2 as the 1985 qualification guidelines for
low, moderate and middle income ownership, rental and development
of employee housing units and by virtue of the enactment of this
ordinance to supercede and amend all prior resolutions and ordin-
ances of the City pertaining to housing guidelines but only to the
extent inconsistent with the provisions of this ordinance.

NOW, THEREFOREf BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen hereby adopts the
1985 Housing Authority qualification guidelines for low, moderate
and middle income ownership housing projects, and development of
employee housing units as set forth in Resolution No. 85-2 of the
Board of Commissioners of the Housing Authority of the City of
Aspen and Pitkin County, a copy of which is annexed hereto and
incorporated herein.
Section 2
The regulations and guidelines set forth and adopted herein
shall supercede, to the extent inconsistent with the provisions of
this ordinance, all prior resolutions and ordinances of the City
of Aspen, specifically Ordinance No. 79 (Series of 1981), Ordin-
ance No. 23 (Series of 1982), Ordinance No. 49 (Series of 1983),
and Ordinance No. 12 (Series of 1984~; provided further, that the
provisions of resolutions and ordinances pertaining to employee
housing guidelines shall remain in full force and effect to the
extent not inconsistent with the regulations and guidelines
adopted herein.
Section 3
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
