AN ORDINANCE A~ENDII~ SECTION 24-3.2 OF T~E NUNICIPAL CODE
TO PEP/qlT PARKII~ LOTS AND PAI~KING STRUCTURES AS CONDITIONAL
USES IE THE OFFICE ZONE DISTRICT, PROVIDED THAT THE
PARKII~ LOTS ON STRUCTUNES DO NOT ABUT ~AIN STREET
WHEREAS, the Planning Office has recommended the amendment of
Section 24-3.2 of the Municipal Code to allow parking lots in the
Office Zone as a conditional use, excluding the Office Zone along
Main Street~ and
WHEREAS, the Aspen Planning and Zoning Commission (hereinafter
"Commission") did hold a public hearing on June 18, 1985 to consider
amending Section 24-3.2 in accordance with the Plannin9 Office's
recoFmendations and did vote unanimously in favor of the code amend-
ment but did add parking structures to the proposed amendment~ and
WHEREAS, having considered the recommendation of the Commission,
the City Council desires to amend Section 24-3.2 of the Municipal Code
as set forth herein below.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Aspen, Colorado:
That Section 24-3.2 of the Municipal Code of the City of Aspen be
and the same is hereby amended such that the list of Conditional
Uses in the O-Zone District reads as follows:
"Fraternal lodges, boarding houses, shop craft industry, restaur-
ants, antique store, furniture store, bookstore,, florist, visual
arts gallery, music store (for the sale of musical instruments),
nursery-day care center, art, dance and music studio, mortuary,
broadcasting station, provided, however, that the above-listed
conditional uses shall be considered (1) only for structures
which have received historic designation, '{2) for no more than
two (2) such conditional uses in each structure (not including
within such limitation accessory dwelling units recognized as
moderate income housing by an approved housing plan), and (3)
only when off-street parking is provided with alley access for
those conditional uses along Main Street. Satellite Dish
Antennae. Commercial parking lot or parking structure that is
independent of required off-street parking, provided that it not
be located abutting Main Street."
If any section, subsection, sentence, clause, phrase or portion
of this ordinance is for any reason held invalid or unconstitutional
by any court of competent jurisdiction, such portion shall be deemed a

separate, distinct and independent provision and such holding shall
not affect the validity of the remaining portions thereof.
A p~lic hearing on the ordinance shall be held on the /~ day
of~ , 1985, at 5:00 P.M. in the City Council Cham-
bers, Aspen City Hall, Aspen, Colorado, fiften (15) days prior to
which hearing notice of the same shall be published once in a news-
paper of general circulation within the City of Aspen.
INTRODUCED, READ AND ORDERED published as provided by law by the
